On 6/25/21 John performed a "Rental Permit" Inspection and issued a Violation: Conversion to single family dwelling, deck, hot tub. We did not find a permit for the hot tub,so it was removed, however,there are permits for the single family dwelling, and the deck has a Trustee's permit. The deck was constructed "at grade" so no building permit or variance was required. My research is below. The conversion of the commercial space to a residence was in 1990 by Schwartz. Prior to and for the Schwartz purchase, a pre-CO was issued for the original building. Also see Schwartz permit 1991 BP#BP# 19918/new#32301 and CO 31848 for the windos on the east side of the building (commercial side). The permit describes"Mullions replaced to a residence" ((closed out open permit on 9/25/06 before sale to Harroun). There are no exterior alterations to the original structure (all permits are in place). The deck was constructed in 2007 (at grade- per Trustees permit). In Trustee's file, drawings show "ON GRADE" trex deck ( 2 X 8 X 12 WITH 4 X 4 POSTS). Also ARIALS SHOW SAME STRUCTURE TODAY AS BUILT IN 2013 (Trustees inspected deck on 2/12/13 and all OK). Trustees coordinate with the building department and the deck was not sent to the building department or ZBA because the deck was considered "at grade". Based on the following Town of Southold records, please rescind the violation. History of Permits: 1960's (Owner Ralph Conklin) • ZBA#443 1962: Expansion of existing building with plans showing Single family dwelling expansion and attached antique shop. Building permit issued 1962 with notice of disapproval and CO by 1965 :djacent Trustees permit 1962 (Permit#169 150' of bulkhead constructed) connecting to sea wall (east) *Note: bulkhead constructed prior to 10/77 (DEC-nonjurisdiction) • ZBA#1035 1967 Business Sign • PRE-00: Estate of Conklin-obtained pre-CO for sale to Schwartz and listed Building Permit #1676 and CO#2111 (affidavit described that the original building was purchased from Jack Levin in 1962. Levin &Conklin used the original structure as an antique shop). The original building pre-dated zoning. But the building permits listed in the pre-CO referred to the structure as a residence. Conklin Died-Estate sells to Schwartz(1990) • BP#19918 June 11, 1991- install Mullions units: windows& headers installed -building permit updated with new#32301 and CO#31848 issued 9/25/06. In 2006 with building permit for Mullions (windows on the east wall replaced) described as "alterations to residence" Schwartz used entire building as a residence. Any work done to the interior would have been done by Schwartz. • Assessors Card shows same structure and 4 bedroom house. Schwartz to Harroun 2006(Harroun used structure as their residence) • Interior repairs and cosmetic improvements done by Harroun. Permits obtained,when required. • Trustees : 2007-& DEC 2008 permit bulkhead replacement • 2013 Wetland permit for"at grade brick&sand patio"Trustee's Amendment 2/20/13- 21 x18 deck with trex material (@at grade) see Trustee's drawings. The Same deck is on the property today. Drawings show"ON GRADE" -( 2 X 8 X 12 WITH 4 X 4 POSTS). Also ARIALS SHOW SAME STRUCTURE TODAY AS BUILT IN 2013 (Trustees inspected 2/12/13 and all OK).
