The Southold Town Planning Board, at a meeting held on Monday, May 12, 2003,
adopted the following resolution:
WHEREAS, the applicant proposes to amend the lot line between parcels SCTM#
1000-129-1-2 (Parcel 1) and SCTM#1000-129-1-3 (Parcel 2) and transfer 1.567 acres
from Parcel 1 to Parcel 2 where Parcel 1 would equal 1.567 acres and Parcel 2 would
equal 2.011 acres; and
WHEREAS all conditions of conditional final approval have been met; be it therefore
RESOLVED that the Southold Town Planning Board grant final approval on the surveys,
dated August 28, 2002, and authorize the Chairman to endorse the final surveys.

Peconic Bay Boulevard,Laurel,New York and JOHN R. McNULTY, of 865 Peconic Bay
Boulevard,Laurel,New York.
WHEREAS the parties hereto are tenants in common of certain premises(SCTM# 1000-
129-01-03)consisting of 3.135 acres as shown on survey of Joseph A. Ingegno,Land Surveyor,
dated August 9,2002; and
WHEREAS the parties wish to make a boundary line alteration with respect to said
parcel:
NOW THEREFORE,it is hereby agreed:
1. An application will be made to the appropriate Southold Town authorities for
permission to make a boundary line adjustment of existing Parcel 1 (SCTM# 1000-129-01-03 )
and existing Parcel 2(SCTM # 1000-129-01-02)as shown on said survey.
2. If such line adjustment is approved by the Southold Town authorities,Frank J.
McNulty and John R. McNulty will convey the westerly portion of the premises, consisting of
68,285.19 square feet, including the buildings and improvements thereon,to Frank J. McNulty
and Marilyn M. McNulty,his wife, so that it will be joined to Parcel 2 as shown on said map and
increasing Parcel 2(SCTM# 1000-1129-01-02)to 87,596.16 square feet. The boundary line
between said parcels will be the proposed boundary line as shown on said survey to wit,running
from land now or formerly of Half Hollow Nursery Realty Corp. S. 28 degrees 56 minutes 58
seconds East 204.53 to the northerly line of Peconic Boulevard.
3. Simultaneously,Frank J. McNulty and John R. McNulty will convey the easterly
portion of the premises consisting of 68,285.19 square feet to John R. McNulty so that the
boundary line of the Parcel 1 will be the proposed property line as shown on said survey running

This letter is in response to a proposed lot line change by John McNulty and
Frank McNulty at Peconic Bay Blvd. and Laurel Lane at Laurel, Southold Town. My
brother Richard Ehlers and I, John Ehlers, are owners of property on the south side of
Peconic Bay Blvd., opposite the proposed action. We have a couple of concerns that we
would like to address.
1. The configuration of the existing lots as shown on the proposed map does not agree
with the current tax map. The current tax map does not show the flag strip to Laurel
Lane as is shown on the proposed map. Was this lot already altered in some way?
2. The town requirements for a lot line change include spot elevations and areas subject
to flooding. The proposed map shows no spot elevations or areas of flooding. As you
can see from the copy of the Five Eastern Town Topo map attached to this letter there is a
low spot in the middle of this lot which collects water from the entire farm to the north.
Our concern is that the lot might in the future be further subdivided, filled, and built
upon,thereby eliminating this natural recharge area and causing the farm runoff to cross
the road and impact our property.

the following resolutions:
WHEREAS, the applicant proposes to amend the lot line between parcels SCTM# 1000-129-1-2
and SCTM# 1000-129-1-3 where; Lot 1 would equal 2.01 acres and Lot 2 would equal 1.57
acres; therefore be it
RESOLVED, that the Southold Town Planning Board, acting under the State Environmental

§ 58-1. Providing notice of public hearings.
Whenever the Code calls for a public hearing, this section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon.The board or commission
reviewing an application shall providefor the giving of notice:
A. .By-causing a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. 'By requiring the applicant to erect the sign provided by
the town, which shall be prominently displayed on the
premises facing each public or private street which the
property involved in the application abuts,.giving notice
of the .application, the nature of the approval sought
thereby and the time and place of the public hearing

Dear Chairman Orlowski:
Al the work session,you asked me to inquire of my brother if he would sign a restrictive
covenant prohibiting any further division of his property. I understand that since then he has
personally spoken with a member of the Planning Board or a member of the Planning Board staff
and indicated to them that he and his wife were unwilling to sign such a covenant.
They are already giving up their vested right to maintain a substandard lot and are making it a
conforming lot. In doing so they are creating a lot which is large enough to create two(2)legal
sized conforming lots. In effect they would be punished for eliminating a non-conforming lot.
They inform me that they have no intention,present or in the foreseeable future, of subdividing
their resulting lot. However, since the future is disclosed to us one day at a time, circumstances
may arise which would necessitate such a division. If such a division were legal in the future, it
seems untoward to impose such a financial burden at this time. It is difficult to ascertain any
legitimate zoning purpose in punishing someone who wants to eliminate a non-conforming lot. I
submit it establishes an unsavory precedent since the elimination of non-conforming lots is the
object of zoning and should be encouraged and not punished.
By raising this possibility,the Board has created a conflict of interest between me and my brother
and his wife. Therefore, I cannot represent them and request that all notices and communications
