After investigation and inspection~ the Board finds that the
applicant wishes to construct a non-farm, barn storage building as
a sole structure On'the lot with insufficient frontyard setback of
45 feet from Cedar Beach Road.
The Board finds that strict application of the Ordinance would
produce practical difficulties or unnecessary hardship; the hardship
created is unique and would not be shared by all properties alike in
the immediate vicinity of the property and in the same ~se district;
and the variance will not change the character of the neighborhood
and will observe the spirit of the Ordinance.
On'motion by Mr. Grigonis, seconded by Mr. Douglass, it was
RESOLVED, that DIANE 'GAZZA, c/o North Fork Equities, Inc.,
North Road, Southold, New York 11971, be GRANTED a variance to the
Zoning O~dinance, Article III, Section 10~or permission to
.ha~e a non-farm, barn storage building as the main structure on a

District, and be GRANTED a variance to the Zoning Ordinance for

Instructions
A. This application must be filled in typewriter OR ink, and submitted in duplicate to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with ~ccurate location of all buildings, property lines, streets, and unusual
natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal-(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survev of peopertv showing all property lines, streets, buildings and unusua~ natural or
topographic featu res.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent informa-
tion required to prepare a certificate.

Dear Mr. Lind:
The following action was taken by the Southold Town Plarm~ng
Board at a regular meeting held J~auary 9, 1979.
RESOLVED that the Southold Town Planning Board override
cmndition #1 of the Suffolk County Planning Commission for the
map of the minor subdivision of Margery Burns. The condition of
the Suffolk County Planning Commission states that "No sanitary
disposal facility shall be constructed within 100 feet of the
mean high water line". The override is based on the following
finding of the County of Suffolk Department of Health Servibes.
"Based on the information submitted that the applications be
approved provided (a) that the two wells be located approximately
l0 feet from the common lot line and two feet from the lot ~lines
£ronting on Cedar Beach Road; (b) that the sewage system locations
be designated by the General Engineering Unit, maintaining at
least 75 feet from surface waters. The override is also based on
the request of the Southold Town Planning Board that the number of
lots be reduced from five to two.

A~er %Dvestigation and inspection, 'the Board finds that the
applicant has requested permission to obtain Certificate of Occupancy
of a non-farm, barn storage building with an insufficient fronhyard
setback in one corner of 4~'3". This Board granted a variance under
Appeal No. 2591 on September 6, 1979 approving a 45-foot frontyard
setback, and applicant has stated that when the property was surveyed
after the barn had been constructed in compliance with the New York
State Department of Environmental Conservation's requirements for a
rearyard setback from the water line of 60 feet, it was found that
the frontyard setback was 43'3" and not 45 feet as originally re-
quested. The Board agrees with the reasoning of the applicant.
The Board finds that the circumstances present in this case are
unique, and that strict application of the ordinance would produce
practical difficulties or unnecessary hardship.. The Board believes
that the granting of this variance will not change the character of
%he neighborhood and will observe the spirit of the zoning ordinance.
On motion made by Mr. Grigonis, seconded by Mr. Douglass,.it was
RESOLVED, that JOHN R. DEMPSEY, on the account of DIANE GAZZA
(by North Fork Equities Inc., North Road~, Southold, New York 11971),
BE GRANTED a variance to the zoning ordinance, Article III, Section
100-30, 31, for permission to obtain Certificate of Occupancy with
an insufficient frontyard setback of 43'3", and that the previous
grant of variance in Appeal No. 2591 is hereby rescinded as to those
portions thereof that are inconsistent with this Decision, and that
approval and/or recommendations be obtained from %he Suffolk County
Planning Commiss%on' pursuant~to Section~ 1332 of the Suf{olk County
