SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 38,195 square feet, .874-acre rectangular parcel located in the R40 Zoning District measures 292.25 feet along Grand Avenue, then runs 150 feet along Knollwood Lane,then runs south 291.17 feet along a residentially developed lot to the west,then returns 113.09 feet along a second residentially developed lot to the south, back to the roadway. The parcel is improved with a 2-story wood frame house with attached front entry walk, an attached side and rear deck each with steps, an inground pool, gravel driveways and timber lined concrete walkways as shown on the survey prepared by Donald J. Metzger, Licensed Land Surveyor, last updated June 7, 2022. BASIS OF APPLICATION: Request for Variances under Article XXIII, Section 280-124 and the Building Inspector's April 28,2022 Notice of Disapproval based on an application for a permit to construct a deck addition to an existing single-family dwelling, at: 1) deck located less than the code required minimum side yard setback of 10 feet; 2) deck addition places the existing swimming pool in other than the rear yard; at: 55 Knollwood Lane, (Adj.to the Mattituck Creek)Mattituck,NY. SCTM#1000-107-6-12. RELIEF REQUESTED: The applicant requests two variances for the demolition of and expansion of an existing attached deck where the proposed improvement will result in the single-family residence having a 10 feet side yard setback where the code requires a minimum of a 15 feet side yard setback; additionally, the expansion of the deck will result in the existing swimming pool (with an open building permit proposing a conforming rear-yard location) being placed in a non-conforming side-yard. ADDITIONAL INFORMATION: The subject parcel has an open building permit for the installation of an inground swimming pool in a conforming location for a residential accessory structure located on a corner lot. Page 2, September 15,2022 #7679,Uklanski #1000-107-6-2 The residence was initially designed by Andrew Geller, architect, and is the only known residence in the Town of Southold, developed by this noted architect. The house is known as the `Toaster House'. The improvements on the subject parcel are covered by the following Certificates of Occupancy: #Z-1590 dated June 11, 1963 covering the construction of a single-family residence #Z-12393 dated March 29, 1984 covering the addition to an existing dwelling #Z-30667 dated January 5, 2005 covering repairs to an existing deck The applicant provided architectural plans, including demolition plan,proposed deck plan,proposed foundation plan, and privacy wall plan and elevations, prepared by Jimenez Design Group, labeled 01 - 04 and dated January 26, 2022. No member of the public spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 1, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject, corner parcel, as originally developed includes a modest residence, which over the years has been expanded and conforms to the mid/late 20"' century residential character of the neighborhood. The expansion of the existing deck is a customary feature to homes in the general area and throughout the Town of Southold. The decking will not be visible from either Grand Avenue or I nollwood Lane as a result of the natural and proposed, altered terrain and a `privacy' wall currently under construction. Furthermore,because the decking surrounds the pool,currently being installed at the site on two sides,and is attached to the residential stricture, the previously approved rear-yard location results in the pool being located in the side yard. The pool's location has not changed and is sited within a conforming, original, location. No publicly discernable physical change, other than the technical definition of the pool's location is proposed or has occurred. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. While the applicant could install a conforming deck or install an at grade patio,the site's natural and altered terrain along with corner location and existing residence makes it less feasible and will potentially limit access to the pool. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 33.3% relief from the code relative to the side yard setback for the deck expansion and 100% relief from the code relative to the pool location in a side yard. However, as a result of the addition of a privacy wall (currently under construction), the natural and altered terrain, and existing landscaping, few neighbors if any or passersby on either road frontage will be able to notice the non-conformity and relief granted. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Page 3,September 15,2022 #7679, Uklanski #1000-107-6-2 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an expanded deck pool surround and pool location in a side yard while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Planamento,seconded by Member Lehnert,and duly carried, to GRANT the variances as applied for, and shown on the survey prepared by Donald J.
