SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and,the Suffolk County Department of Planning issued its reply dated February 18, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated June 22, 2022. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a 24, 760. 7 sf non-conforming parcel located in an R-40 zoning district. The property is.accessed by a shared 15 foot wide Right Of Way easement from Peconic Bay Boulevard. The lot treasures 91.99 ft across the front yard property line,then turns south for 303.11 ft toward Peconic Bay,then turns east for 102.7 ft of frontage on Great Peconic Bay, ,then returns 250. 93 ft north back to the front property line. The parcel is improved with an existing 2-story frame dwelling with attached garage and an accessory garage in the northwest corner of the front yard. All as shown on the survey prepared by Jason D. Leadingham,L.S.,dated November 8, 2021. BASIS OF APPLICANTION: Request for variances from Article 11I, Section 280-15; and the Building Inspector's February 10,2022 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing accessory garage; at 1) located less than the code required minimum front yard setback of 40 feet; 2) located less than the code required minimum side yard setback Page 2,September 15,2022 #7645, Hobley SCTM No. 1000-128-6-21 of 15 feet; located at: 2826 Great Peconic Bay Boulevard(Adj. to the Great Peconic Bay), Laurel,NY. SCTM No. 1000-128-6-21. RELIEF REQUESTED: The applicant requests variances for additions and alterations to an existing one car accessory garage for a proposed first floor two car garage addition and a second story addition for a proposed accessory apartment with an exterior second floor deck addition that will result in a front yard setback of 4.0 feet where the code requires a minimum of 40 feet and a side yard setback of 4.1 feet where the code requires a minimum of 15 feet, as shown on the site plan by AMP Architecture dated 08/18/22 ADDITIONAL INFORMATION: At the public hearing,testimony was given and a Memorandum of Law was submitted by an attorney representing the neighbor directly to the east of the subject property objecting to the proposed two-story accessory apartment. Those neighbors also testified on their own behalf objecting to the proposed second story addition to the accessory garage with non-conforming setbacks of 4 feet+/-from two property lines. Similar objections were made in testimony by another nearby neighbor.No neighbors spoke in favor of the application. On September 13, 2022 the Board of Appeals received two emails from different neighbors both stating they"no longer have objections to the accessory apartment,"when neither had previously stated any objection to the Board of Appeals. This application for variance relief is related to a Special Exception application for the proposed accessory apartment in ZBA#SE7646 which was submitted concurrently to the ZBA and opened and heard by the Board during the same public hearings. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 7, 2022 and September 1, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1 Town Law §267-b(3)(b)(1). The requested relief as applied for will adversely affect the character of the neighborhood and be a detriment to nearby properties. Two story accessory structures are not the norm in this neighborhood,The existing one-story accessory garage measures 441.54 square feet in size and is located at 4(four) feet/-to both the front and side property lines. The proposed 627.02 square foot addition on the ground floor for a two-car garage with mechanical room,elevator, and interior hall, closet and staircase will more than double the existing size with a total of 1,068.56 square feet. In addition, the applicant proposes to add a second story over the enlarged first floor measuring 1,062.7 square feet in area, some of which is proposed as storage.The resultant accessory building would contain a total of 2,131.22 square feet which will create the appearance of a second dwelling on the subject property, and will potentially disrupt the privacy of adjacent neighbors and visually impact the shared access Right Of Way. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the legally existing accessory garage on this waterfront parcel does not meet the code required front yard setback for a primary structure or side yard setback in its current location.Unless the structure is lifted and relocated to a conforming location, any additions will require an area variance. Page 3,September 15, 2022 #7645, Hobley SCTM No. 1000-128-6-21 3. Town Law &267-b(3)(b)(3). The variances requested herein are mathematically substantial. The front yard setback of 4 feet represents a 90 relief from the code. The alternative relief granted herein for a front yard setback of 24. 3 feet represents a 39.25% relief form the code and is also substantial. However, this alternative setback will be less non-conforming and visual impacts to other nearby properties will be mitigated by the requirement that all additions to the existing one-story accessory garage must also be only one story. The side yard setback of 4.1 feet represents a 72.6%relief from the code. However,the 4.1-foot side yard setback for the existing one-story accessory garage already exists, so the continuance of this setback, as a one-story structure would not change the character of the neighborhood and would not adversely impact the privacy of adjacent and neighboring properties. 4. Town Law t 267-b(3)(b)(4). No Evidence has been submitted to suggest that variances granting alternative relief in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the Conditions of Approval imposed by this Board. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had,actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of Alternative Relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory apartment in an accessory structure while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Lehnert seconded by Member Dantes, and duly carried,to DENY the variances as applied for, and GRANT ALTERNATIVE RELIEF SUBJECT TO THE FOLLOWING CONDITIONS: 1. The existing non-conforming side yard setback of 4.1 feet may be maintained for the construction of a one-story addition to the existing accessory garage for a proposed accessory apartment and garage. 2. Grant relief for a front yard setback of no less than 24.3 feet for a one story addition to the existing accessory garage which may maintain its existing 4-foot front yard setback. 3. No second-floor habitable space may be constructed. 4. The applicant must comply with the conditions imposed in ZBA# 7646SE. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Before applVin,Q for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final site plan and architectural drawings, conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in Page 4,September 15, 2022 #7645, Hobley SUM,No. 1000-128-6-21 the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration,grant an extension not to exceed three (3) consecutive one (1) year terms.IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN.Failure to comply in a timely manner may result in the denial by the Building Department of a Certificate of Occupancy, nullify the approved variance relief,and require a new variance application with public hearing before the Board of Appeals Any violations of the conditions,occupancy or other requirements described herein,may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. The applicant is one of four lots created by the Zoning Board in 1966. The Zoning Board of Appeals approved the G. Harvey Moore application for the four lots with a common right of way running along the center of the four lots. Thereafter 280A approval was granted with respect to the improvements of the common road. All four lots are encumbered by the right of way, together with 1/2 of the 45' "foreshore" (split 20' +2.5 right of way). The map approved by the Zoning Board in their decision#984 provides a clear depiction of the right of way and beach area. (Exhibit 1-ZBA MAP) • Each lot is subject to four additional Covenants & Restrictions which restrict 1. Minimum size and cost of house, 2. Use for one single family dwelling only 3. The four lots share in cost of maintenance, snow removal and repair of the road 4. The same restriction will be on all four lots. (Exhibit 2-Deed) • The applicant's garage is pre-existing non-conforming. The setbacks are only two feet from the front and side property line. Converting the existing 20' x 22' one-story garage to an accessory apartment would not be objectionable. The impact on the neighbors would be minimal. • Special Permit: The proposed plan is substantially larger than the code allows. The applicant had described to their neighbors this project as "adding a small apartment for mom". No one had any objection to that request, however, the plan submitted is not small. The application is to convert a one-story garage (19'x 22'with 1 Y bays)to a three-car two-story garage. The application is to more than quadruple the overall square ,footage of the pre-existing structure. The proposed two-story garage is 41' x 29' with a 24 x 6 second story deck. • The accessory apartment is described as 719 habitable spaces with a large 19 x 9 storage area and a footprint of 1200 sq ft(with the deck). The actual interior space is 890 sq ft. which includes the"storage"area. The proposed apartment meets the definition of a "dwelling unit". The storage area is livable floor area according to the Town Code definition. The design of the proposed apartment should be revised. The reason that the accessory apartment(livable floor area)size is limited is to avoid making the accessory apartment a 2nd dwelling. See Town Code 280-4 definitions: i DWELLING UNIT A building or entirely self-contained portion thereof consisting of a minimum living area of 850 square feet containing complete housekeeping facilities for only one family, including any domestic servants employed on the premises, and having no enclosed space (other than vestibules, entrance or other hallways or porches) or cooking or sanitary facilities in common with any "dwelling unit."... FLOOR AREA, LIVABLE All spaces within the exterior walls of a dwelling unit, exclusive of garages, breezeways, unheated porches, cellars, heater rooms and approved basements having a window area of less than 10% of the square foot area of the room. Usable floor area shall include all spaces not otherwise excluded above, such as principal rooms, utility rooms, bathrooms, all closets and hallways opening directly into any rooms within the dwelling unit. • The private covenants in this community limit the property to one dwelling per lot. The proposed size of the accessory apartment meets the definition of a second "dwelling unit" which would violate the private Covenants and Restrictions on the property. The Zoning Board does not enforce private covenants; however, the covenants are the "character of the neighborhood". If the variances are granted, the neighbors would be required to bring an action to enforce the Covenants. • Intensifying the use of the property adversely effects the shared driveway and beach access. No one can control the size of a family, but the Board can limit overcrowding by controlling the size of the structures. • The property is one of four lots which has a certain character. The homes are reasonably sized. The proposed accessory structure is larger than two of the four homes in this subdivision. The four families have to share a common, private, road and common beach. This application threatens the peaceful coexistence of the four families in this private development. There are multiple code provisions which place controls on accessory structures, that are violated by this application. (Town Code 280-15) 1. The code places limitations on the size of the customary accessory structure: Accessory structures are permitted, the maximum size allowed is 1,000 to 1,200 depending on the size of the lot (buildable area of the lot verses non-buildable area of the lot). The Proposed accessory structure is 2,400 sq ft. (full two stories). U 2. The code places limitations on the setbacks of the accessory structures. The setbacks are violated. See Schedule 1. 3. The code places limitations on the second floor of an accessory structure: Dormers up to 80% of the roof width. Dormer design is permitted rather than a full second story. The applicants propose a full 2"d story 4. The Code creates limits on the accessory apartment in an accessory structure. What if the applicant's personal circumstances change and the residence is no longer the applicant's primary residence? The neighbors are stuck with an oversized structure. If the apartment then becomes a rental, there would now be two families, which increase the demands of the common road and beach. The existing garage is modest in size with nonconforming setbacks. The subject property is not representative of the surrounding community. Development of the accessory structure on the Yau/Hobley lot disproportionately impacts their neighbors more than the development of typical accessory structures on the individual lots along Great Peconic Bay Boulevard. There have been variances granted for accessory structures within the "neighborhood" on Great Peconic Bay Boulevard. However,.when reviewing the facts of the individual variance applications and the relief granted, there was only one appeal which was somewhat comparable. Of the many variance applications, the issues presented and variances requested in this application have not been reviewed by this Board in other applications in this neighborhood. (Exhibit 3-attached list of variances in the neighborhood). The closest example to the applicant's request was filed very recently and is as follows: Appeal #7642 Dated 6/16/22 on 1000-128-6-10 Girandola. The Board granted a variance for an existing 19'-10" x 22' garage and limited the redesigned dormer to "non- habitable attic space". The existing house was being demolished and reconstructed, the existing garage was pre-existing non-conforming and only the roof line was being changed. The garage footprint was not changing and the Board limited the roof line to allow for non-habitable storage. No living space or the possibility of a later conversion of the modified roof line to living space was permitted. The Yau/Hobley appeal is significantly greater in design and use. The existing nonconforming garage is being more than doubled in size and in height, and the use is adding habitable living space for an accessory apartment. The Girandola appeal sited two appeals which were supplied as comparable files. However, the cases dealt with the setbacks of the principal structure, rather than the accessory structure. In one of the cases sited, Froehlich 128-2-6 there had been a previous appeal#6974 dated 8/9/16 wherein the Board reviewed a request to expand the size of the garage (more than 750 sq.ft.), with larger dormers and non-conforming setbacks. The Board, in denying the relief requested, found that the "existing oversized garages have not been shown to be characteristic of the neighborhood". The Board required a more conforming re-design and conditioned the alternative relief with "garage could be used for storage only and shall remain unfinished and without heat". The Froehlich owners ultimately did not build the approved garage, and they changed their overall design plans on the house with an attached garage. Next door, Cifarelli "as built"accessory structures 129-2-13.4#7206 were denied. These structures consisted of a small shed and a pergola. The Cifarelli property was a pre- existing non-conforming parcel where the principal structure was on the adjacent lot, and the lot containing the accessory structures was vacant (the "back yard" of the waterfront house). The comparable fact is the common driveway. The Cifarelli accessory structures where minor in size and had deminimis impact on the neighboring parcels. Nevertheless, the Board denied the variances. The proposed application will be a detriment to the community. The Special Permit standards could be met with a redesign of the structure. The neighbor does not object to providing a reasonable space for the applicant's mother. The requested apartment exceeds the code, and should be redesigned to comply with the accessory apartment in an accessory structure. Careful effort should be made to have the design of the apartment remain conforming after the CO is issued. The Board has previously reviewed the deign of accessory apartments, and redesign has been favored over a denial of the Special Permit. CONCLUSION No evidence has been submitted that the applicant is entitled to the relief requested. The proposed oversized garage has not been shown to be characteristic of the neighborhood, and the accessory apartment should be redesigned to meet the Special Permit standards in the Town Code. .___._.. . ._ _.
