c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such
permit shall be kept on the premises available {or inspection throughout the progress of the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.

1, STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because
the property was bought January or 195~ and
divided June 1956. It was rormerly 485 reet long and when
divided only 1~5.was given,to'~ brother~in-law. We retained
15'or access along the property to the county road. The parcel
or land is now 360' long with a 15' wide, 125' long ddveway
running ~)ong the given land.
2, The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because this treck of lane_ is
longer tLan usual house "ets run. There is another small summer
hc'"se on t.he land now.
3, The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because

Dear Mrs. Grzesik;
In answer to your letter REI building at Greenport,
I would assume that you have reference to a lot on the sound outside
of the Village limits of Greenport Village.
To get a building permit in the Town of Southold area you will
need a survey of the property showing your access to a public street,
if your property has enterance on the "North Road" (county Road 27A),
you will have to supply seven copies of an engineers plot plan with
your application for a building permit, and an application for approval
of access to the Board of appeals if the lot is not direotly on the
public highway. Water supply and sewerage disposal by County Dept Health.
A lot of 12,500 sq ft area or larger requires minimum sideyards
of 10ft and 15ft - a total of 25ft, a rear yard of 25ft, and front yard
setback of 35ft minimum.
The fee for Board or Appeals application is $ 5.00, and fee for
buildirg permit 10.00.
Enclosed please find the necessary application forms, these must
be corenletely filled out on both sides, and signatl~es notarized.

Appeal No. 3809:
Application of STEPHEN AND DONNA GRZESIK for a Variance to
the Zoning Ordinance, Article III, Section 100-31 for permission
to construct addition to dwelling with an insufficient rearyard
setback. Location of Property: 62215 North Road, Greenport,
NY; County Tax Map District 1000, Section 40, Block 1, Lot 3.
WHEREAS, a public hearing was held and concluded on
December 8, 1988 in the Matter of the Application of STEPHEN AND
DONNA GRZESIK under Appeal No. 3809; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:

The premises in question is located along
the North Road (C.R. 48), in the Hamlet of
Southold, and is identified on the Suffolk
District 1000, Section 40, Block 1, Lot 3.

2. The subject premises is a described parcel of land
containing a total area of 8,375 sq. ft., average lot width of
67.63 feet, and lot depth of 125 feet, and is improved with a
single-family, one-story frame house and accessory garage
structure, as more particularly shown on the copy of survey
prepared by Roderick VanTuyl, P.C. dated February 6, 1987.

Article
By this application, appellants request a variance from
III, Section 100-31 for permission to construct six-foot
extension, 30 feet wide, with an insufficient rearyard
at 30 - 31 feet (at its closest point).

5. Article III, Section 100-31, Bulk Schedule, of the
Zoning Code requires a minimum rearyard setback at 35 feet. The
dwelling as exists appears to be set back at 35-36 feet from the
rear property line.
6. The amount of relief requested by this application is
six feet (or slightly less), or 17% of the requirement.
7. In considering this application, the Board also finds
and determines:
(a) there is no other alternative available for
appellants to pursue other than a variance;
(b) the variance requested is uniquely related to the
property and will not alter the essential character of the
neighborhood;
(c) the variance requested is the minimal necessary
to afford relief and is not substantial in relation to the
requirement;
(d) the variance will not in turn be adverse to the
safety, health, welfare, comfort, convenience or order of the
town, or be adverse to neighboring properties;
(e) in view of all of the above factors, the

interests of justice will be served by granting the relief, as
requested and conditionally noted below.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr. Dinizio, it was
RESOLVED, to GRANT the relief for a siX-foot
extension at the rear of existing dwelling structure, as applied
under Appeal No. 3809 in the Matter of the Application of
STEPHEN AND DONNA GRZESIK, provided there be no further rearyard
setback reductions.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
and Dinizio. (Absent was: Member Serge Doyen, due to poor
weather conditions, and Member Joseph H. Sawicki
{out-Of-state}). This resolution was dUly adopted.
