No. 5270 - PAUL DAVIS (and Property of Van Bolt & Others) Seruthold Town Clerk Property Location: 1025 Ninth Street and 235 Linnett Street, Greenport; 1000-48-2-32.1 and 1000-48-2-33, respectively. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is a 5,625 sq. ft. vacant lot (except that it contains remains from an old foundation), with 50 ft. frontage along the north side of Linnet Street, Greenport, and shown on the Suffolk County Tax Maps as No. 1000-48-2-33. The adjacent property is a 20,168 sq. ft. improved lot with 112.94 feet along the east side of Ninth Street and 184.76 feet along the north side of Linnett Street, and shown as CTM 1000-48-3-32.1. Both lots are shown on the Map of Greenport Driving Park filed in the County Clerk's Office on December 1, 1909 (Lot Nos. 7, 8, 68, 69), and are more fully shown on the detailed map prepared by Stanley J. Isaksen, Jr., L.S. dated March 31, 2003. BASIS OF APPLICATION: Building Department's October 2, 2002 Notice of Disapproval, amended October 28, 2002, citing Section 100-30A.3 in its denial of a request for a lot-line change. The reasons stated in the denial is that the proposed lot line change is not permitted because the bulk schedule requires 40,000 sq. ft. of total area, lot width of 150 feet, and lot depth of 175 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 20, 2003 and April 3, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant is requesting variances under Section 100-30A.3, Bulk Schedule, for a modification of sizes for two existing lots: (a) lot area of CTM 32.1 [formerly 31.1 and 32], reduced from 20,168 sq. ft. to 18,557 sq. ft. and increased lot width from 184.76 ft. to 169.76 feet; and (b) lot area of CTM 33, increased from 5,625 sq. ft. to 7313.55 sq. ft, and lot width increased from 50 feet to 65 feet. cry Page 2-April 17, 2003 Appl. No. 5270-Paul Davis 48-2-33, 32.1 at Greenport REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. The properties subject to this area variance are in a very developed neighborhood consisting of many preexisting, non-conforming parcels approximately equal in size to the applicant's proposed properties, after the lot-line change is made, and will not result in a significant increase in the density of the neighborhood. The Applicant-Paul Davis proposes to build a dwelling on CTM 33, and wishes to increase the size of his lot by acquiring 1688.55 sq. ft. (15' x 112.57') from the adjacent property (CTM 32.1). This change will give him an additional westerly side yard of 15 feet, and will increase his lot from 5,625 sq. ft. to 7313.55 sq. ft. 2. The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance, because the applicant seeks to enlarge to size of pre-existing lot (CTM 33), while reducing the size of the adjacent lot (32.1), includes and combines Lot Numbers referred to as 7, 8 and 68 on the Map of Greenport Driving Park (GDP), and shown on the Isaksen survey dated 03-31-03 survey. This will create a more conforming parcel 33 (GDP #69), and allow more room for the applicant's proposed residence. 3. The requested variance is not substantial because the proposed construction on the applicant's lot (CTM 33, GDP 69) will meet the average neighborhood minimum setbacks within 300 feet of the property, and total lot coverage after construction will be +- 15 percent. The lot coverage for the remainder of the combined lots 7,8, and 68, also known as lot 32.1 will be increased to +-12 percent. 4. No evidence has been submitted to suggest that the proposed lot size variances will have an adverse impact on physical or environmental conditions in the neighborhood. The proposed variances will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood, or district because the applicant seeks to build on a larger, and more conforming size parcel, after the lot line change is finalized. 5. The difficulty for the applicant is self-created, since the applicant seeks to change a pre-existing lot line. 6. The relief offered to this applicant is the minimum necessary for this. applicant to enjoy the benefit of a new residence, while at the same time protecting and preserving the character of the neighborhood, as well as the health, safety, and welfare of the surrounding community. No. 5270—Paul Davis 48-2-33, 32.1 at Greenport RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Tortora, seconded by Member Goehringer, and duly carried, to GRANT the Variances as applied for and shown on the 3-31-03 survey map prepared by Stanley J. Isaksen, Jr., L.S., subject to the following CONDITION: This variance is limited to a total of two (2) lots, without any increase in density, and set forth below: (a) a lot area of 18,557.02 sq. ft. and 169.76 ft. of lot width along Linnet Street for the parcel affected by this lot size change, currently identified on the County Tax Maps as 32.1 which included Greenport Driving Park Lot#7, 8 and 68, and (b) a lot area of 7,313.55 sq. ft. and lot width of 65 feet for the parcel currently identified on the County Tax Maps as 33 which included Greenport Driving Park Lot#69. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. DAVIS: I'm not exactly sure what I need to do at this point. CHAIRWOMAN: Why don't you just get up and tell us a little story. I don't mean to be sarcastic,but when we first looked at this application we saw 3 lots and then we said these lots don't match the other lots, then we finally began to figure out what was going on so that's why at least I didn't maybe you can tell the board members. It's fairly clear to me. MR. DAVIS: I purchased a small lot in Greenport, 50x112 and in the cleanup process the next door neighbor offered to sell me a portion of his lot next door. We agreed to 15'. At which point I thought it would be very simple to buy 15'however I felt I had to apply for a subdivision so to speak and I've merged lot numbers from the adjoining lot, a couple of surveys, title searches, every detail you have requested I think I've accomplished. CHAIRWOMAN: What we have let's try to keep it simple and you correct me if I'm wrong. What is happening is you are taking the 15' from your neighbor's property. Your neighbor's property is going to become 1 lot, and you're going to have 1 lot so actually what we are doing is reducing the degree of nonconformity because what was 3 lots is now going to become 2 lots, correct? MR. DAVIS: No. What was 3 lots will become 1 lot that would be on the east side. CHAIRWOMAN: Let's see- you're going back even further than I am. I see what you're saying. Right now on the tax map it shows as 33.1 and 32 that's going to become 1 lot and your lot 33 and you're going to take the 15' from that what you are referring to as 1 lot and that's going to get a new tax map number. MR. DAVIS: Eventually, yes. CHAIRWOMAN: And you are going to get a new tax number or will you stay the same? MR. DAVIS: I couldn't answer that, I think I have to get another one.
