DEC made a determination regarding the limits of Tidal Wetlands Act (Article 25)jurisdiction at this property on January 10, 2007. This office does not make repeated jurisdictional determinations for the same site. The limits of DEC's jurisdiction were indicated in our original No-Jurisdiction letter, a copy of the letter is enclosed. Therefore, your client's recent request is being returned to you. No-Jurisdiction letters remain valid indefinitely unless substantial changes in site conditions have occurred.
