SCTM Nos. 1000-81-3-1.4. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type Il category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated May 16, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 30, 2022. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. TOWN OF SOUTHOLD PLANNING BOARD: The application was referred to the Planning Board for comments. In their memo dated August 29, 2022 it was advised that the area being transferred from is designated recreation open space, perpetually unbuildable and cannot count towards future build out liberties on Lot 2. PROPERTY FACTS/DESCRIPTION: The subject property (SCTM 1000-81-3-1.4) is a non-conforming 23,094 square foot waterfront parcel located in an R-80 Zoning District. The parcel has 148.78 feet of wood bulkhead frontage along Peconic Bay. The parcel runs 120.58 feet along Old Paradise Point Road, runs 186.91 feet on the West side and 115.76 feet on the East side. The parcel is improved with a one-story dwelling with attached wood deck,walk out cellars and an accessory shed. All is shown on a survey by Kenneth M.Woychuck,L.L.S. last revised March 2, 2022. BASIS OF APPLICATION: Request for Variances from Article 111, Section 280-14 and the Building Inspector's April 6, 2022,Notice of Disapproval based on an application to permit a lot line change to create a non-conforming lot, 1) proposed lot 1.4 at less than the code required lot size of 80,000 sq. ft.; 2) proposed lot 1.4 less than the code required minimum lot depth of 250 feet; located at 5000 Paradise Point Road and 5300 Paradise Point Road, (Adj. to Peconic Bay) Southold, SCTM Nos. 1000-81-3-1.4. Page 2, September 15,2022 #7677,James/Sinning SCTM No. 1000-81-3-1.4 and 24.3 RELIEF REQUESTED: The applicant requests a variance to convey a 5,183 square feet portion from an adjacent undeveloped 3.03-acre designated recreation open space parcel, particularly known as Suffolk County Tax Map Lot 1000-81-1-24.3. This will result in the subject lot(1000-81-3-1.4) increasing in size to become less non-conforming at 28,277.83 square feet in area. The conveyance of land will also result in the proposed lot having a reduced lot depth from 115.76 feet to 91.55 feet. Since the property is zoned R-80,the Town Code requires newly created lots to have a minimum 80,000 square feet and have a minimum lot depth of 250 feet. Tax map lot 1000-81-1-24.3 will remain code conforming after the proposed lot line change. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 1,2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of many waterfront parcels along Peconic Bay that are developed with single-family dwellings on numerous undersized lots that were created by the 1963 subdivision of Paradise Point. The proposed lot line change will not result in any additional dwellings since the proposed area to be conveyed from Suffolk County Tax Map Lot 1000-81-1-24.3. to the subject developed lot, is a designated recreation open space parcel located at the very end of Old Paradise Point Road and surrounded by the waters of Peconic Bay and Southold Bay.Moreover,the 3.03-acre open space parcel,which cannot be developed, will remain conforming to the code while the subject lot will become less non-conforming. The lot line change will not be discernable. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject lot is non-conforming and cannot be increased in size without the requested lot line change which will create a less nonconforming size lot, although the lot depth will become slightly less conforming. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 65% relief from the code for lot area and 63% non-conforming for lot depth. However, the current lot is 72%non-conforming for lot area and 53% non-conforming for lot depth. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant proposes to annex the conveyed portion of land to create a larger land buffer between the dwelling on their property and the open space Point property in anticipation of future severe storm events and potential flooding and erosion from the ongoing erosion of the undeveloped Point parcel whose shoreline is no longer protected by a functional bulkhead. In addition, the applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of adding 5,183 square feet to the subject parcel while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Woychuck, L.L.S., last revised March 2, 2022 SUBJECT TO THE FOLLOWING CONDITIONS: 1. No further development shall be permitted on the conveyed portion of the parcel, currently designated as recreation open space, measuring 5,183 sq. ft. 2. The applicant is required to receive approval from the Southold Town Planning Board for the subject Lot Line Change. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. Although the proposed lot line modification would result in an increase in the James property's preexisting nonconforming lot area of 23,094 sf, the proposed lot area of 28,277 sf is still well less than the 80,000 sf currently required in an R-80 zoning district; and although the relocation of the easterly side lot line would result in the lot width increasing from a preexisting nonconforming 145.58 feet to a conforming 203.29 feet, the minimum lot depth would decrease from a preexisting nonconforming 115.76 feet to 91.55 feet. The proposed lot area and depth of the James property thus requires relief from Section 280-14 of the Town Zoning Code. But allowing the proposed changes in lot size and dimensions would not undesirably change the character of the surrounding neighborhood, which consists of numerous other similarly undersized lots that were created by the 1963 subdivision of Paradise Point, nearly all with lot areas less than 80,000 square feet; lot widths less than 175 feet; and lot depths less than 250 feet. Rather, the additional square footage merely makes the James property's lot area somewhat more conforming to current code; the shorter easterly lot line makes its lot depth somewhat less conforming; and the longer northerly lot line actually changes its lot width from a nonconforming to conforming length. And the associated decrease in area of the Point Property to the east, from which the 5,183 sf of land area will be transferred, does nothing to change the existing zoning compliance of that parcel, which will be left with an area of 126,972 square feet. Moreover, while the lot line change would increase the James property's building area relative to the Point property, the Point property is a vacant, communal "recreation and open space"parcel, which subsequent to the lot line modification would be forever preserved from future development. And there would be no change to the James property's building area relative to the developed-residential properties located across the road to the north or to the west. Therefore, the proposed lot line modification also would not cause a detriment to nearby properties. 2) The benefit the applicant seeks from the proposed lot line modification is an increase in the area of the James property, prior to the permanent preservation of the Point property, to provide the dwelling with an increased buffer and potential protection from the ongoing severe erosion of the Point Property. The relief is not substantial in fact, however, as the proposed lot area of 28,277 sf would make the James property 5,183 sf more conforming than it is currently; the 57.71-foot easterly extension of the northerly property line would change its lot width from a nonconforming 145.58 feet to a conforming 203.29 feet; and relative to the required lot depth of 250 feet, the proposed 91.55-foot easterly property line would make its minimum lot depth only 24 feet less conforming than the existing 115.76-foot easterly lot line. 4) The proposed lot line modification would have no direct impact on the physical and environmental conditions in the neighborhood,but it would create the potential for a future improvement in the physical conditions of the James property. Because having an increased land area between the existing dwelling and the Point property would create a greater land buffer between the dwelling and the Point property and an opportunity for increased protection of the dwelling from the potential flood and erosion damage that could result from the severe ongoing erosion of the Point property, which will be permanently preserved from future development. _ 5) The difficulty associated with the proposed lot line modification is not self-created because at the time the James property was purchased, the Point property's shoreline was protected by a functional bulkhead, and there was thus no reason to anticipate the potential future need to create an additional land buffer between the dwelling on the James property and the Point property; and it is not possible to gain such an increase in land area without variance relief. No claim shall be made against the State of New York on account of any such removal or alteration. 5. State May Require Site Restoration If upon the expiration or revocation of this permit,the project hereby authorized has not been completed, the applicant shall,without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 6. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings,paints, concrete, leachate or any other environmentally deleterious materials associated with the project. Facility Inspection by The Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation(the Department) to determine whether the permittee is complying with this permit and the ECL.
