No. 5286 - Paul and Maureen Cacioppo Property Location: 195 Skunk Lane, Cutchogue; 1000-85-3-2.2 Southold own Clerk SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 9,655 sq. ft. vacant parcel has a frontage of 117.30 ft. along Bay Avenue (a/k/a Skunk Lane), with 70.85 feet in depth along the north side, 87.31 feet along the south side, and 136.12 feet along the east (rear) line. BASIS OF APPLICATION: Building Department's October 15, 2002 Notice of Disapproval, citing Sections 100-244B and 100-33, in its denial of a building permit to construct a new dwelling at less than 35 feet from the front and rear lot lines, and for approval of the existing garage in a side yard location. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 20, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the • Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct a new dwelling with a detached garage. The September 9, 2002 survey, amended October 8, 2002, prepared by John C. Ehlers, L.S. shows a proposed house 47 feet x +- 27' at 20 feet from the front line and 11 feet from the rear line, at its closest points. The existing 18' x 40' accessory garage will remain in its present location, defined as a side yard once the dwelling is constructed. The garage is 10 feet from-the north lot line and 8 feet from the rear (easterly) lot line. ADDITIONAL INFORMATION: At the March 20, 2003 public hearing, an alternative location was discussed between the board and the applicant's agent to consider modifying the angle of the house and increasing the front yard setback. The applicant on April 2, 2003, submitted a revised 3-28-03 survey map for a proposed alternative location with a 35 ft. front yard setback and 10 ft. rear yard setback, at its closest points. The south side 10 ft. setback is shown to meet the current setback requirements. 'r - - Page 2—April 17,2003 Appl.No. 5286—P.and M.Cacioppo 85-3-2.2 at Cutchogue REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Applicants agreed to revise the original plan (for a 20 ft. front yard) and offered a new location and design for a conforming 35 ft. front setback and 10 ft. rear yard setback on this 9,655 sq. ft. lot. The lot is narrow, quite small and irregular in shape, with a large garage existing for over 20 years in the northeast corner of the property. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling will be located with setbacks similar or greater than other dwellings existing in the neighborhood. The garage will be an accessory use located in a yard that gives the appearance visibly of a rear yard. 3. The amount of relief granted herein is not substantial. The north-south placement of the proposed home places it at 35 feet at its closest point from the front lot line facing Bay Avenue (Skunk Lane). 4. The difficulties were self-created in that the size of the lot and existing placement of the garage on an irregular shaped lot places structures in areas not permitted under the zoning code. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Tortora, and duly carried, to DENY the relief requested for a 20 ft. front yard, and GRANT Alternate Relief for placement of the dwelling, and existing garage, as shown on the survey prepared by John C. Ehlers, L.S. revised 3-28-03. CHAIRWOMAN: Good morning, Mr. Fitzgerald. JIM FITZGERALD: This is a copy of the survey. CHAIRWOMAN: Is that the survey we have in the record? It does show the setbacks of the existing houses but that's okay, I want the board members to have the survey. MR. FITZGERALD: There was a question recently as you may already know about whether or not the lot was recognized by the town and it turns out it is because the zoning board approved it in 1975 and apparently at that time the garage which already exists also existed when it was approved by the zoning board. The lot is relatively small to begin with and the existence of the garage on it makes the site of the dwelling a problem. We chose a modestly sized house and pictures of which I've just given you and I located it on the property in a position which would provide the maximum front and rear yard setback. You will see from the survey you have that some of the setbacks of the houses within 300' on the same side and in the same district are relatively small however they are not that small enough to take advantage of the regulation that would permit the setback we are asking for because of the average setback from the other houses. CHAIRWOMAN: Let me ask you a question because the setback you are asking for is considerably less that obviously from this survey what is already existing in the neighborhood a 22' front and an 11'rear. Why not turn the house around? Because what you've essentially done is you've taken the house and placed the whole length of this 47'house against the 87'property line which is -why not turn it around and put it next to the garage which would be more of a unit and your variances would be half of what you are asking for. MR. FITZGERALD: I presume that could be done. The Cacioppo's are here. How would you feel Mr. &Mrs. Cacioppo? MR. CACIOPPO: I just want to make sure I understand it. MR. FITZGERALD: We are just talking about turning the house 90 degrees so the major access of the house is parallel to Skunk Lane. CHAIRWOMAN: In other words this particular size and design of the house is for a rectangular piece of property- it's a railroad house. Why not do just what would amount to traditional houses which you have similar in the neighborhood and you'd still have your garage, yes it would be in a side yard, but it's going to be in a side yard anyway.
