SCTM No. 1000-31-7-4. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type I1 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated May 10, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The parcel is a non-conforming 21,281.48 square foot parcel located in an R-40 zoning district. The parcel runs 83.13 feet fronting Main Road along the northerly property line, 263.63 feet on the West side, 83.25 feet on the south side, and 262.25 feet on the East side. The parcel is improved with a two- story frame residence with a concrete patio, an accessory garage/barn, a green house, and two accessory sheds. All is shown on a survey prepared by Jason D. Leadingham, LLS, dated July 21,2021. BASIS OF APPLICATION: The applicant requests variances from Article XXIII, Section 280-124 and Building Inspector's March 11, 2022 Notice of Disapproval based on an application for a permit to construct additions to an existing single family dwelling; at; 1) less than the code required minimum front yard setback of 40 feet; 2) less than the code required minimum side yard setback of 15 feet; 3) less than the code required minimum combined side yard setback of 35 feet; located 8520 Main Road, East Marion,NY. SCTM No. 1000-31-7-4. RELIEF REQUESTED: The applicant requests variances to construct additions and alterations that will result in a front yard setback of 29' 4" where the Town Code requires a minimum 40-foot front yard setback. The additions and alterations will result in a side yard setback of 9'5"and a combined side yard setback of 27'4"where Town Code requires a minimum side yard setback of 15 feet and a combined side yard setback of 35 feet. Page 2, September 15,2022 #7673,Appel SCTM No. 1000-31-7-4 ADDITIONAL INFORMATION: The applicant has the benefit of Certificate of Occupancy No. Z8103 dated November 21, 1977 for a private one family dwelling with addition, Certificate of Occupancy No. 36714 dated January 15,2014 for a heating system in a one family dwelling,Pre-existing Certificate of Occupancy No.40729 for a wood frame one family dwelling with a rear concrete patio, an accessory garage and two accessory sheds. Certificate of Occupancy No.40727 dated September 27, 2019 for electric for accessory garage and accessory shed. The survey dated July 21, 2021 shows the existing westerly side yard setback at 18.4 feet for which no additions or alterations are planned. The Site Plan prepared January 25, 2022 indicates the setback for the westerly side yard setback at 17 ft. 11 inches. The proposed 17 ft. 11 inches setback along the westerly side yard plus the proposed 9 ft. 5-inch side yard setback along easterly side yard equals a requested non-conforming combined side yard setback of 27 ft. 4 inches. The applicant's representative submitted to the office two prior comparable variances granted to neighboring properties;#4679 dated May 5, 1999,which granted side yard and rear yard setback relief for an addition to a single- family dwelling; and#5551 dated August 2, 2004 variance relief to construct a new dwelling with less than required front yard setback. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 1, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is an older residential neighborhood along Main Riad with many historic dwellings and single-family homes which were built prior to zoning. The existing dwelling has non-conforming front yard setback,side yard setbacks,and combined side yard setbacks. The proposed additions and alterations and the relief requested are characteristic in this neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling has non-conforming front yard side yard, and combined side yard setbacks. Any proposed additions and alterations to the existing dwelling will require the benefit of variance relief. 3. Town Law V67-b(3)(b)(3). The variances granted herein for the non-conforming front yard setback is mathematically substantial, representing 17% relief from the code. The variance granted herein for the non- conforming side yard setback of 9.5 feet is mathematically substantial, representing 27% relief from the code. The variances granted herein for the non-conforming combined side yard setback is mathematically substantial, representing 21% relief from the code. However,the existing house has pre-existing, non-conforming setbacks and the proposed additions and alterations are modest increases in the non-conformity. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has not been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a renovated house while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variances as applied for, and shown on the Engineered Plans prepared by Louis Schwartz, labeled Sheets SK-1 through SK-8, dated January 25, 2022. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. Failure to comply in a timely manner may result in the denial by the Building Department of a Certificate of Occupancy, nullify the approved variance relief, and require a new variance application with public hearing before the Board of Appeals Vote of the Board: Ayes: Members Weisman (Chairperson) Dantes, Acampora, and Lehnert. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed dwelling will be located on small faction of a large, irregular-shaped, 2.34-acre lot. Although the lot contains over 707 feet of road frontage on North Lane, the dwelling and variance will only affect approximately 60 feet of road frontage, leaving a spacious amount of undisturbed woodlands and greater privacy than most of the lots in this community.
