Laws Art. 16 Sec. 280A Subsection 3 4. PREVIOUS APPEAL A previous appeal (_(has not) been made with respect to this decision of the Building Inspector ar with respect to this property. Such oppeal was ( ) request for a special permit ( ) request for a varionce and was made in Appea'l No. ................................Dated REASON FOR APPEAL (X) A Variance to Section 280A Subsection 3 ( ) A Variance to the Zoning Ordinance ( ) is requested for the recson that applicant is the owner of a parcel on Peconic Bay Boulevard approximately 100 feet in width extending from the Boulevard to Peconic Bay,(as shown on the attaohed sketch) and wishes to sub- divide the property as shown. This was denied by the Building Inspec- tor for the reason that approval of access was required under Section 280, Subdivision A of the Town La~. Form ZBl (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce proctical difficulties or unneces- sary HARDSHIP because it would deny applicant reasonable use of her property. This extends from Peconic Bay Boulevard to Peconic Bay a distance of over 497 feet. In close proximity to the Bay there is located a dwelling and garage. The remainder of the property is vacant. Unless applicant is able to sub-divide the parcel into three lots in accordance with the sketch attached, the additional property from her dwelling to the Boulevard would be a burden on her. 2. The hardship created is UNIQUE and is not shored by all properties alike in the immediate vicinity of this property and in this use district because in many parcels the dwelling is located more to the center of the plot, or closer to Peconic Bay Boulevard, therefore making subdivision impracticable sinoe that would ruin the outlook from the dwelling to the Bay. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because this is a neighborhood in which there are many rights of way less than fifty feet in width providing access to more than one dwelling, both to the west and to the east of this location. Dear Mr. Terry: Phyllis R. Moore is the owner of certain property at Laurel des- cribed as follows:- ALL that certain tract, piece or parcel of land being a part of the farm formerly owned by John Hallock, situate, lying and being at Laurel, formerly Franklinville, in the Town of Southold, BEGINNING at a point on the southeasterly side of peconic Bay Boulevard, distant two hundred feet southwesterly measured along said Boulevard from a stone monument marking the division line between the lands formerly of Thomas H. Harper and G. B. Woodhull; and running thence S. 210 7t E. parallel with said division line between the lands formerly of Harper and Woodhull to peconic Bay; thence southwesterly, along said Bay, 100 feet more or less, thence northeasterly, parallel with the first mentioned course to peconic Bay Boulevard at a point thereon distant 100 ft. from the point of beginning measured along said Boulevard; and thence northeasterly, along the southeasterly side of said Boulevard, 100 feet to the point or place of beginning. The above described parcel is shown on the enclosed print. Mrs. Moore has agreed to convey the center lot to her brother, D. Stanley Raynor. This lot would be 165 feet in length and 100 feet in width. There would be a 15 foot right of way over the Peconic Bay Boulevard parcel of Mrs. Moore and this parcel would, of course, be subject to a 15 foot right of way to Mrs. Moorets Bay parcel on which there is now a residence. The Raynor parcel would also include a 10 foot right of way to the beach. We would like to secure from the Board of Appeals approval of access as required in Section 280a of the Town Law.
