SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 18, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated June 22, 2022. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. BASIS OF APPLICANTION: The Applicant-Owner requests a Special.Exception under Zoning Code Section 280-13(B)(13)to establish an Accessory Apartment in an existing accessory structure. PROPERTY FACTS/DESCRIPTION: The subject property is a 24, 760. 7 sf non-conforming parcel located in an R-40 zoning district. The property is accessed by a shared 15 foot wide Right Of Way easement from Peconic Bay Boulevard. The lot measures 91.99 ft across the front yard property line,then turns south for 303.11 ft toward Peconic Bay,then turns east for 102.7 ft of frontage on Great Peconic Bay, , then returns 250. 93 ft north back to the front property line. The parcel is improved with an existing 2-story frame dwelling with attached garage and an accessory garage in the northwest corner of the front yard. All as shown on the survey prepared by Jason D. Leadingham dated November November 8,/2021. Page 2, September 15,2022 7646SE, Hobley SCTM No. 1000-128-6-21 ADDITIONAL INFORMATION: At the public hearing, testimony was given and a Memorandum of Law was submitted by an attorney representing the neighbor directly to the east of the subject property objecting to the proposed two-story accessory apartment. Those neighbors also testified on their own behalf objecting to the proposed second story addition to the accessory garage with non-conforming setbacks of 4 feet+/- from two property lines. Similar objections were made in testimony by another nearby neighbor.No neighbors spoke in favor of the application. On September 13,2022 the Board of Appeals received two emails from different neighbors both stating they "no longer have objections to the accessory apartment,"when neither of them had previously stated before or submitted any objection to the ZBA. This Special Exception application is related to an application for setback variance relief for the proposed accessory apartment in ZBA# 7645 which was submitted concurrently to the ZBA and opened and heard by the Board during the same public hearings. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application July 7, 2022 and on September 1, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application, the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds that the applicant complies in part with the requirements for the reasons noted below: 1. The Accessory Apartment unit is proposed to be located in a second story addition to an existing accessory structure with a non-conforming area of 797 square feet of livable floor area, where the code permits a maximum of 750 square feet, as described and shown on the floor plan signed by AMP Architecture and as confirmed by the Building Inspector in a memorandum titled "Verification of Livable Floor Area" dated August 23, 2022 and received by the Board of Appeals on August 23, 2022. 2. The dwelling unit complies with the definition of same in §280-4 of the code and complies with all code requirements as defined in Section 280-13(B)(13) of the Zoning Code except for the proposed size of the apartment. The owner confirms that the accessory apartment shall not contain less than 450 sq. feet, but the accessory apartment will exceed 750 square feet of livable floor area, by 47 sq. ft. with an overall square footage of 797 sf all on one floor with only one full bathroom. 3. The applicant herein, owns and resides at the property and will continue to occupy the single family residence as a principal residence in conformance with the code requirements as set forth in Article III, Section 280-13(B)(13)0, 1-4), and as documented by copies of driver's license, utility bills,tax return and voter registration.The applicants stated that they do not qualify for STAR Exemption based on their income. 4. The occupants of the accessory apartment will be either a family member or a resident who is currently on the Southold Town Affordable Housing Registry, and the occupancy shall not exceed the number of persons permitted, in conformance with the code requirements as set forth in Article III, Section 280- 13(B)(13)0, 1-4). The tenant of the accessory apartment will be a family member, as evidenced by copies of a lease. Melissa Hobley's mother Marjorie Hobley will occupy the proposed accessory apartment as confirmed by a birth certificate and copy of a lease. , Page 3, September 15,2022 7646SE,Hobley SCTM No. 1000-128-6-21 5. The owners' plans comply with the on-site parking requirements and provide for a total of 1 parking spaces, as shown on the site plan by AMP Architecture dated August 18, 2022. 6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists., 7. This conversion is/shall be subject to a building permit, inspection by the Building Inspector, and annual renewal of the Certificate of Occupancy. REASONS FOR BOARD ACTION DESCRIBED BELOW: Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1) The Accessory Apartment, as applied for, is reasonable in relation to the District in which is located, adjacent use districts, and nearby adjacent residential uses. 2) This Accessory Apartment shall be in conjunction with the owner's residence in the Accessory structure, and as proposed will prevent the orderly and reasonable use of districts and adjacent properties. The proposed second floor apartment would be out of scale and character of the surrounding neighborhood. 3) Evidence has been submitted to show that the safety,health,welfare,comfort, convenience,order of the Town would be adversely affected by the construction of a second-floor apartment addition with existing setbacks of 4 feet+/-to two property lines in this existing one-story accessory structure. 4)The special exception is authorized under the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory Apartment may be occupied. 5)No adverse conditions were found after considering items listed under Sections 280-142 and 280-143 of the Zoning Code. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Lehnert, seconded by Member Acampora, and duly carried,to GRANT a Special Exception Permit SUBJECT TO THE FOLLOWING CONDITIONS: 1. The accessory apartment shall conform to the size requirements of the code, and shall contain no more than 750 square feet of livable floor area as confirmed by the Chief Building Inspector 2. The applicant shall submit to the ZBA amended architectural drawings with a code conforming livable floor area as determined and approved by the Building Department. 3. The amended architectural design for the proposed accessory apartment shall conform to the variance relief and conditions of approval granted in ZBA# 7645 4. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 5. This Special Exception permit cannot be transferred to new owners. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Page 4, September 15,2022 7646SE, Hobley SCTM No. 1000-128-6-21 In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein.
