My brother Richard Ehlers and I, John Ehlers, are owners of property on the south side of Peconic Bay Blvd., opposite the proposed action. We have a couple of concerns that we would like to address. 1. The configuration of the existing lots as shown on the proposed map does not agree with the current tax map. The current tax map does not show the flag strip to Laurel Lane as is shown on the proposed map. Was this lot already altered in some way? 2. The town requirements for a lot line change include spot elevations and areas subject to flooding. The proposed map shows no spot elevations or areas of flooding. As you can see from the copy of the Five Eastern Town Topo map attached to this letter there is a low spot in the middle of this lot which collects water from the entire farm to the north. Our concern is that the lot might in the future be further subdivided, filled, and built upon,thereby eliminating this natural recharge area and causing the farm runoff to cross the road and impact our property. I understand that since then he has personally spoken with a member of the Planning Board or a member of the Planning Board staff and indicated to them that he and his wife were unwilling to sign such a covenant. They are already giving up their vested right to maintain a substandard lot and are making it a conforming lot. In doing so they are creating a lot which is large enough to create two(2)legal sized conforming lots. In effect they would be punished for eliminating a non-conforming lot. They inform me that they have no intention,present or in the foreseeable future, of subdividing their resulting lot. However, since the future is disclosed to us one day at a time, circumstances may arise which would necessitate such a division. If such a division were legal in the future, it seems untoward to impose such a financial burden at this time. It is difficult to ascertain any legitimate zoning purpose in punishing someone who wants to eliminate a non-conforming lot. I submit it establishes an unsavory precedent since the elimination of non-conforming lots is the object of zoning and should be encouraged and not punished. By raising this possibility,the Board has created a conflict of interest between me and my brother and his wife. Therefore, I cannot represent them and request that all notices and communications be sent to them as well as to me.
