REGARDINGBELFI
.
A residential building permit was issued Nov. 15 1960 and a
certificate of Occupancy april 3 1961.
The lot is 1&0 x 210 A plot diagram was furnished with the
application for the building permit and showed a house 25 x 40 with a
small extension at onepoint 4 ft. A side yard of 31 ft and 15 ft
which left 10 ft unaccounted. An architect's plan was used.
When the building inspector noticed construction had started .on
the extension he went down and saw Belfi andtold him he was working
without a permit'which was required and Belfi said he thought the
original permit was good. Howard spoke about side yards and Belfi
said. he knew he had plenty. He said he had put up the extension
with help from friends and two carpenters and that everything had
been done in 24 hours which is the reason Terry had not seen the
men at work.
Terry told Belfi to stop what he was doing,and left a violation.
A t that time there were no shingles. and the garage was without the d.oor.
The roof shingles were being placed.
In spite of the warning Belfi finished the kmx addition
now complete and in use. It consists of a garage and a large
room.

lots and other lots in the developement.

Any~istake was of Belfi's own making and might well be classified
as reckless.
He showed an indifference to regulations in that he did not obtain
a building permit as required. He continued construction after he
was notified he was in violation. He has been practicing law for 30
years according.to his own statement.
He is!eeking rel.~ to escape the results of his own act. He has
made the expenditure recklessly without regard to the fact that by his own
measurements he was bringing anAauthorized addition within the forbidden dist-
ance from the p~roperty line. ~
A varianc~ cannot legally be granted for reasons which also apply
to others in the same neighborhood as the hardship claimed is common to
all
