Dear Mr. Olsen:
The Southold Town Planning Board, at a meeting held on Monday, May 13, 2003, adopted the
following resolution:
WHEREAS, the applicant proposes to set off a 1.47 acre unimproved lot, located within the R-
80 Zoning District, from a 2.42 acre parcel with proposed right-of-way access from Boisseau
Avenue, in Southold; and
WHEREAS, the Zoning Board of Appeals has approved a variance (Appeal No. 4991) for the
proposed 1.47 acre lot set-off granting relief from the R-80 Zoning District Regulations; and
WHEREAS, all conditions of conditional final approval and the requirements of the Subdivision
Regulations of the Town of Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant final approval on the maps, dated as
revised January 2003, and authorize the Chairman to endorse the maps.
Enclosed please find a copy of the map that was endorsed by the Chairman. The mylar maps,
which were also endorsed by the Chairman, must be picked up at this office and filed in the
Office of the County Clerk. Any plat not so filed or recorded within sixty (60) days of the date of
final approval shall become null and void.

FINDINGS OF FACT
PROPERTY FAcTS/DESCRIPTION: Applicant's property consists of a total area of 2.43-acres
parcel with 229.71 ft. along the west side of Boisseau Avenue in Southold. The property is
improved at the west end of the property with a two-story frame dwelling and two accessory
buildings. The property is located in the R-80 Residential Zone Distdct on the westerly portion of
the property, and in the R-40 Low-Density Residential Zone District on the easterly portion of the
property.
BASIS OF APPEAL: The Building Inspector's May 1, 2001 Notice of Disapproval, citing Section
100-32 Bulk Schedule of the Zoning Code, based on applicant's request for a lot of less than
80,000 sq. ft. in the R-80 zoned portion of the property, in this proposal for a two-lot subdivision, or
set-off project. The westerly lot, proposed as Lot #2 on the Map of John C. Ehlers, L.S., is
proposed with a land area of 65,740+- sq. ft., inclusive of the 20.62 ft. strip extending from the
street.
RELIEF REQUESTED: Proposed Lot #2 with a total land area of 65,740+- sq. ft. The amount of
relief requested is 14,260 sq. ft., or 17.8% of the code requirement. (The remaining lot as
proposed (Lot #1) will conform to the minimum 40,000 sq. ft. requirement in the R-40 Zone
District.)
REASONS FOR BOARD ACTION, DESCRIBED BELOW: In considering this application, the
Board finds that:
1. Grant of an area variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The proposed rear lot will be a minimum of one
acre (43,560 sq. ft.) and is similar in size to other properties in the neighborhood. Nearby lots
range from 15,000+- sq. ft. to 2.1 acres. The total land area as exists with 2.43 acres is one of the
largest lots in the immediate area. The subdivision in the AHD Zoning District on the easterly side
of Boisseau Avenue is comprised of 50 or more lots containing lot sizes of 20,000+- sq. ft.
2. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to
pursue, other than an area variance. The total lot area is insufficient to create two lots in
conformity with the code.
3. The requested area variance is not substantial. The rear lot will meet 82% of the requirement;

the front lot will meet 100% of the requirement.
4. The difficulty has not been self-created and 'was created by the deeded size of the 2.43-acre
parcel, created more than 40 years ago,
5. The proposed vadance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district. No evidence has been submitted to
suggest that the proposed lot of 65,740+- sq. ft. in this proposed set off dMsion will have an
adverse impact on physical or environmental conditions in the neighborhood~

The Southold Town Planning Board, at a meeting held on Monday, April 14, 2003,
adopted the following resolution:
The public hearing was closed.
WHEREAS, the applicant proposes to set off a 1.47 acre unimproved flag lot, located
within the R-80 Zoning District, from a 2.42 acre parcel with access from Boisseau
Avenue in Southold; and
WHEREAS, the Zoning Board of Appeals has approved an area variance (Appeal No.
4991) for the proposed 1.47 acre lot set-off, granting relief from the R-80 Zoning District
Regulations; and
WHEREAS, the Southold Town Planning Board, acting under the State Environmental
Quality Review Act, performed an uncoordinated review of this Unlisted Action and
issued a Negative Declaration on April 9, 2002; and
WHEREAS, the Southold Town Planning Board granted sketch plan approval on April 2,
2002 on the maps dated December 10, 2001; and
WHEREAS, the Southold Fire District has determined in an April 2, 2003 letter that no
firewell is required; and
WHEREAS, the Suffolk County Department of Health granted approval of the action on
February 7, 2003; and

WHEREAS, the Suffolk County Water Authority issued a Letter of Water Availability,
dated November 26, 2002; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold
have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final approval on
the maps, dated as revised April 2002, subject to the following condition:
1. The submittal of the $5,000.00 Park & Playground Fee to the Planning Board
Office.
Approval is conditional upon the satisfaction of the above condition within six months of
the date of this letter, unless an extension of time is requested by the applicant and
granted by the Planning Board.

As you are the owner for the above application please be advised that a Local Law was adopted
at the regular meeting of the Southold Town Board on August 13, 2002 entitled "Local Law to a
Temporary Moratorium on Processing, Review of, and making decisions on applications for
Major Subdivisions, Minor Subdivisions and Special Use Permits containing Dwelling Units in
the Town of Southold". The Local Law Number 3. 2002 is attached.
The Local Law states that the Planning Board Office "shall not accept, review continue review,
hold hearing or make any decision upon any application for a subdivision, whether that
subdivision application was submitted prior to or after the effective date of this law" for a

In response to your request for comment regarding Ms. Martin's letter, stamped June 17,
2002 requesting a waiver of the Park and Playground Fee in the amount of $5.000, the
Planning Board has decided not to grant the request at this time. The decision was based
upon the following:
The application was submitted on March 3, 2002, following the increase in the
Park and Playground Fee. The fee was stated and shown in the application Packet
prior to submission.

The purpose of the Park and Playground Fee is to provide parks and playgrounds
and/or other recreational opportunities to all residents of the Town of Southold.
The fee can also be used to purchase open space for passive recreational purposes.
3. The Planning Board does not support waiving the Park and Playground Fee for
any subdivision application.

Re: Park and Recreation Fee
To Southold Town Board,
On September 20th, 2001, the Zoning Board of Appeals approved a Variance (Pending
Set-OffDivision) for my mother's property on Boisseau Avenue (Application Number
4991).
Since then, the Planning Board has notified us that we are to pay a $5000 Park and
Recreation Fee. I am making a personal appeal for a waiver of this fee.
This is a set-off from my mother's property. It is a family transaction with no
speculators. This transaction helps the both of us. My father died over 13 years ago, and
my brother died in 1995. My mother cannot take care of her property due to arthritis and
does not have the finances to pay for someone to do so. I will be helping her take care of
her property while paying her for the land however I can.
I am 29 years old and currently am employed as a teacher at Cutchogue East Elementary.
I am presently living with my mother due to the high costs of living in Southold Town. I
cannot afford this $5000 Park and Recreation Fee. It would create a severe hardship and
I ask you please to consider my appeal.

On September 20th, 2001, the Zoning Board of Appeals approved a Variance (Pending
Set-Off Division) for my mother's property on Boisseau Avenue (Application Number
4991).
Since then, the Planning Board has notified us that we are to pay a $5000 Park and
Recreation Fee. I am making a personal appeal for a waiver of this fee.
This is a set-off from my mother's property. It is a family transaction with no
speculators. This transaction helps the both of us. My father died over 13 years ago, and
my brother died in 1995. My mother cannot take care of her property due to arthritis and
does not have the finances to pay for someone to do so. I will be helping her take care of
her property while paying her for the land however I can.
I am 29 years old and currently am employed as a teacher at Cutchogue East Elementary.
I am presently living with my mother due to the high costs of living in Southold Town. I
cannot afford this $5000 Park and Recreation Fee. It would create a severe hardship and
I ask you please to consider my appeal.

Dear Mr. Olsen:
The Southold Town Planning Board, at a meeting held on Monday, April 8, 2002,
adopted the following resolutions:
WHEREAS, the applicant proposes to set off a 1.47 acre unimproved lot, located within
the R-80 Zoning District, from a 2.42 acre parcel with Proposed right-of-way access
from Boisseau Avenue, in Southold; and
WHEREAS, the Zoning Board of Appeals has approved a variance (Appeal No. 4991)
for the proposed 1.47 acre lot setvoff granting relief from the R-80 Zoning District
Regulations; therefore be it
RESOLVED, that the Southold Town Planning Board, acting under the State
Environmental Quality Review Act, do an uncoordinated review of thi§ unlisted action.
The Planning Board establishes itself as lead agency, and as lead agency, makes a
determination of non-significance and grants a Negative Declaration; and be it
FURTHER RESOLVED, that the Southold Town Planning Board grant sketch plan
approval on the maps dated December 10, 2001.
Sketch plan approval is conditional upon the submission of final maps within six months
of the date of sketch plan approval, unless an extension of time is requested by the
applicant, and granted by the Planning Board. The final maps, six (6) paper prints and
two (2) mylars, must contain a current stamp of Health Department approval and must
be submitted before a final public hearing will be set.

The Planning Board has reviewed the property and has decided that it is inadequate for
a reservation of land for park and playground use. Therefore, a cash payment in lieu of
land reservation will be required. The amount to be deposited with the Town Board
shall be $5,000 ($5,000 per vacant lot in the subdivision). Payment is required prior to
the final endorsement of the map.
The Sketch Plans have been referred to the Town of Southold Police and the Southold
Fire Department for review and comment.
Once we are in receipt of the above requested information, the application will be
scheduled for an upcoming work session.

Enclosed herewith please find the following in re the above

1) Check in the sum of $250.00 payable to the Town of
Southold for the application fee.

3) Letter of authorization signed by property owner, Barbara

4) 6 copies of the Sketch Plan done by Stanley J. Isaksen,

5) Copy of letter dated September 26, 2001, from Gerard P.
Goehringer, Chairman of the Town of Southold Board of
Appeals. This letter includes a variance determination,
unanimously granting a variance to allow for the proposed
set-off.
On behalf of my client, I respectfully ask the Board to
waive the Park and Recreation fee for this Set-Off. Please
consider that my client is 28 years old, and is young member
of the community who is trying to stay in the Town of
Southold. Anything that can be done to help keep this
process affordable would be greatly appreciated. This is
also not a sub-division in the traditional sense. My client
is only seeking to create one new buildable lot, which would
be behind the lot owned by her mother.
My client or I would be more than happy to meet with the
Planning Board to answer any questions which the Board may
have.

REASON FOR APPEAL
An undesirable change will NOT be produced in the character of the
neighborhood or a detriment to nearby properties, if granted BECAUSE:
· The neighborhood is comprised of varying sized lots. The Martin
property is the largest single-family home site in the area at 2.6 acres.
Nearby lots range from 15,000 square feet (1/3 acre) to 2.1 acres.
· The zoning district line intersects the subject property, with the easterly
200' lying within an R-40 zone and the remainder of the property in an
R-80 zone. Lot # I created by the proposed subdivision will conform to
the R-40 lot area requirements. Lot #2 will conform to the setback
requirements of the R-80 zone, but lacks the required 80,000 square
feet.
· The subdivision on the easterly side of Boisseau Avenue is comprised
of approximately 57 lots of approximately % acre and is in the AHD
zone.

2. The benefit sought by the applicant CANNOT be achieved by some method,
feasible for the applicant to pursue, other than the area variance BECAUSE:
· The total area of the existing property is insufficient to create two
conforming lots.
The amount of relief requested is not substantial BECAUSE:
· An 18% variance is requested. The resulting lots will conform to the
surrounding area.
3. The variance will NOT have an adverse effect or impact on the physical or

· The potential density of the area will be increased by only one unit.
