DECISION AFTER TRIAL

Joseph S. Czartosieski and Joseph S. Czartosieski Inc., by

In this matter the People charged the Defendants with violations
of the Code of the Town of Southold as follows:
Count #1- Sections (2) 100-23A, 100-144A
and 100-70B(4)
Count ~2- Section 100-143
(1),& (2),
Defendants are charged with two informations both alleging viola-
tions of the Code as set forth in Count #1 and Count ~2 supra. One
of such informations relates to the Defendants' alleged use of the
accessory building on the premises as the principal building as
set forth in the accusatory instrument sworn to May 1, 1981. The
Court will refer to this charge as the "Accessory Building Charge".
The other information relates to Defendants' allegedly conducting
a used car lot on the premises as set forth in the accusatory instru-
ment also sworn to May 1, 1981. The Court will refer to this charge
as the "Used Car Lot Charge".
Ail counts were tried by the Court together with the consent
of both sides on February 10, 1982.
During the trial a motion to dismiss Count ~2, in both accusatory
instruments was made by Defendants' Counsel on the ground that same
did not apply to an order to remedy a violation,(People's Exhibit#6),
but rather applied to construction.
The motion was granted and Count #2 was dismissed in each
case.

People v. Czartosieski 3-4-82
With reference to the "Accessory Building Charge" the Court
finds that the People have not proven its' case beyond a reasonable
doubt. There was no evidence adduced at the trial as to the volume
of work done in each building nor that there had been a shift of
the business to the accessory structure.
There is no doubt that the Certificate of Occupancy is for access-
ory use and its use to be collateral and accessory to the upholstery
business Defendants conducts on the premises.
There is no dispute that the principal building and the accessory
building can be used for the same business but it must be just that,
principal and accessory, with the accessory building's use subordinate
and incidental to the principal building's use. The People contended
otherwise, but the sufficiency of the evidence did not support the
contention. The quantum and quality of the evidence did not buttress
the People's case.
Accordingly, the Court dismisses the "Accessory Building Charge"
which alleges a violation of Sections 100-23A and 100-144A(1) of
~he Code of the Town of Southold.
With reference to the "Used Car Lot Charge", the People charged
Defendants with a use violation and here the Court finds that the
People have proven its case beyond a reasonable doubt.
The testimony of Building Inspector Hindermann in this charge
was clear and direct. He stated he saw all of the indices of a
used car lot in operation, to wit, spare automobile bumpers stored
on racks, conversations with Defendant, photographs (People's Exhibits
numbered 8,9 & 10) clearly showing "Used Cars, bought,sold" with
telephone number plus cars on premises together with one car on prem-
ises with for sale sign and Defendants' admissions,to wit that he has
a license from New York State to sell used vehicles. Significant was
Defendants'response to the question:
"Did you in fact sell used cars from the premises?"
The response was a hesitant- "I don't think so, I needed to put
up a sign as a requirement for the State license".
Ostensibly, a State of New York inspector was to believe that the
premises were in fact utilized as a used car lot.
Further, in response to the prosecuter's questionf
"Did you offer vehicles for sale from the premises? Answer was
" Yes, from June 1977 on".
At another point Defendant stated "Yes, vehicles were offered
for sale from the premises by me but trailers were not offered for
sale".

Accordingly, this Court finds the Defendant guilty as charged to
the counts which allege a violation of Sections 100-23A, 100-144A(2)
and 100-70B(4) of the Code of the Town of Southold as relates to the
use of the premises as a used car lot.
Defendant is directed to appear before this Court for sentencing
on Friday March 26, 1982 at 9:30 A.M.

Also excluded was item #8, concerning the fencing in of the drainage
area. (Mr. Cron presented a letter to the board concerning this) He
requested a waiver on this item and stated he would provide the Town
with whatever covenants and agreement that the Town would not be held
liable. He said the roads will remain private ownership and lot owners
will be bound to it. The board had no objections provided that in-
surance be provided on this porperty alleviating the town from any lia-
bility. Mr. Raynor cautioned Mr. Cron that a similar situation has
been before the board at an earlier date and it is incumbant of the
board to review the maps and changes. All information must go to the
Town Attorney for his recommendations. The board requested more time
to review item #5, which will be discussed at the January 18th meeting.
Mr. Raynor also requested more information regarding the parking area
at the end of lot #18o Mr. Young stated that it would consist of loose
base.
.~os~e-s~-sitet~a~ -~ . . ~. Mr. Richard Cron, Esq. discussed this proposal
with the board. He was informed of the actions taken by the board
regarding this plan; the most recent being a request for the applicant
to submit a scaled parking plan of the area. Mr. Cron was unaware of
this request. Mr. Czartosieski then appeared before the board and ex-
plained when he purchased this property, it consisted of a restaurant~,
~l~!est~.t~ office' and an aP~rtm~l~"a~, all of which requires
more parking than his present proposal. The~'bo_a~d[~gain requested that
he submit a scaled parking plan to the board for them to make a deter-
mination.
On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED to request the Town Board to permanently appoint Susan E. Long
to the position of Clerk-Typist of the Southold Town Planning Board
and any time during the interim 90 days, for which she was temporarily
appointed, she receive retroactive benefits and pay that would apply
to the CSEA contract.
Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski
Being no further business to come before the board, Mr. Orlowski made
a motion, seconded by Mr. Mullen, and carried to adjourn. Meeting
adjourned at 3:45 p.m.

Dear Henry:
Your letter of September 17, 1981 to George Fisher
has come to my attention today and since George is vacationing,
I will respond.
This property is Zoned B-1 General Business and the area
and width does not conform to Art. VII Sec. 100-71 Bulk Schedule
of Zoning Ordinance. Site contains approximately 7,834 sq. feet,
which is considerably short of the 30,000 sq. ft. requirement.
Under this section, lot width required is 150' 0" with set back
requirements as follows. Front and rear yard are 35' 0"; side
yards total50' 0", 25' 0" for each side yard.
The building on property pre-existed Zoning. The frame
garage was reconstructed under a building permit, permitted use is
for accessory use only.
The two story frame building contains an apartment on the
second floor. This is a non-conforming use in this district. The
first floor of this building was used by Mr. Czartosieski for his
upholstery business~ a permitted use, since this is the principal
building on the site.

Applications of Joseph S. Czartosieski
Dear Henry:
Recently, the Board of Appeals forwarded correspondence to Mr.
Czartosieski dated August 14, 1981, a copy which has been
provided with your office concerning applications before this
Board by Mr. Czartosieski. It is our understanding that the
Planning Board does not wish to entertain any requests concern-
ing these applications.
Mr. Czartosieski has applied to the Board of Appeals requesting
a change in use of his premises located at Peconic Lane, Peconic,
to include the "sales of used cars" in addition to the upholstery
business. Article VII, Section 100-70B(4) of the zoning code
permits "a use for used car sales" upon applications to the Board
of Appeals for a Special Exception and to the Planning Board for
site an~ parking plan approvals.
The Board of Appeals believes that before it may entertain this
application for a change in use, additional information is needed
concerning the limit of available area for outside storage of the
cars proposed for sales, and since the Planning Board must deter-
mine the "...reasonable and appropriate off-street parking require-
ments for...uses which do not fall within the categories listed..."
in Article Xt, Section 100-112A (page 10043) of the zoning code,
Mr. Czartocieski was asked to obtain that information from your
department. The Board of Appeals may wish to place certain condi-
tions as to the limit of cars for outside storage if these appli-
cations were approved, and this is why your cooperation is being
requested.
A copy of this letter is being forwarded to the applicant and his
attorney in order that they may proceed in this matter.

After reviewing your recent appeal applications, it is
the consensus of the Board that Site Plan Approval be obtained
from the Southold Town Planning Board before scheduling these
matters for public hearings for the following reasons:
(a) The area to be utilized for used cars may affect
the area required for parking;
(b) Clarification of the current uses w~thin these build-
ings.
A copy of this letter and your survey submitted August 6,
1981 are being forwarded to the Southold Town Planning Board.

FACTS
That at or about 9:45 A.M. on April 22~ 1981, the said
defendants were utilizing the accessory building on the premises
at 75 Peconic Lane, Peconic~ Town of Southold, Suffolk County~
New York, as the principal building on the premises for the con-
duct of an upholstery business in violation of the Certificate of
Occupancy No, Z-9386 issued on January 23~ 1979 for an accessory
use. On or a~]out Nove~r~er 2]., 1980~ Edward F. Hindermann~ Build-
ing Inspector~ issued an order notifying the defendants that the
accessory structure had been improperly altered and to comply with
law, and on or about February 2, 1981, the Building Inspector,
Edward F. Hindermann~ issued an order to the defendants notifying
them to remedy the aforesaid violations on or before February 13,
1981. That said defendants have failed to comply with the orders
to remedy the violations~ all contrary to the provisions of the
Code of the Town of Southold ~n such case made and provided.
The above allegations of fact are made by the Complainant

Inspector, with 3 sere of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets o~
areas, and giving a detailed description of layout of property must be drown on the diagram which is part of this application.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.

Inspector, with 3 sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets o;
areas, and giving a detailed description of layout ofproperty must be drawn on the diagram which is part of this application.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such permit
sholt be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.
