REASON FOR APPEAL (X) A Variance to Section 280A Subsection 3 ( ) A Variance to the Zoning Ordinance ( ) is requested for the reason that Form ZBl (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce proctical difficulties or unneces- sary HARDSHIP becouse the land area would permit in excess of five parcels under existing zoning areas. The physical dimensions of the property however precludes each lot from having a minimum required road frontage. 2. The hardship created is UNIQUE and is not shared by all properties alike. in the immediate vicinity of this property and in this. use distri!:t becouse 'of tqe above setforth physical di- mensions. of the property the applicant would be prejudiced in the proper use of his property and access over a 25 ft. right-of-way for ingress and egress to and from No. BayviewRoad and from the rear three parcels will still result in building plots substantially in excess of the dimensions and square footage as re- quired in existing zoning ordinances. Surrounding properties are physically lo- cated such that they are not confronted with this problem. 3. The Variance would abserve the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the property, as proposed to be divided into building lots and plots, will contain fewer lots than permitted under the existing zoning ordinances and access over a 25 ft. common right-of-way which will cause no inconvenience or difficulty to such lots, for ingress or egress to and from No. Bayview Road or in anyway depreciate surrounding property values. Fisher Senior Building Inspector FROM: Jerry Goehringer, Chairman c Your Letter dated December 21, 1981 Concerning Private Road #21, Southold Appeals #774 and 775 DATE: January 30, 1982 SUBJECT: Dear George: o t I Your correspondence dated December 21, 1981 with attachments have been reviewed concerning the above private road No. 21, Southold. There has been no final action of the Board of Appeals on Appeals No. 774 and 775 (Jordon M. Iserman and O. Stanley Eldredge), inasmuch as it was the determination of the Board of Appeals at a public hearing held May 27, 1965 that the appeals be recessed until such time as the subject right-of- way has complied with the general specifications [see attached copy of minutes]. At such time as we are advised that the improvements have taken place within this right-of-way as required by the May 27, 1965 resolution, the board will then officially take action. On these C.O. 's I like to state if there is access to an approved street or approved access. I am referring to Private Road #21, South old , located on the south side of North Bayview Road Extension. I have found the minutes (copy enclosed) for this access, (ZBA #774, Tserman .,),~ I~' and ZBA #775, Eldredge) but there is no final action by the Board. I could find only the file of Eldredge. Several houses have been built on this road. I did not inspect, but was aware of this access construction. A C.O. was issued to Richard Norklun after he received a letter (en- closed) from Howard Terry, Building Inspector, stating the access must be built to comply to the Board's specifications. I feel sure that it was, and I haven't heard of any problems from people using this access in all seasons.
