FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF MAY 15, 2003
Appl. No. 5295 - Mary C. Berdinka CTM 1000-114-10-25 (and 26)
Property Location: 655 and 725 Youngs Avenue, Mattituck.
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without an adverse effect on the environment if the
project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's property .78 acre is located along the
north side of Youngs Avenue in Mattituck, and consists of properties identified on the
Suffolk County Tax Maps as #25 and #26. The June 26, 1961 survey prepared by Otto W.
VanTuyl & Son for the southerly portion, CTM #26, shows an existing one-story frame
home centered on the property with 20 ft. side yards and 40 ft. front yard setback, and a
property size of +-13,500 sq. ft. with 100 ft. frontage along Youngs Avenue, depth of
140.91 feet along the north side line, width of 100.49 feet along the rear line, and 131.10
feet along the northerly side line. The December 9, 1970 survey prepared by VanTuyl &
Son for the northerly portion, CTM #25, shows a property size of +-19,700 sq. ft. with
frontage of 166.23 feet along Youngs Avenue, depth of 131.10 ft. along the south side line,
width of 150.48 feet along the west rear line, and depth of 117.57 feet along the north side
line.
FINDINGS OF FACT
BASIS OF APPLICATION: Building Department's October 9, 2002 Notice of Disapproval,
citing Section 100-25 in its denial of an application for a merger determination and building
permit. The reason stated in the denial is that CTM #25 is merged with the adjacent
southerly lot (CTM #26).
APPLICANT'S REQUEST: Applicant requests a Waiver of Merger, pursuant to Article II,
Section 100-26 to unmerge a vacant parcel of+-19,700 sq. ft. referred to as CTM #114-10-
25 from the adjacent northerly land, CTM #114-10-26 of+-13,500 sq. ft.
The Zoning Board of Appeals held a public hearing on this application on October 17, 2002
and January 16, 2003, at which time written and oral evidence were presented. Based
upon all testimony, documentation, personal inspection of the property, and other
evidence, the Zoning Board finds the following facts to be true and relevant:
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:

1. The August 12, 2002 title search, prepared by Commonwealth Land Title Insurance Co.
indicates that CTM 25 was acquired by Emily R. Mather on March 7, 1964, and on January
26, 1971 the lot was conveyed to Robert P. Berdinka and Mary C. Berdinka, his wife.
Robert P. and Mary C. Berdinka owned the adjacent CTM 26 house lot until Mr. Berdinka's
passing in 1982, when both properties became vested in Mary C. Berdinka as surviving
tenant by the entirety.
2. In considering this application, the Board believes that the `original lot lines' of lots in
this specific area were established by deeds in 1957.
3. Many lots in the neighborhood are developed with single-family residences on lots
similar in size to this property. Grant of a Waiver of Merger for the vacant lot, adjacent to
the house property, would recognize a lot consistent with the size of a majority of the lots in
this area.
4. CTM #25 and #26 are adjacent to lots shown on the Subdivision Map of Deer Park.
5. The waiver of merger will not result in a significant increase in the density of the
neighborhood. The parcels subject to this proposed lot un-merger, as previously created
or recognized, are situated in an established neighborhood of similarly size parcels along
the westerly side of Youngs Avenue in Mattituck. The waiver will unmerged a lot that will
be the last unimproved parcel in the area, and if the lot is developed with conforming
setbacks according to its size, it will not produce a density that is not in harmony with the
adjacent lots in this neighborhood. Parcels of similar sizes are characteristic for this
neighborhood along Youngs Avenue. Lot 25, which is currently vacant, will be
approximately .45 acre, and Lot 26, which is developed with a single-family residence, will
be approximately .33 acre.
6. The waiver will avoid economic hardship. This applicant's husband passed away
in 1982, within a year prior to the effective date of the 1983 merger law, and the family was
unaware of the effect of this statute on their properties.
7. The natural details and character of the contours and slopes of the lot will not be
significantly changed or altered in any manner, and there will not be a substantial filling of
land affecting nearby environmental or flood areas. There are no known environmental
issues related to this application.

December 9, 1970 survey prepared by VanTuyl & Son.
This action does not authorize or condone any current or future use, setback or other
feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action

hearing will be held by the SOUTHOLD TOWN BOARD OF APPEALS at the
Town Hall, 53095 Main Road, P.O. Box 1179, Southold, New York 11971-0959,
on Thursday, April 17, 2003, at the time noted below (or as soon thereafter as
possible):
1:30 p.m. Mary C. Berdinka #5295. Request for a Lot Waiver under
Section 100-26, based on the Building Department's October 9, 2002
Notice of Disapproval, citing Section 100-24 states that 1000-114-10-25
containing +- 19,700 sq. ft. is merged with an adjacent land area identified
as 1000-114-10-26 containing +- 13,500 sq. ft. Applicant proposes to
unmerge the nonconforming properties. Location: 655 and 725 Youngs
Ave., Mattituck; Parcel Nos. 1000-114-10-25 and 26 are adjacent to lots
shown on the Map of Deer Park.
The Board of Appeals will hear all persons, or their representatives, desiring to

determination by the Board of Appeals to determine whether or not
these parcels qualify for a "waiver" under the.merger provisions of
Article II , Section 100-26 of the Southold Town Zoning Code .

Town of Southold in making this review determination:
1 . Copies of my recent tax bill for both ( all ) lots .
2 . Copies of deeds dated prior to June 30 , 1983 for all lots .

Applicant's Reason#1: The vacant lot in question was purchased separately from the
adjoining merged residence parcel of applicant, and applicant learned only this Summer
that the lot were merged.
Applicant and her husband, Stanley Siejka, acquired the adjacent residence parcel, tax lot
26, in 1961, by deed in Liber 4941 cp 430. Mr. Siejka died in /%W6; and the residence
became vested in applicant's name alone,then Mary S. Siejkys surviving tenant by the
entirety. After her marriage to Robert Berdinka, she conveyed the residence to Mr.
Berdinka and herself, in 1967,by deed in Liber 6171 cp 529, copy attached. In 1971, Mr.
Berdinka and she purchased the adjoining vacant lot from Emily Mather, which is the lot
in question, by deed in Liber 6879 cp 446, copy attached. After Mr. Berdinka's death in
1982, both properties became vested in Mrs. Berdinka as surviving tenant by the entirety.
Mrs. Berdinka continued to keep the residence and vacant lot, paying separate tax bills on
each, without realizing they eventually merged. She inquired during the recent publicity
on upzoning vacant lots, and learned of the merger. The vacant lot has been kept
wooded and is not used as part of the residence property. It would create a severe
financial hardship, both in terms of los of value and overpayment of taxes as a separate

Applicant's Reason#2: The vacant lot is of comparable size to other developed lots in
the neighborhood, and its separation from the residence parcel would not create any
adverse impact. If not separated,the vacant parcel would be an unwieldy appendage to
the residential lot, and under current zoning no accessory structure could be built upon it
except in the rear yard.
Addressing the specific concerns of Article 100-26: a _.
1. The waiver will not result in a significant density increase because all of the lots in
the neighborhood are already built upon. This is a neighborhood that was developed in
the 1960's or earlier, and it was contemplated that this density would exist in this
neighborhood-A-copy-of the tax maps showing improved lots, marked as "I",}s^
enclosed.
2. The lot is consistent in size with others in the neighborhood, as evidenced by the
tax map submitted with the application.
3. It is well recognized that the value of a single lot is considerably more than an
oversized size yard to an existing residence. Mrs. Berdinka has four children, and many
grandchildren, and while she has no plans to sell or build upon the residence, she feels it
is important for her estate planning to have a resolution of this matter.
4. The lot is level and will not need fill. There are no wetlands, environmentally
sensitive areas, or flood areas on or near the lot.

1:45 p.m. Mary C. Berdinka#5295. Request for a Lot Waiver under Section 100-26,
based on the Building Department's October 9, 2002 Notice of Disapproval, citing
Section 100-24 states that 1000-114-10-25 containing+- 19,700 sq. ft. is merged with an
adjacent land area identified as 1000-114-10-26 containing+- 13,500 sq. ft. Applicant
proposes to unmerge the nonconforming properties. Location: 655 and 725 Youngs
Ave., Mattituck; Parcel Nos. 1000-114-10-25 and 26 are adjacent to lots shown on the
Map of Deer Park.
CHAIRWOMAN: Is someone here who would like to speak on behalf of the
application?
ABIGAIL WICKHAM, ESQ: Yes my name is Abaigail Wickham on behalf of Mrs.
Berdinka I have the final receipt for the mailing I have the affidavit of posting and I have
a map of the residence on the west side of this property I have 2 copies. I will be brief
the application shows that this lot is not only very comparable in size to every other lot in
the neighborhood which all of which are built upon. It was created years ago Mrs.
Berdinka wasn't aware until 7 months ago when she started reading in the newspaper
about potential upzoning and vacant lot issues that this was merged. She was paying a
separate tax bill on this property since she acquired it in the 70's she had no idea the lots
had merged her house is next door she's always maintained that it's a separate piece of
property and she was really quite shocked when she found out it was under the zoning
ordinance merged. I've done a lot of real estate out here and I can put into the record that
as a vacant lot this property would be worth at a very minimum$125K probably
considerably more as an adjunct to her residence parcel it would all anywhere from 25 at
the most $50K there's a huge financial difficulty if it is not recognized as a separate lot.
In addition to the current tax bill of$862 and all of the prior years tax bill which she has
paid on this property she would be out of pocket on. She has similar to the lady previous
she has considered this as part of her assets that she may need to fall back on. She bought
this property shortly after she remarried and she and her husband thought that it would be
part of their retirement unfortunately he died quite a number of years ago Mrs. Berdinka
has on her own since her first husband died raised 4 children all of whom live and work
in the town of Southold they each have a spouse who lives and works in the town of
Southold this is a local family none of them had any idea this was a problem until very
recently until very recently so I would ask that you seriously consider granting the
application. You have in your package a map of 2 tax map sections that apply to this lot
and the surrounding properties and you will notice I have written on an H notation all
houses on every single and adjoining lot with the exception of this one vacant parcel
which is actually larger than her house parcel the map I just submitted to you shows that
the house is 20' from the line so it will not create an encroachment.
CHAIRWOMAN: Were the lots ever deeded in S&S ownership. Were they always held
as Mary and Robert Berdinka?

MS. WICKHAM: Originally the house piece was held as Stanley and Mary Berdinka.
On his desk that property was in her name alone after her marriage she put it in both
names as people normally do and they bought the house together the vacant lot together
as well.
CHAIRWOMAN: So in '67 Robert Berdinka, Mary Berdinka owned the house lot and
they owned the vacant lot in common ownership as well.
MS. WICKHAM: They bought that in 1971.
CHARWOMAN: In '67 the improved and in '71 the vacant and they didn't
checkerboard it.
MS. WICKHAM: They didn't know they needed to no.
CHARWOMAN: The only other thing I was going to ask the survey you just showed us
I know I went out and I looked at the property and there are other structures on there I
want to kind of just talk about that a little bit Mrs. Wickham.
MS. WICKHAM: There's an attached garage which would be attached to the house
which would be shown on the survey I'm not sure it shows it as a separate garage maybe
some boats that their 4 children or their spouses like to use for storage those will be gone
soon I hope if the weather holds up.

Re: Chapter 58 — Public Notice for Thursday, April 17, 2003 Hearing
Dear Sir or Madam:
Please find enclosed a copy of the Legal Notice describing your recent application. The Notice will
be published in the next issue of the Long Island Traveler-Watchman newspaper.
1) Before March 29th: Please send the enclosed Legal Notice, CERTIFIED MAIL, RETURN
RECEIPT REQUESTED, with a cover letter and a copy of your survey (or map filed with this
application) showing the new construction area, or map with details of your request to all owners of
land (vacant or improved) surrounding yours, including land across any street or right-of-way that
borders your property. Use the current addresses shown on the assessment rolls maintained by the
Town Assessors' Office (765-1937) or the County Real Property Office at the County Center,
Riverhead. If you know of another address for a neighbor, you may want to send the notice to that
address as well.
2) before April 9th: Please make arrangements to pick up the sign poster, for posting at your
property for seven days commencing April 9th; the sign should remain up until the day of the
hearing. Securely place the sign on your property facing the street, no more than 10 feet from the
front property line bordering the street. (If you border more than one street or roadway, an extra
sign is available for the additional front yard.) If you need a replacement poster board, please
contact us.
3) Before April 11th, please either mail or deliver to our office your Affidavit of Mailing (form
enclosed) with parcel numbers noted for each, and return it with the white receipts postmarked by
the Post Office. (Also, when the green signature cards are returned to you by the Post Office,
please mail or deliver them to us before the scheduled hearing, if possible.) If any signature card is
not returned, please advise the Board at the hearing and return it when available. These will be kept
in the permanent record as proof of all Notices.
4) On April 17th, please file yourAffidavit of Posting with our office to show proof that the sign
has been posted for seven (7)days.
If you do not meet the deadlines stated in this letter, please contact us promptly. Thank you for
your cooperation.
