Soof {r' Ow4da„..„iii rrk SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned: PROPERTY FACTS/DESCRIPTION: The applicants' property is located along the west side of Harbor Lane in Cutchogue. The property contains a total area of 28,000 sq. ft. as merged and is identified on the Suffolk County Tax Maps as 1000-103-1-27 and 1000- 103-1-28. Existing is a two-story frame dwelling with garage and deck addition (CTM 27), at 40 feet from the front line along Harbor Lane and 19 feet from the northerly side property line. Also existing are an accessory swimming pool and shed in the rear yard. CTM 28 is vacant. • FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 12, 2002, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: BASIS OF APPLICATION: Building Department's August 22, 2002 Notice of Disapproval, citing Section 100-25 in its denial of an application for a building permit for a merger determination. The reason stated in the denial is that the lands are merged due to common ownership for a period of time after May 1983. APPLICANT'S REQUEST: Applicant requests a Waiver of Merger, pursuant to Article II, Section 100-26 to unmerge CTM 103-1-28 from CTM 102-1-27. Each contains an area of 14,000 sq. ft. as deeded and first created in 1962. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. The August 6, 2002 title search, prepared by Aquebogue Abstract Corp. indicates that CTM 27 was transferred 5/11/62 to Chester Orlowski, who constructed a dwelling, and on 11/3/1967 transferred the premises to the applicant (Robert C. White). CTM 28 was vacant and was acquired by Robert F. White, the applicant's father prior to 8/31/78, fir. , '1' • Page 2—March 20,2003 Appl. No.5214—Robert and Leona White 1000-103-1-27,27 at Cutchogue who transferred the property to his son, Robert C. White. On 4/30/1987 the vacant lot was from transferred from Robert C. White to Leona M. White. 2. The 1994 development of "Harbor Park Homes is adjacent to these premises (CTM 20.11, 20.12, 20.7, and others) and is developed with single-family residences on lots similar in size to the lot in this waiver request. 3. In considering this application, the Board finds that the waiver will recognize the original lot lines, as created and as described in deeds dated 5/11/1962 and 11/3/1967 for CTM 27 and CTM 28. 4. Information was submitted by applicant to show that the waiver will avoid an economic hardship. 5. No evidence was introduced to indicate that construction on lot 34 will have a detrimental effect on nearby environmental or flood areas. The topography of the land is flat. RESOLUTION/ACTION OF THE BOARD: Now, therefore, on motion by Chairwoman Tortora, seconded by Member Oliva, it was RESOLVED, to GRANT a Waiver to unmerge CTM 28 from CTM 27, as applied for and shown on the July 11, 2002 Map of John C. Ehlers, L.S.
