with the. ZONING ORDINANCE ARTICLE III SECTION 306
SUBSECTION
THE SPECIAL EXCEPTION IS REQUESTED BECAUSE: This lot is all the property
that is left on the south side of Pine Neck road, betwewn North BayView
Road and Oakwood Drive having a frontage of 99.59Ft on Pine Neck Road
and a depth of 150ft -frontage on Oakwood drive.
Several plans have been drawn to try and make the proposed dwelling
conform tb the required setbacks and tb meet the owners requirements.
The proposed 70ft overall house is the nearest that we can come
to m@€i~~~g the owners requirements. It is impossible to meet the
the required side yard and corner lot setbacks. It is also impossible
to widen the lot.
A special exception is requested to reduce the front yard requirem
ent on Oakwood Drive to 19ft. This will maintain the 10ft minimum side
yard on the East side. The house will be setback 51ft from Pine Neck Road
in line with the house to the west, thus not interfering with the sight lin
that would be created with the normal 35ft setback from each street.
W~th this deep setback no traffic hazard would be created, and no
additional safety hazard would be created.
If the Board of Appeals wishes we would be willing to reduce the
10ft east side yard to increase the setback from Oakwood Drive.
Any further information will be supplied upon request of the
Board.

c, The work covered by this application may not be commenced before issuance of Building Permit..
d. Upon appravol of this application, the Building Inspector will issue a Building Permit to the applicant. Such
permit shall be kept on the premises available far inspection throughout the progress ,of the work.
e. No building shall be occupied or used in whole, or in part far any purpose whatev~r until a Certificate of Occupancy
shall have been granted by the Building Inspector.
