with the ZONING ,oRDINANCE ARTICLE 10 SECTION 1007
SUBSECTION e
THE SPECIAL EXCEPTION IS REQUESTED BECAUSE Charles B. Ferguson, forwhom we are
General Contractors, proposes to construct a small one-story additi.on costing approximately
$2000.00 to hi.s exi.sting frame building at the i.ntersection of Montauk and Crescent Avenues.
This building has for the past 12 years or more been used by him as an art gallery and artist's.
studio. In April 1957 :"rhen zoni.ng became effective here this hecame a non-conforming usage
in an "A" resi.dential ~one. The proposed addition will exceed in cost 50% of the assessed
valuation of thepresent building "rhi.ch was a fonner barn. The purpose of this addition is
very much in the publiq interest. A group of SU'1lJ1ler residents here are nxious to hold
exhibits of paintings by well known artists and have agreed to rent the xisting "Red Barn Studio"
from Charles B. Ferguson, who will then be forced to have other space fo his actual studio
in which to paint, store hi.s equipment, etc. The plan of the addi tion h been carefully
worked out to adhere to required set-packs, hence its odd shape.

c. The work cov,ered by this application moy not be com menced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such
permit shall be kept on the premises available for inspection throughout the progress of the work.
e. No building shall be occupied or used in whole or in port for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.

The proposed extension of the art studio owned by
Charles B. Ferguson on Crescent Avenue, Fishers Island, New York
has been brought to my attention as my property adjoins his.
Since the Crescent Avenue side of my property is the only land
adjoining Or facing my property that is not zoned for business,
it is obvious why I should be interested in limiting the
expansion of the art studio, which represents a non-conforming
use of the property. Nevertheless, because the owner of the
property is Charles B. Ferguson and I have confidence in his
tact and judgement, I will not oppose his proposed extension.
An examination of the tuilding plans submitted to me by
Mr. H. Lee Ferguson, Jr. show that the addition will be a
single story, 1011 lying strvcture of not more than ninli feet
in height and that no part will be visible from my house.
My acquiescence is based. upon this understanding.
I reserve the right to object to any additional physical
extens.ion or. to any commercial use of the present or new
premises apart from the use to which Mr. C., B. Ferguson has
put.'the'Property up to the present date.

of a studio addition on hj.s eld.sting art gallery and studio at the jntersection,
of l.!ontauk and Crescent Avenues. 1,\Te are also attachjng a t" scale drawing
shot-ring the plan of this addition but not sho.ring the one foot overhang of the
roof which does not enter the picture.
In reference to your letter of February 28t.t,. you mentioned Article X
SectionlOO6 Subsection E but in my copy of the Zoning laws section ((1106 has no
subsection E iand I am wondering if you are actually referring to Section.1Ik:l7
whj.ch has to do with an addition rendering a street intersection dangerous.
If this is th~ case I think you will find that this a~dition is so located as
to offer no ha~ard at this intersection.
I mn l1bt clear as tow-hat goes on fron here. Is it necessary for you to
automatically turn 0.0..'11 this application 2nd have the matter brought to the
Board of Appeiils? I would appreciate your outlining the procedure from here on.
.fe are extremely anxious to start on this in order to have it comnleted at. the
beginning of the summer season. I would appreciate your calling me collect if
I can clear up anJ' questions in order to e xpedi te the thing.

I have looked over the sketoh which YOU had attached to
your letter or Febuary ,27th and dated 2/23/61. '
This meets the requirements or setback, side li~e etc., the
only thing I can see that may require anything else is the requirements
of Article X sectionl006, subsection e if the proposed addition will
cost more than 50% of the value of the present building. '
This is a main 'building onth~premises and as such will
require a permit for the addition; Ordinarily an,artist studio on the
same lot with a dwelling would be an accessory building and not require
a permit. Also the fact it is on a lot by'it'sself makes it a non-conformh
use.

You certainly are a good taxi driver and Perry and I greatly appre-
diated being: delivered to the boat in such good time the other day.
You will recall row talking to you about a problem my brother had in
that he has very little room on which to build an addition to his Red Barn
Studio at th.e junction of Crescent and Montauk Avenues. Because I wish to
be perfectly sure of what he can and cannot do I am enclosing a plot plan
showing in r.ed the proposed Studio addition. ~ brother wishes to put this
on so he cati have it as a Studio in which to paint, while the existing structure
is uaed for exhibits.

What ,I have tried to do is keep this structure at least ten feet from
the property line at the rear, property of Anthoine, and twenty feet from
the street at the northeast end. What I would particularly like to know is
whether or not this is all right and whether or not, if he chose, he could
extend theiline which runs roughly north and south so long as it remained at
least twenty feet from the Crescent Avenue line at both the front and north
east end. ~ suppose these setbacks will govern the nearest point of the
building, wnether it be a side wall or overhanging roof. Is this correct?
If I am not mistaken I believe you said it would be necessary to make
application to the Board of Appeals for a variance to permit this addition.
Will that, then, require a hearing? I feel very sure thst my brother wants to
go ahead on this addition provided he can surmount the various zoning problems
and I would appreciate your assistance so we can prepare a definite plan for
the structure.
