Work Session:

IV. For Discussion Items. IV. 1. Canine Unit - 9:00 a.m. Appointment - Chief Cochran
appeared before the Town Board to discuss a canine unit for the Police Department. Supervisor
Horton asked him to come in for a brief discussion on this due to the proliferation of drug activity in
Greenport. There was gunfire in Greenport last week. A dog was brought in to enhance the
department's efficiency in the case. The Chief reported an incident where screens were cut in an
occupied house recently. A canine unit would have been very useful in such an instance. He said that
having a canine unit would be a definite plus to the Town. Supervisor Horton asked Chief Cochran to
do the logistics and put together a package for the Town Board to review. The Chief said that there
would be some costs and commitment for such a unit and he will put the package together for the
Town Board. IV. 2. Historic Preservation/LWRP - Councilman William Moore presented a five
(5) point package that he was asked to put together from the last meeting. Mr. Moore reported
that he conferred on it with Bill Sharp of Historic Preservation in Albany. The draft historic
preservation law that they came up with is a bare minimum law regarding "Certificates of Demolition".
It is more than what we now have, but less than what was proposed before. There is also a tax relief
incentive built into it. It will go to the Planning & Zoning Committee once the Town Board gives the
general direction to proceed in. The question is the Board content to just do the demolition or do they
want to go beyond that with faCade easements and restrictive covenants? The Board agreed that they
should just go with the bare minimum demolition so that they can just get the LWRP finished. A
meeting of the Planning and Zoning Committee was set for 7:00 p.m. Wednesday, May 28, 2003. IV.
3. Policy on Waiving Fees. Currently there is no written policy. It had been removed several years
when a review of policies was conducted by the Town Board. It was their intent at that time that there
should be no waiving of town fees and that that the removal of the policy would interpret it as such.
However, it has become apparent that a clarification by the Town Board is needed. The East Marion
Fire District is requesting a waiver of fees to the Planning Board and Zoning Board of Appeals to set-

off a single building lot in order to separate it from the fire department operations. The Town Board
placed resolution number 322 on the agenda clarifying their position on waiving of fees. Copies of
this resolution when certified will be distributed to all town departments. IV. 4. Church Lane -
Hiring of Planning/Legal Counsel. (Resolution No. 288 5/6/03.) Thomas Twomey & Frank Isler of
Twomey, Latham, Shea & Kelly Law Firm appeared before the Town Board (Executive Session
Appointment at 1:00 p.m.)
Councilman Wickham advised that Pace University Land Use Law Center would be willing to provide
services for us. They have expertise in resolving conflicts.
9:35 a.m. - The Town Board recessed for a ten (10) minute break at this time.
9:45 a.m. (9:30 a.m. Appointment). - Moratorium Group members Consultant Patrick Cleary,
Charles J. (Chick) Voorhis and Planner Valerie Scopaz appeared before the Town Board to give
some preliminary information on their planning data. Mr. Cleary gave a power point
presentation of (1) Build-Out Analysis; and (2) GIS Tracking Information. Two types of
information were presented: straight forward baseline data and a means of tracking and measuring all
past, present, and future development. The amount of land available for development, how much is
being lost and how much is being saved was discussed and explained by Mr. Cleary. It is expected
that the DGEIS will be accepted by the Board at the next meeting on June 3rd and a date for a public
hearing set at that time.
11:30 a.m. Appointment with Land Preservation Committee members Bill Edwards and Ray
Huntington and Land Preservation Department Head Melissa Spiro presented the Board with a
written report on the outlook of the town's purchase of development rights and open space land
acquisition and the projected cash flow. The cash flow projections indicate that an additional $18.5
million will be required to finance land preservation during the 2003-2008 period over and above the
funds generated by the two percent transfer tax ($3.5 million annually) and the $6 million already
authorized by the issuance of bonds.
On motion by Councilman Wickham, seconded by Councilman Richter, it was
RESOLVED that the Town Board of the Town of Southold hereby enters into executive session at
1:00 p.m. for the purpose of discussin~ litigation~ contracts~ and personnel - a particular person.
Vote of the Town Board: Ayes: Councilman Wickham, Councilman Richter, Councilman Romanelli,
Councilman Moore, Justice Evans, Supervisor Horton.
This resolution was duly ADOPTED.
Resolution number 324 was adopted as a result of this executive session.
On motion by Councilman Wickham, seconded by Councilman Romanelli, it was
RESOVLED that the Town Board hereby exits from this executive session at 3:00 p.m.

SUPERVISOR HORTON: We have various reports, public notices and communications on file with
the Town Clerk's Office. The Town Clerk's Office is open from 8:00 A.M. to 4:00 P.M., Monday
through Friday if you care to view any of those, we will make those available to you, at your request.
As well, there are two portions of the meeting reserved for public comment. The first will be prior to
the reading and voting of any of the resolutions on the printed agenda. I will offer the floor to
members of the public that would like to address the Town Board on those specific resolutions. After
the voting of the resolutions, we will make the floor again available to the public, should you care to
address the Town Board on town related matters. We ask that when you do address the Town Board,
you do so from one of the two microphones at the front of the room and that you state your name and
place of residence for our records. So at this point, I do have one piece of communication that I would
like to read. And Town Ckrk Neville, I don't know if you are aware of this but this is addressed to
you. I would like to read it out loud. "Dear Betty, Thank you for your kind letter of May 8. I was so
glad that you were able to serve as a reviewer during this year's Local Government Records
Management Improvement Funds Grant Reviews. I received only praise for your work from your
fellow panelists and staff liaison. Concerning your suggestions regarding training for new reviewers, I
should let you know that we have already been discussing the development of a Grant Reviewers
seminars, which we would hold around the State, late in the calendar year preceding grant review.
These would be open to those who wish to be included in the pool of individuals from which reviewers
are selected. If we are able to proceed with this plan, we would be letting all former reviewers know
about dates and locations. Once again, thanks for your words of praise and your fine participation."
So, Betty, thank you for re:presenting Southold Town and the Town Clerk's so well at that State
conference. So we will move to our resolutions portion of the agenda. Would anybody care to address
the Town Board on any of the printed resolutions?
JOAN EGAN: Good evening, Joan Egan, East Marion. Before we get to the resolutions, on the
discussion, this Church Lane hiring of planning legal counsel. Are we providing them or are you
people getting legal counsel to finally do this right?
SUPERVISOR HORTON: We are retaining legal and we will be retaining planning counsel to, as you
said, do this right.
MRS. EGAN : You will be retaining legal counsel.
SUPERVISOR HORTON: We have, that is correct.
MRS. EGAN: I think Al Sharpton may be helping them with legal counsel. Alright, now again, #297
and #298 are redundant as again, as I said to you the last time, maybe it would be a good idea if
somebody read these things. These go out to the public and you look like fools again. Okay, now, as
far as #303 and #304, I don't think that you have really enough help for the projected number of people
coming into our area for protection of the roads and certainly for Greenport. For the most part, you
only probably have maybe two units down there and truly, with all the trouble down there and the new
routing of roads, you are asking for trouble. So I would suggest you hire more people. Now, I also
saw that a Mr. Foley was going, which one was this? A Mr. Foley was going to a BOCES school for
police. Something of that sort. Now, what does that mean?
SUPERVISOR HORTON: You have to refer to a specific resolution, Mrs. Egan.

MRS. EGAN: Well, whatever. I guess, oh. #320. What does that mean?
SUPERVISOR HORTON: We will get you the information specifically. But essentially, it is a
program set up through the Police Department, as a high school participant of the BOCES Police
Internship Program with the Southold Town Police Department. So, it is an opportunity....
MRS. EGAN: So he may be a future candidate for our Police Department, is that what you are
thinking is there?
SUPERVISOR HORTON: I believe that would be his personal decision.
MRS. EGAN: Okay, now this #319, what is that all about?
SUPERVISOR HORTON: She will be hired to record minutes of the Board of Assessment Review
during their annual grievance proceedings.
MRS. EGAN: And what are her qualifications?
SUPERVISOR HORTON: She comes, actually, highly qualified and at what time worked full-time....
MRS. EGAN: I said what are they? I don't want to hear just high, what are her qualifications? Is she a
High School graduate?
SUPERVISOR HORTON: Yes.
MRS. EGAN: Did she take shorthand, typing, all of that?
SUPERVISOR HORTON: She actually has passed civil service tests, that I believe that she is a .....
MRS. EGAN: Uh huh. Very good. How was she hired? By advertising or somebody up there has a
friend who needed a job?
SUPERVISOR HORTON: Mrs. Egan, your questions are inappropriate.
MRS. EGAN: No, it is not inappropriate. It is very, very true. Very true. Well, I can't think of
anything right now but I will get back to you. Thank you very much.
SUPERVISOR HORTON: Would anyone else care to address the Town Board on the printed

COUNCILMAN ROMANELLI: Let's see. The entry level is $49,500, step 3 is $54,000.
MR. CARLIN: What is it?
COUNCILMAN ROMANELLI: $54,350.
MR. CARLIN: $54,350. What was it before?
COUNCILMAN ROMANELLI: Well, actually, you know what Frank? I gave you the wrong
number. That is what it was before; it is going to $57,000.
MR. CARLIN: Oh, okay. $57,000.

MR. CARLIN: The Chief Building Inspector, is that the Code Enforcement Officer?
COUNCILMAN ROMANELLI: No, that is the head of the Building Department. He has code
enforcement powers.
MR. CARLIN: He is almost up to him anyway. I think that they are about the same. Code
Enforcement Officer, too, right?

JUSTICE EVANS: I am not quite sure why we decided that Chief Building Inspector should be 5%
higher than Principal Planner. Did we ever decide why we came up with that figure?
COUNCILMAN ROMANELLI: Yeah. They were trying to build a management tier in the Building
Department, is what it boils down to.
JUSTICE EVANS: So in order to do that, but why does it matter...
COUNCILMAN ROMANELLI: Civil Service rules really are..they want the differential.
JUSTICE EVANS: Okay. Why doesn't it say it?

Corazzini & Sons, in the amount of $52,000, to construct a tennis court and basketball
court at the Ovsterponds PlaVl!:round, in accordance with the plans and specifications
prepared by Araiys Design and James Richter, R.A.
SUPERVISOR HORTON: ] believe that this is for the playground in East Marion, if! am not
mistaken.

Supervisor Joshua Y. Horton to sil!:n an Al!:reement with Paul Corazzini & Sons, to construct a
tennis court and basketball court at the Ovsterponds PlaVl!:round, in accordance with the plans and
specifications prepared by Araiys Design and James Richter, R.A., subject to the approval of the Town
Attorney.

WHEREAS the North Fork Housing Alliance has requested the expenditure of Community
Development Block Grant funds, under the Housing Rehabilitation Program, for extensive housing
rehabilitation work to a home located at 1825 Carroll Avenue, Peconic, NY, that is in excess ofthe
Southold Town Rehabilitation Guidelines and,
WHEREAS James McMahon, the Town's director of Community Development agrees with the
recommendation of the North Fork Housing Alliance, and
WHEREAS there is sutlicient funds in the Housing Rehabilitation Program to cover this request and,
WHEREAS the Town of Southold will secure these funds with a Mortgage and Note, to be
recaptured, in full, when the property is sold or transferred, now therefore be it
RESOLVED that the Town Board of the Town of South old hereby authorizes the expenditure of
Community Development Hlock Grant Funds. for this Housin!!: Rehabilitation Proiect. in the
amount of $75.000 and recapture these funds, in full whenever this property is sold or transferred.

of public safety durin!!: the Cutcho!!:ue-New Suffolk Historical Council "Annual Antiques Show
and Sale" on the Villa!!:e Green. provided they file with the Town Clerk a One Million Dollar
Certificate of Liability Insurance naming the town of Southold as an additional insured and contact Lt.
Flatley at least ten (10) days prior to the event to coordinate traffic control.

RESOLVED that the Town Board of the Town of Southold hereby authorizes Chan!!:e Order #2 for
the Brushes Creek Brid!!:e Construction Proiect - to allow for the substitution of a pre-stressed.
post tensioned concrete deck system in lieu of the cast-in-place concrete deck currently shown on
the contract documents. This change will constitute a credit to the Town in the amount of twelve
thousand five hundred sixty-five dollars ($12,565.00) and has been approved by the office ofH2M, the
Town's Consulting Engineer for this project.
COUNCILMAN MOORE: We are saving $12,000 on that, it is a good thing.

WHEREAS an application has been made by Ernest Schneider for a waiver from the provisions of
Local Law #3 of2002 (and extended by Local Law #3 of2003) entitled "Temporary Moratorium on
the Processing, Review of, and making Decisions on applications for Major Subdivisions, Minor
Subdivisions and Special Exception Use Permits and Site Plans containing Dwelling Unites) in the
Town of South old" pursuant to Section 6 "Appeal Procedures" of Local Law #3-2002 to permit the
Planning Board to consider an application for a minor subdivision for the parcel of property known as
SCTM# 1000-101-01-14.3; and
WHEREAS the application involves the subdivision of a 13.41 acre parcel into 2 lots; and
WHEREAS the Town Board has reviewed the file, conducted a public hearing, and considered all
pertinent documents; and
WHEREAS the criteria that the applicant must meet is set forth in section 6. (Appeal Procedure) of
Local Law #3-2002 and Local Law #3-2003 and the section states:
Section 6. APPEAL PROCEDURES a. The Town Board shall have the authority to vary
or waive the application of any provision of this Local Law, in its legislative discretion, upon
its determination, that such variance or waiver is required to alleviate an extraordinary hardship
affecting a parcel of property. To grant such request, the Town Board must find that a variance
or waiver will not adversely affect the purpose of this local law, the health, safety or welfare of
the Town of Southold or any comprehensive planning being undertaken in the Town. The
Town Board shall tak,~ into account the existing land use in the immediate vicinity of the
property and the impact of the variance or waiver on the water supply, agricultural lands, open
and recreational space, rural character, natural resources, and transportation infrastructure of
the Town. The application must comply with all other applicable provisions of the Southold
Town Code.
WHEREAS the Town has hired a "moratorium group" consisting ofin-house and outside planners
and attorneys who are working on a "Comprehensive Implementation Strategy" of the Comprehensive
Plan of the Town of Southold and certain comprehensive planning currently being undertaken
includes, but is not limited to a 80% preservation of open space throughout the Town and a 60%
reduction in density and clear establishment of the Hamlet Centers and a possible Transfer of
Development Rights component (a full description of the "action" is set forth in the SEQRA
Resolution dated January 7, 2003 for the Southold Comprehensive Implementation Strategy which is
incorporated by reference into this decision); and
WHEREAS the Town Board finds that the application is not in contrast with the extensive planning
initiatives being undertaken by the "moratorium group", or the Comprehensive Plan of the Town of
Southold; and
WHEREAS the Town Boardl finds that this application will not adversely affect the purpose of the
Local Law # 3 of2002 and Local Law #3 of2003; and
WHEREAS the Town Boardl of the Town of South old finds that the application will not adversely
affect the health, safety, or welfare of the Town of Southold; and
WHEREAS the Town Boardl of the Town of Southold finds that the minor subdivision application is
consistent with the existing land use in the surrounding area and has a minimal impact on water supply,
rural character, natural resources and transportation infrastructure of the Town; and

MR. CARLIN: Good evening, ladies and gentlemen, Frank Carlin from Laurel. Oh, before I start
Josh, I want to know. I didn't know that you could play the guitar and sing. Very good.
SUPERVISOR HORTON: Thank you.
MR. CARLIN: It is too bad that I still didn't have my band. I could have used you in my band. We
could have made some nice music together.
SUPERVISOR HORTON: You were Frank Carlin and the Musical Notes.
MR. CARLIN: That's right. And I used to sing, too. Believe it or not.
SUPERVISOR HORTON: You guys used to rock the house, from what I used to hear.
MR. CARLIN: I want to ask him a question but I am going to go to you instead. This is before I get
to my issue here. I am throwing in something else. But it is nothing negative, believe me. But I want
go through you to transfer a fact to my friend here, Tim Kelly. Being that Troy is retiring from the
Suffolk Times, I always wondered, did he know that Tim goes into McDonalds for a hamburger once
in a while?
COUNCILMAN MOORE: Tim throws the wrappers away in the garbage pail in the office.
MR. CARLIN: Plead the fifth, right? Because I know that Troy doesn't like McDonalds, he calls it a
litter factory. I can prove that in the paper. But anyway, okay. Bill Moore, I have something for you.
A couple of weeks ago, you said in the paper that when you leave the Town Board you would like to
accomplish as much as you can on land preservation and five-acre zoning. I was a little surprised that
you didn't mention also in there, the Animal Shelter.
COUNCILMAN MOORE: I forgot.
MR. CARLIN: That would be one of your objectives...

COUNCILMAN MOORE: Absolutely.
MR. CARLIN:... to see that that was complied with.
COUNCILMAN MOORE: Oversight, Frank.
MR. CARLIN: Right now, my opinion is that we should have three main priorities in this town right
now. As far as land preservation goes and five acrc zoning, we should have three right now that I feel
they should have high priority on. And that is, building of or remodeling of the Town Hall. We have
been kicking around that thing for four or five years. Get that thing done with one way or the other.
Let the people have some breathing space in the Town Hall, let's get on with that one. That should
have a priority. Number two, the Church Lane people. Get that thing over with, make a decision.
Moratorium now, we are going to drag that thing out for four months, we don't need it. Make a
decision, step up to the plate and say yes or no and stop the nonsense. And number three but not last.
The Animal Shelter. Get tha.t thing built. Now, you mentioned to me, Bill, two months ago, that we
will be starting on that Animal Shelter in the summer. After that, you come and you say that we are
going to start on it sometime in the fall. Well, the fall can mean anywhere's up to the 21 st of December.
And you know as well as I do, you don't like to start construction in the middle of the winter. So, I
am a little bit confused. And I want to ask you another question, Bill. That $250,000 that Mr. Raynor
donated, now it has been in here for about two years now. Where is it? Is it in escrow, is it in the bank
collection some interest whik we are waiting for this project to go through? Where is the money?
COUNCILMAN MOORE: Mr. Cushman could report how much interest that it has earned but it is
earning interest for the purpose. It is in a dedicated fund.
MR. CARLIN: That is what [want to know. I want to know ifit is laying there making some interest
while we are waiting this.
COUNCILMAN MOORE: Yes, it is. Yes, it is. As you know, interest isn't paying that much right
now but it is collecting inten::st and I would like to see us get started this summer. I am being realistic
for the fall, call it August, S,eptember. We had, I think I mentioned at the last Board meeting or the
meeting before, having had a series of questions posed by Mr. Bradley. And we have gathered up,
with Jamie's help, responses from that and we are trying to pin down from him, his final comments on

MR. CARLIN: We don't need to wait for no architect plan to come back in and anything else. And I
would also suggest on the next resolution, if you want to put this one on there you can but you don't
have to. But you put on it that you issue the nice residents that live in Church Lane down there, two
cases of air refresher. So that they can squirt it around out there to get rid of that stench that you got
from that super compo sting plant that you got down there. Where is Mr. Bunchuk? I wish that he
would come here so that I could debate him. I would like to debate him, let him come here. Now,
back to you Bill. You said about five acre zoning, we ever had five acre zoning in this town, it would
be a disaster in my opinion. The young people might as well move out. Young people who are
wanting to get married, raise a family and build a house. How are they going to do it? Five acres of
land. It is going to cost you more money to buy the land then it is to build the house. It would be a
disaster, five acres. Why do we always play it, why are we always playing with zoning? I want to
give you an example. 1959, we had one page of the zoning code. One page in 1959. 1996, we had six
pages. And here it is. That was our zoning code. Six pages in 1966. 1984, we went to 180 pages.
Here was our zoning code. Now, we are up to about 1000.
COUNCILMAN MOORE: No.
MR. CARLIN: This book is this thick...
COUNCILMAN MOORE: That book has every other code in the Town from the parking and traffic.
That has parking regulations in it, beach regulations in it, everything else.
MR. CARLIN: Well, how many pages in it, Bill?
COUNCILMAN MOORE: From '89, probably added 60 pages.
MR. CARLIN: But it is about this thick though.
COUNCILMAN MOORE: No. No.
COUNCILMAN ROMANELLI: The total code book.
MR. CARLIN: I seen you walking with it one day, though. And you was tilted to one side.
COUNCILMAN MOORE: That is every ordinance....
MR. CARLIN: Bill, you nee,d a shock absorber to balance you out there, down the hall there.
COUNCILMAN MOORE: That is every law, that relates to every topic the Town can act upon.
MR. CARLIN: But anyway, what I am trying to get at here, we started with one page and we are up
to, you say it is now, what in 1994 it was 180 pages.
COUNCILMAN MOORE: Okay, call it 200.

MR. CARLIN: Okay, call it 200 now. Why we changing so much, you know what the old saying is,
Bill? I am addressing the Board now, not only you. If something isn't broken, don't try to fix it.
Youse did this with the people on Route 48 over two years ago, when you was going to change all the
zoning over there. Caused a lot of uproar. They come to meetings, didn't like it, people bought homes
over there that are specified zoning and you want to come along and change it. It caused a lot of
uproar, I can remember that You should remember it, too. Why, why, why do we have to make all
these changes all the time? And these moratoriums dragging things out. Let's get something done and
do it and step up to the plate and don't stand there with the bat on your shoulder while three pitches go
by you and the umpire says 'strike three' and you are out. Another issue is, I agree and I approve that
this Town should have a K.9 Unit in the Police Department. Now, I know that Chief Cochran met
with the Board this morning but let's stop relying on other Town's to supply that unit. We have to rely
on Suffolk County, we have to rely on the State Police, we have to rely on Riverhead Police. In fact,
we relied on Riverhead Police back in 1993...

SUPERVISOR HORTON: Mr. Carlin, I have asked the Chief to put a proposal together for the Board
on that proposal specifically.
MR. CARLIN: I know. But let me finish. I know. We relied on Riverhead Town Police to supply us
with a canine dog in an issue that happened in Greenport. And the dog lost his life. I happened to go
to that funeral. He had policemen from all over the country, as far as Maryland, the dogs name was
Ace. We don't need that. We got to stop relying on our own self to get stuff that we need here. Not
just worrying about land preservation and five acre zoning. There are other things in the town that
make up the town where we have to every day live our lives on.
COUNCILMAN MOORE: Taxes.
MR. CARLIN: And taxes. But you didn't do that well this year when you took from a .09 % decrease
to a....
SUPERVISOR HORTON: Mr. Carlin, do you have a specific...
COUNCILMAN MOORE: Don't go there.
MR. CARLIN: ....to a 7.5% increase. Don't mention taxes to me.
COUNCILMAN MOORE: We can debate that increase all you want, talk to the State. Frank.
MR. CARLIN: You want to debate it with me.
SUPERVISOR HORTON: Mr. Carlin, do you have a specific issue that you would like to finish with
the Town Board?
MR. CARLIN: There was stuff in there that you didn't need. You didn't need that $150,000 for that
Open Space Land Preservation Committee or whatever you said there...

SUPERVISOR HORTON: Mr. Carlin, is this specific town business?
MR. CARLIN: Well, this pertains to, I want to say this. Can I say it? When the Town bought the
Whitaker House, about three or four years ago, the first year they used it for, when I geL you will know
what I am saying. The first year they used it for a Halloween haunted house. He is starting to know
what I am going to say.
COUNCILMAN MOORE: No, I don't. That part is correct, it was.
MR. CARLIN: They used it for a Halloween haunted house, I was at a Town Board meeting-are you
listening? I was at a Town Board meeting, just before it started, in the lobby reading my resolutions
and Bill approached me and he said, "Frank, we are using the Whitaker house as a haunted house.
Would you like to be part ofilt?" I said, "What do you mean?" and he says, now this is true, Bill. "We
would like you to lay down ill the box and play Count Dracula's dead." I looked, I said, "What did you
say?" "Lay down in a box and make believe that you are Count Dracula." I says, "Well, how much
you going to pay me?" He said, "Minimum wage." I says, "Hell, no, I ain't going to work for no
minimum wage and lay in that box four or five hours, playing dead." Don't you remember that, Bill?
COUNCILMAN MOORE: No.
MR. CARLIN: Oh, boy, I do.

SUPERVISOR HORTON: Would anyone else care to address the Town Board on town related
business?
CAROLINE PEABODY: Good evening, I am Caroline Peabody and I live in Orient Point. I am just
here to ask you what sort of progress, I know that we are waiting for the moratorium hearing but we
and I apologize for coming a little late but I checked with my colleagues and they haven't sort of told
me that you addressed any of the specifics of either how the moratorium is being framed or what the
progress is in terms of your thinking around issues around Church Lane. So.
COUNCILMAN WICKHAM: Actually, today the Town Board took up two issues and we skipped
one issue, regarding Church Lane. The two that we took up, one of them was as you may recall at our
last meeting, we passed a resolution to engage professional services to help prepare a plan that would
establish a strong foundation for enhanced residential quality in the Church Lane area. Today, we
identified a firm that we think we would like to ask to do that. And I guess in the next day or so, the
Supervisor will be talking to that firm and seeing, an environmental law firm here on Long Island, that
we think we would like to approach to help us do that. To put a strong planning foundation, that will
help the Town do properly what we said that we want to do, which is to establish a stronger, residential
community. The second thing that we did today, which was a resolution that we adopted towards the
end of our list of resolutions, is to hire appraisers to find the value of properties in that area. If the
Board is going to take actions around there, we feel that we need to know what the value of the
properties are. So, we would like to get some arms length appraisals of property in that area. What we
didn't do today, is to take arlY further action on the moratorium, on the proposed moratorium. As you
said, that scheduled for a hearing two weeks from today. And so today, that really didn't feature in our
plans. The Board did review and discuss a proposal for participation from a broad section of people
who would be involved in whatever developments occur in connection with the Church Lane. We
didn't take formal action on it but the Board is aware of it and I think will give due consideration to
broad based planning with input from a wide range of sources.
MS. PEABODY: So that would be a specification of the procedure, in terms of how the planning
process is going forward. That the community would be involved?
COUNCILMAN WICKHAM: That is my view.
SUPERVISOR HORTON: That was the consensus of the Board.
MS. PEABODY: Great. Thank you very much.
SUPERVISOR HORTON: Thank you. Would anyone else care to address the Town Board on town
related issues? Mrs. Egan.
MRS. EGAN: Mr. Moore, you did not answer the question that Mr. Carlin asked you when he asked
you about the large sum of money. You said that it is earning interest, is it still in its entirety intact?
And the answer to that is yes or I don't know.

MRS. EGAN: Would you consider it correct to ask him to do it now, in front of witnesses, so that his
memory, you know, so that he could review it on TV.
SUPERVISOR HORTON: To be honest, Mrs. Egan, I need you to perhaps write a letter or. ....
MRS. EGAN: I am not allowed to write to Mr. Yakaboski, I am not allowed to call him, nothing. Mr.
Yakaboski lives in a little isbmd.
SUPERVISOR HORTON: Mrs. Egan, would you stop....
MRS. EGAN: I asked you to do this, did you do it. You said no.
SUPERVISOR HORTON: That is correct.

No noise control, no nothing. But may I ask you a question? I saw in one of our local papers, that you
were kind of brushing off the fact that these wineries may get kitchens. Which would, in fact, hurt our
small, local restaurants humongously. And this is a very important thing. Do you want to make
comment on what was quoted in one of our local papers, that you said the Board doesn't have to deal
with. Is that what YOIl said?
COUNCILMAN ROMANELLI: I don't recall.
MRS. EGAN: You don't recall. Why not?
SUPERVISOR HORTON: Mrs. Egan. Do you have anything else that YOIl would like to address the
Board?

Lane. I would just like to know who that firm is. Well, you didn't hire yet but I would like to know
who itis.
COUNCILMAN WICKHAM: I think this was discussed during the Executive Session and unless,
until the Board agrees, I am not sure we.. .if the whole Board is open to it, I am quite willing to talk
about it.
SUPERVISOR HORTON: We have hired the legal firm of Twomey, Latham, Shea and Kelly.
MRS. T AYLOR: Who?
SUPERVISOR HORTON: Twomey, Latham, Shea and Kelly. That is the legal counsel that we have
retained. And I am going to contact the firm of Green and Peterson, which is an Engineering and
Environmental Law firm.
MRS. TAYLOR: Where are they located?
SUPERVISOR HORTON: ] don't know their exact.. .they are a Long Island based firm. I don't know
their exact town.
MRS. TAYLOR: Excuseme?
COUNCILMAN RICHTER: We can give it to you later.
MRS. TAYLOR: When is later? Can I have it tomorrow?
SUPERVISOR HORTON: I will have the information tomorrow. I have to contact Tom Twomey to
get the number and the infonnation on that firm.
