· is requested forthe reason that lots bought at different times but in the same name
wzth the result that at the time of the purchase of the second lot the two parce~
became one in the contemplation of the zoning ordinance. Applicant requests
under Article III Section 303 that the lots be separated so that permission may
be forthcoming from the Building Inspector for construction on Lot #66, on
compliance with other provisions of the ordinance. Applicant also requests
under Article X section iO00A that the remaining half of the lot, Lot #67, be

Without the granting of the above mentioned variance the applicant
would be unable to use lot #66 ss he intended at the time of the
purchase. A strict application would result in the ownership of a
useless parcel of land.

The majority of the parcels on the east side of Bay Shore Road on
this filed map are 50 foot parcels whereas the applicants parcel
is 100 feet in frontage.

CHARACTER OF THE DISTRICT because
The granting of this appl~ation would create two 50 foot lots thereby
conforming with the majority of the other lots in the i~nuediate

Dear Mrs. CsaJko:
In response to your letter of March 18th in which
you have exhibited considerable knowledge and interest
in the problems of Zoning, the Board has decided in
favor of the applicant with the condition that the
garage and newly constructed 16 ft. by 32 ft. dwell/ng
shall be separated, the house being moved to the rear
of the lot on a line established by the residences to
the South. Had this problem been presented to us in a
different way and ~lior to any construction we believe
this Board would have decided in exactly this manner.

Gentlemen:
On December 19, 1963, the Southold To~vn Board of Appeals denied the application of
charles Bumble on ~ehalf of Thomas Liggis to convert an ,,accessory building,, into a
dwelling. NOW, three months later, we are back at the same old stand and trying the
same old tl~ng in a new w~.
An application has now been made to divide a 100 foot lot into two 50 foot lots. If
this is granted, another application v~ll undoubtedly be received requesting permis-
sion to build a dwelling on the second lot.
zoning is explicit as to the size of a lot upon m~ich a dwelling m~y be constructed.
Therefore, there is no possible excuse for the ~oard to grant the division of t~is
lot. The claim that the immediate neighborhood is composed of ~0 to 60 foot lots
is dependant upon a decision as to just what compromises an immediate neighborhood.
If au immediate neighborhood is considered to be everything within several miles
of a particular spot, that is one t!~Yng. If, however~ we assume that an immediate
neighborhood would consist of everyth~%g say vrlthin a quarter mile radius, then we
may well note that the ratio of 50 foot to larger size lots is close to even in this
oarticular case. In ar~ event, the zoning laws are quite clever as to v~]at consists
of a dwelling size lot mud the A~opeals Board has marv times denied perr~[ssion to
break up a 100 foot lot into two 50 foot lots. ~ the case of adjoining lots, the
fact that t~ey were keot on seoarate trax bills is not real]~.; relevant.
~.~ I point out the. t, under the evidence provided at the last hexring, there is no
question but that no matter what ~.~. Li~gis claims he ,,thought. in re.~ard to t~s
proper'by, the fact is that a garage which was used by the only dwelling on the land
was constructed on what is now claimed to be the second lot -- and w]~ s~one would
put their ~vn garage on a piece of land w!~ich th~. dich~,t consider part of their
own home and therefore probably unusable at a later date is beyond me.
There is no point in going into details of the last hearing, sufficient to state
that the Board denied the application and in doing so made the follovring decisions:
1. ~r. Liggis: belief that he was the owner of two lots is not relevant and he is,
in fact, the owner of a parcel approximating 1OO x l~Owhich is a single lot for
zoning purposes;
2. the use of the lot for another dwelling would prevent the orderly and reasonable
use of adjacent properties;
3. the character of the existing and probable development of the uses in the dis-
trict would be adversely affected;
~. the conservation of proper~ values would be adversely affected.
No matter whetl~r ~e BoarC aecide~ to reconsider in regard to fact number one;
the Board is on record on facts number two through four and whether a dwelling is
built as an .accessory building ~ith a change of mind,, or as applied for as planned
now, it is still a dwelling and still comes under facts two tkrough four.
I have nezther the time nor the money to keep fighting this every time a n~w w~y to
a?peal is thought up. It is nV contention that the Board has ruled conclusively on
this matter and it is up to the Town at this point to see that the situation is re-
medied. The Board has stated that the purport~ a~cessery building is in fact a
partially completed dwelling and t~at, ~ sl~ case, the cost of this accessory
building is well beyond tn2 amount sllov~ble. T,,ere is no question that this is
net an accessory buildinE and has never been an accessoz~/ building.
I~ ',~uld seem to me tt~t there is only one question here: do we have zoning in
Southold Tov~ or don,t we? ~nd, ~I' w~ don,t really have zoning laws, let,s admit
it and then sit back and wait to see how long it vrlll tsd~o to tucn S~G~old Town
into s~tother Coney Island ~Z people interested on]j in a profit.
