On October 13, 1982 the Board of Appeals sent you a letter you that an inspection that they made showed that the right-of- way was not in compliance with the June 12, 1982 report or with the December 1, 1977 decision of the Board of Appeals. According to the Code of the Town of Southold Article XXVIII 100-281 and 100-284 a building permit is needed for construction of a dwelling. It is unlawful to occupy a dwelling until a Cer- tificate of Occupancy has been issued. In order to avoid any legal action you must correct the above violation immediately. Please send the appropriate papers to this office so that we may issue the Certificate of Occupancy. Thank you for your cooperation in this matter. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinitY of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance.
