REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
is requested for the reason that deponent desires to sell 3 dwelling houses presently
situated c~ her premises in such manner as to preclude absolute compliance
with the requirements of the Zoning Oz~lnance because the two northez~most
parcels do not have a 100' frontage on a public highway a~d are accessible
by a 20' right of ~ay extending northerly from the northerly line of Ceda~
Beach Road.
Foz~n ZB~ (Continue on other side)
REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficultie,s or unneces-
sary HARDSHIP because applicant would be unable to sell her respective parcels
of property separately even though the respective parcels have been occu-
pied by three separate families and maintained as three separate economic
units.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because of the f. aet that tho buildings
were constructed and used prior to the adoption of the Zoniug O~dinance
as three separate and independent economic units.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the premises would continue to be used for
re sident ial cc cupancy.
