SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 10,476 sq. ft, parcel is vacant and has 120 ft. frontage along the east side of Gillette Drive and a lot depth of+- 87 feet. BASIS OF APPLICATION: Building Department's December 18, 2002, Notice of Disapproval, amended January 9, 2003, citing Section 100-244B, in its denial of a building permit to construct a new dwelling with a setback of less than 35 feet from the front and rear property lines. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 17, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a new dwelling at 30 feet from the front property line, from the +- 40 sq. ft. front porch, and +- 24 feet from the rear line, at its closest point (excluding a rear step area of less than 30 sq. ft.), as shown on the April 11, 2002 survey prepared by Peconic Surveyors, P.C. with applicant's sketched-in steps. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed new construction measures 60'8"by approximately 27'8" on a lot of 10,476 sq. ft. The new dwelling is of a modest size comparable to others existing,in the neighborhood. The majority of the proposed house will meet the 35 ft. front yard code requirement, except that a small • Page 2—May 1,2003 Appl.No.5299—Paul Dimzio 38-3-17 at East Marion portion of front 5' x 8' covered porch will require variance relief. The rear of the house also requires relief for +-11 ft. from the 35 ft. rear yard setback requirement. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant is building a modest house on a small lot, which is typical in the surrounding community. 3. The requested relief is not substantial in relation to the 5' x 8' front porch, and is substantial in relation to the code's 35 ft. rear setback. 4. The difficulty was self-created when the applicant acquired the lot and designed a house. 5. No evidence was submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. As noted in Reason 1, the relief is consistent in the neighborhood which consists of small 10,000+- sq. ft. lot sizes. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member Goehringer, and duly carried, to GRANT the Variances as applied for and shown on the survey map prepared by Peconic Surveyors, P.C. dated April 11, 2002, SUBJECT TO THE FOLLOWING CONDITION: That the front covered porch shall not be enclosed. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. First, to document my concerns regarding this request for a variance #5299, and second to express my surprise at the relatively new policy of scheduling these hearings during the business day. I own the lot immediately to the south(lot 33 on the survey provided) and have concerns regarding both the front and south side setbacks. Clearly the proposed structure is not centered on the property and having it positioned closer to my lot than to the vacant lot to the north is an obvious question and concern. The 40 plus. feet between the proposed structure and the north property line seems luxurious when compared to'the 19 foot distance to the south property line. The question of whether 19 feet even meets the minimum side yard setback comes to mind as well. A review of your files would reveal that I have done some work on my home. One of the early proposals did not meet the 35 feet minimum front setback and was-rejected. The same treatment for this proposed structure would seem to be the only appropriate course of action, given the precedent that your office has set. It should be noted as well, that while my dwelling is served with public water, I have a functioning well in very close proximity to the southwest corner of Dinizio's lot(my northwest corner). This well is used for irrigation purposes,to ensure the viability of the$75,000 worth of landscaping and improvements that I invested in my property last year. I, of course, would have significant concerns if the cesspools ended up encroaching on the well,impairing its usefulness. The other topic I would like to comment on is the scheduling of the hearings. A call to your office revealed that there is now a policy of conducting the hearing during business hours. This is an extreme hardship for me, as well as it must be for all of us who have second homes in the area. This is especially annoying in my case because I personally visited town hall during evening hours when I was dealing with the board. DINIZIO: I have the letter and some comments on it. I'm looking for relief on a rear yard setback to build a small house for my son who's presently working for me the same as everybody else in the neighborhood is looking for and has received and I guess my comments on his letter is the 35' setback I do have in the front but I don't have in the back like anybody down there doesn't have in the back and Mr. Bascard's garage is 3' off my property line. He wants to talk about setbacks with the garage. CHAIRWOMAN: He was objecting to the 19' sideyard from his property line,however I would note that it is more than sufficient and does meet the requirement. MR. DINIZIO: Also he states the concerns of his $75K worth of landscaping and my cesspools. I would suggest that the board see where his cesspools are because his cesspools might be closer to his well than mine. And I don't know what he puts in his cesspools but what's going in mine and I'm sure it's the same thing. CHAIRWOMAN: I went down there and it's a brand new house and the front yard setback, the existing house would meet the setback the only portion of the setback that would not be met would be the 5x8 covered porch you have in the front. MR. DINIZIO: The BD told me the measurement wouldn't be taken from that it would be taken from the house. CHAIRWOMAN: That's not accurate, I'm not fooling with you. MR. DINIZIO: That's just what they told me. CHAIRWOMAN: That's not what's in the NOD, they cited you on that. DINIZIO: In his letter he says he has public water. MEMBER ORLANDO: Then the Health Dept. would regulate the distance from the well but we're not using wells so it's not part of the equation. I think it's a very modest house for the neighborhood and no other questions. MEMBER HORNING: No questions.
