SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 14,241 sq. ft. parcel has a frontage of 50 feet (radius) along the east side of Knoll Circle in East Marion. The property is improved with a new foundation for a dwelling, under construction and referred to under the September 19, 2002 Building Permit No. 28754-z. The property is situated along a bulkhead 131.18 in length along Spring Pond. BASIS OF APPLICATION: Building Department's January 9, 2003 Notice of Disapproval, amended January 28, 2003, citing Sections 100-244 and 100- 239.4B, in its denial of a building permit for new construction within 10 feet on a single side yard, and within 75 feet of the bulkhead. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 17, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a new foundation, as an alternative, to renovations and additions to the former dwelling structure, a portion of which is 9.4 ft. from the side property line and a portion of which will be not less than 73 feet to the existing bulkhead. The building and site details are detailed as shown on the maps prepared by Fairweather-Brown Design Associates, Inc. last dated July 20, 2002 (Plans Si, Al-A8, El). The north and waterside locations of the new foundation are identical to the location of the original house, and the addition to the south is stepped back to increase the formerly established waterside setback. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: •i, _fir , . Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant will retain the pre- existing, non-conforming setbacks noted in the Southold Town Building Dept. Notice of Disapproval, while constructing a new single family dwelling on the original building footprint. This re-building project will not change the character of the adjacent neighborhood, which has a significant density of developed parcels with similar non- conforming setbacks. 2. The benefit sought by the applicant cannot be achieved by some other method, feasible for the applicant to pursue, other than an area variance, because the applicant is re-building on a parcel with pre-existing, non- conforming, setbacks from one side yard and a bulkhead. 3. The relief requested is not substantial because the pre-existing, nonconforming setbacks will not change. 4. The difficulty has not been self-created, since this property was;already improved with a single family dwelling that had the same setbacks, pre-existing zoning code, which will remain after new construction. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the,neighborhood. The applicant will comply with the terms and conditions set forth by the Southold Town Board of Trustees in its Wetlands Permit and with regard to the adjacent wetlands, has a Letter of Non-Jurisdiction from the NYS Department of Environmental Conservation, and the new construction will retain the pre-existing, non-conforming setbacks from the side yard and bulkhead on Spring Pond. 6. The relief offered is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Ll A Variance clue to lack of access required by New York Town Law-Section 280-A. fI Interpretation of the Town Code, Article Section Ll Reversal or Other A prior appeal Ll has t4 has not been made with respect to this property UNDER Appeal No. Year Page 2 of 5-Appeal 'ication-Chin BACKGROUND This appeal is from the Building Department's Notice of Disapproval dated January 9, 2003 (amended January 28, 2003) of demolition which had been completed and construction which had been commenced pursuant to that Department's Building Permit#28754Z dated September 19, 2002. By deed dated September 25, 2000, Ms. Chin purchased the subject one-family waterfront dwelling located in Section Two of Gardiners Bay Estates - the map for which was filed in 1927. While there is some new construction, the structures in Gardiners Bay Estates primarily are (1) summer bungalows, or (2) summer bungalows which have been renovated, expanded and/or converted into year-round use. The majority of the lots in the area are nonconforming under the Southold Town Code. The subject premises consists of 2 lots (#33 and #34) on the filed map and totals 14,240.95 square feet (to bulkhead). The pre-existing non-conforming dwelling was similar to many in the area in that it was an asbestos shingled house constructed on a partial concrete block foundation. The original house's setbacks were: Front yard 40.0' + Back yard (to bulkhead) 56.0' + South side yard 35.0' + North side yard 9.4' +' Outside the foundation on the north side is a walk with a concrete wall and chain link fence. That wall, walkway and fence remain, as does the northwest corner with adjacent foundation walls. Photographs of the original dwelling are annexed. Ms. Chin determined that she wished to renovate, upgrade, and update the house. She enlisted the services of the local architectural firm of Fairweather-Brown Design Associates, Inc. Prior to preparing and submitting plans to any agency, a discovery hole was dug and detailed structural inspections were made. It was determined that the foundation wall surrounding the northwest corner of the structure met NYS building code and was sufficiently strong to support the planned construction. The side yard for that pre-existinuorthwest Nn corner is 9j nonconforming according to Code §100-244.- It also was determined, ifiowever, that the majority of the rest of the existing foundation was substandard and illegal under the NYS building code. (For example, the bottom of the original trench footings were only 16" below grade - not 36' as required by the code.) Accordingly, there was no alternative to removing the substandard structures and, as set forth in the submitted building plans, construct new foundations in their stead. Because (1) much of the foundation was unsafe and required removal, (2) the first floor interior space was to be redesigned, and (3) a partial second floor was to be added, the deck and the walls of the original house were designated for removal. Based on an application dated May 1, 2002 with supporting documents, the Southold Town Board of Trustees held a hearing and issued a determination dated May 30, 2002, approving the proposed construction with a minimum setback from the existing wood bulkhead of 56.2' The New York State Department of Environmental Conservation issued a letter of non jurisdiction dated June 19, 2002. Plans for the reconstruction were submitted to Suffolk County Department of Health Services ("SCDHS"). By determination dated August 12, 2002, SCDHS approved the proposed upgrade and relocation of the septic system. On September 9, 2002, a site plan, a full set of building plans, and copies of the Trustees' permit, the DEC letter of non jurisdiction and the SCDHS approval were submitted to the Southold Town Building Department.' A review of the site plan reveals the following: ' The plans submitted to the Building Department are identical to the plans submitted to the Trustees, DEC and SCDHS. Page 3 of 5-Appeal Application- 1. Much of the northern, eastern and western foundation footprint of the house is maintained. 2. The front of the proposed house is stepped back 3 times in order to maintain the required 35' front yard setback. 2. The minimum south side yard is proposed as 21.8." 3. While the location of the original foundation of not less than 56' from the bulkhead is maintained, the proposed addition is located more than 73' from the bulkhead with most of the addition being in excess of 75' from the bulkhead. 4. With the exception of a 7 1/4" encroachment by the pre-existing northwest corner of the foundation (which structure is to be retained), the 10' required side yard on the north is maintained. The second page of the submission to the Building Department (page Al) sets forth the plans and specifications the builder is to follow in retaining the northwest foundation corner and pouring the new foundation. The northwest corner and foundation walls are cross-hatched to indicate that that portion of the existing foundation is to remain in place. The rest of the building plans provide the necessary detail with respect to the proposed construction of the first floor and the addition of the partial second floor. The building plans together with the site plan clearly reflect the original (and current) intention with respect to the construction. After analysis of the submitted building plans and the site plan, the Building Department issued Building Permit#28754Z dated September 19, 2002, to "CONSTRUCT ADDITIONS AND ALTERATIONS TO AN EXISTING SINGLE FAMILY DWELLING AS APPLIED FOR PER TRUSTEE AND DEC CONDITIONS AS REQUIRED." Site- demolition occurred December 2 through 7, 2002. Conforming to the plans, footings were commenced on December 11, 2002. The foundation walls were poured on December 17, 2002, and the forms removed on December 20, 2002. Snap ties were removed and walls parged on January 4, 2003. The first foundation inspection was made by Southold Building Inspector John Boufis on January 6, 2003. Building Department's Notice of Disapproval dated January 9, 20032 was the subject of a conference with the head of the Building Department and the person who had written the Building Permit almost 4 months before. Although a full set of building plans were submitted and presumably reviewed in September, it was asserted that the site plan was unclear and the Building Department refused to rescind its Notice of Disapproval. The Disapproval is two-pronged: (1) although the now existing construction conforms to the building plans and site plan submitted to and approved by the Building Department, "upon inspection, it was determined that the entire house was demolished and was being rebuilt" and apparently now falls within the rubric of new construction; and (2) because the project is now deemed to be new construction, it must conform to §100-239.4.B requiring that the now claimed new construction be 75' from the bulkhead. Photographs of the current site are annexed. ANALYSIS 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties, if granted, because: (a) As a general rule, the lots in Gardiners Bay Estates are non-conforming under the Town Code and many, if not most, of the dwellings in the area have insufficient setbacks similar to or greater than those in the instant case. Rather than an exception, nonconformity is probably the rule in Gardiners Bay Estates. (b) The de minimus nonconformity of 7 1/4" on the north side and 56' on the water side are precisely the same nonconformities which existed at the site since the enactment of the Southold Code in 1957. 2. The benefit sought by the applicant CANNOT be achieved by some method, feasible for the applicant to pursue other than an area variance because: Acting in reliance on the Building Permit, the site was prepared for foundation pouring 2 The Disapproval was amended on January 28, 2003, "to correct [that] the dwelling setback to the bulkhead" was 56.2' rather than the originally stated 57.' • Page 4 of 5 -Appeal App', on- Chin in conformity with the plans approved by the Building Department more than 4 months previously. Construction proceeded pursuant to those plans until the January 6, 2003 foundation inspection. The foundation is completed and in the location reflected on the plans submitted to the Building Department. See January 7, 2003 foundation location survey. Despite her justifiable reliance on the issuance of the Building Permit and the belief that construction according to that Permit would pass inspection, Ms. Chin now is faced with the costly prospect of having to redesign the project, rip out the new foundation, and commence construction anew. She also is faced with the probability of the house not being completed in time for use during the summer of 2003. All because a misunderstanding of the plans submitted in September 2002. Had the plans been rejected in the first instance on the grounds now stated, then (a) an appeal could have been taken at that time or (b) the plans could have been amended and the project. 2. The amount of relief requested is not substantial because: (a) The._71/4"on-the_no.rtl_and_the_now claimed waterside nonconformity_were pr-e existing. The foundation locations on the north side and on most of the waterside are identical to the locations of the original house. The addition to the south is stepped back to increase the waterside set back to more than 73.'. (b) The substantial efforts to keep the additions within Southold's zoning requirements are patent from the submitted plans. For example, the northwest corner and wall of bedroom #2 was stepped back approximately 1' 8" in order locate the addition in conformance with the 10' side yard setback. 3. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the proposed structure will result in (a) the elimination of a substandard structure on a substandard (and, in places, unsafe) foundation and (b) the construction of a dwelling that conforms to the building codes. The new structure will be an enhancement to the neighborhood. 4. Has the alleged difficulty been self-created? ( ) Yes. ( X ) No. Ms. Chin obtained all the necessary approvals and relied on the Building Permit issued by Southold Town. While retaining existing north and waterside setbacks, care was taken to conform to the Southold Code as illustrated by (a) the 3 step backs proposed on the front side of the house to maintain the requisite 35' front yard setback, (b) addition's location of the south side more than 21' from the property line, (c) the step back of the proposed addition on the waterside to more than 73,' and (d) with the exception of a 7 1/4" encroachment by the pre- existing northwest corner, the maintenance of the 10' setback on the north. Construction proceeded in conformity with the Permit and the submitted plans. Those plans had the approval of the Southold Town Trustees, the NYS DEC and the SCDHS, and, for 4 months, the approval of the Building Department. This matter is before the Board only because a portion of the pre-existing foundation was substandard and not capable of supporting the proposed dwelling. Had that foundation been sufficiently strong so as to conform to the NYS building code, Ms. Chin would not have been required to make the within application for relief and construction would have proceeded to conclusion. 6. Additional information about the surrounding topography and building areas that relate to the difficulty in meeting the code requirements: (attach extra sheet as needed) The site is small and hemmed in by road, property lines, and Spring Pond. While maintaining one pre-existing non-conforming set back of 9.4' on the northwest corner, the house was designed with care to bring the structure into conformity with the Town Code and NYS building code. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6 NYCRR Part 661) no permit is required under the Tidal Wetlands Act. The proposed addition/renovation is to maintain the existing footprint on the water side of the home. There will be a slight addition of fill to bring the 9' contour outside the house envelope. This will change grade <l'xl'for 30'. Fill will be clean topsoil. The concrete wall is to be removed on the south side of the home and the proposed addition is to replace the existing concrete patio as shown on the site plan. The residence, with the proposed changes should not cause any new impact to the wetlands, in fact there will less, as roof run-off will be directed to dry wells. Hay bales will be placed as directed, during construction and any other recommended practices you may suggest will be implemented. The only other disturbance we foresee might be a necessary septic system upgraded, to meet SCHDS standards, and again proper care will be taken during this process to assure nothing affects the local wetlands. The bulkhead was constructed during the '1930's and has been maintained to date. Application for repairs are currently being made by Costello Marine. Rather, it was made only after the January ' 2003 foundation inspection. DEBORAH DOTY ESQ: Good morning, it's Deborah Doty. I have here the affidavits of posting. I'd like to thank the board for advancing this hearing from the May session to today. As you know we've been left with an open foundation for more than 3 months. Previously there had been a nonconforming structure on the lot- the northwest corner was 9.4' from the property line and essentially there've been 3 bites at this apple and the most recent one was really quite painful. The first bite was we originally submitted a set of plans and specifications to the BP in April of 2002 at that point in time there was NOD by the BD. After discussing it with the BD, they withdrew the NOD even though the grounds stated were substantially the ones they are now disapproving the project on. We went ahead, we took our plans and specifications with minor changes and when I say minor I mean internal changes not the overall structure outside and we got Trustee approval, DEC letter of nonjurisdiction and Health Dept. approval. We then submitted the plan specifications to the BD in September 2002 and got a building permit. Demolition occurred we called for a foundation inspection when the project was disapproved because of the nonconforming sideyard and because we are 56' from the bulkhead both of those nonconformities have existed since the house was built. The BD now has determined this is new construction and not a renovation of an old substandard dwelling. For more than 3 months we've been with an open foundation on the property and nothing has happened, well virtually nothing, something has happened the old wall that's adjacent to the walkway into the basement door has now collapsed and we are going to have to replace the wall and I'm going to request the board amend the application to include a request the variance be granted with respect to the building of that wall on the north side on the walkway. I have a picture of it prior to it's collapse. CHAIRWOMAN: I see where that is. MEMBER ORLANDO: Access to the basement? MS. DOTY: Yes it is. CHAIRWOMAN: What's the height of the wall? MS. DOTY: 3 or 4' and it encroaches - it's sideyard setback is 8' at best. JOHN BERTANI, BLDR: There's 16" of exposure • - MEMBER GOEHRINGER: So you're absolutely correct. MS. DOTY: I'm going to amend the application right now. CHAIRWOMAN: We don't have a setback on that do we? MS. DOTY: It's 8' from the sideyard at it's closest. 11' otherwise. That wall was going to be reinforced but I have to assume and I'm not a geologist or an architect or a builder but I have to assume part of the collapse was the movement of the soil away from the foundation area the leaving it there for 3 months, the winter weather, the runoff everything else caused it to fall down. MEMBER GOEHRIGER: A lot of freeze. MS. DOTY: I think it just gave up. MEMBER ORLANDO: You submitted a concrete foundation plan to the town and they didn't pick up on that so I don't see why- CHAIRWOMAN: Let's do this- MS. DOTY: There was a change in fact. MEMBER ORLANDO: You didn't put a measurement on the survey but you- MS. DOTY: But it was indicated to remain. CHAIRWOMAN: What we think, let's go through a couple of things the variance on the north side 9.4 instead of the required 10 it's diminimus. The 56' to the bulkhead is going to be maintained for the existing construction the new construction will be either between 75+77 so it will be either very slightly below or above the required setbacks from the bulkhead. The issue of the collapsed retaining wall I don't want to see you come back here. MS. DOTY: In fact I'd like to get a house up. CHAIRWOMAN: We're going to ask you to take this letter, go to the BD and just say yes -no and please come back with an amended NOD today at 11:15am. I will tell them that you have requested this and that it's important that I get back here at 11:15. CHAIRWOMAN: Tell them the ZBA has asked them to make a decision in writing or not in writing if it's not applicable so we can clear this matter up today. MEMBER GOEHRINGER: See Damon because he wrote this. CHAIRWOMAN: I'll make a motion to recess this hearing until 11:15. 11:15 CHAIRWOMAN: How did you fare? MS. DOTY: It was 4 against 1. Mike Verity reviewed what we asked him about that wall that had collapsed and whether or not they would require that the NOD be amended if we have to reconstruct that wall and he indicated to us that we could reconstruct that wall regardless of what's on the variance that it is not included as part of the house and it could be even 4' from the sideyard and he said not to worry. MEMBER GOEHRINGER: Could I just have Ms. Doty again the actual setback of the new foundation or the foundation closest to the bulkhead, what the distance is to your knowledge. MS.DOTY: The existing foundation closest to the bulkhead - I shouldn't say existing because it didn't exist- the old foundation was 56' from the bulkhead a new foundation a portion of the new foundation was poured in that same location therefore the current foundation there was 56' at it's closest point. It stepped back however to 77.2' and the entire design of this house with the exception of those 2 nonconformities reflects that we have conformed with all of the sideyard/frontyard/backyard setbacks. It's gone to great lengths in stepping back the front of the house for example to keep us out of the front yard.
