R.0.W.. that provides access to the four lots in the subdivision. ~here is an existing narrow dirt road that meanders slightly through the property for access to houses on Lots No. 2 and No. ~. The house on Lot No. I has a separate entrance from Co×~s Neck Road. qhere is a partially completed house on the easterly part of Lot No. 3. ~he existing entrance road at Cox's Neck Road is not ent%rely within the 25 ft. R.O.W. qhe north R.O.W. line is 97 ft. from a monument on Cox,s Neck Road and the north side of the existing ent. rance road is 120 ft. from the same monument. The R.O.W. should be staked out to determine the location of the present road. qbe 0rooer%¥ is wooded and from observation the road was laid out to by-pass some of the larger trees. ~he survey should have shown the existing road location. I would recommend that the existing road be improved by the addition of 6" of ban~run with ~0% of gravel for a width of 12 ft. In order that we may proceed with the signing of the map, would you submit, to our office, three final copies of the map which must include the following eight conditions: Approval of this subdivision shall be made subject to the subdivision meeting the requirements and stand- ards of the Suffolk County Department of 'Health Services. No lot shall be subdivided or any lot line changed in any manner at any future date unless authorized by the Southold Planning Board. Should any additional lot be created within this parcel as it now exists a map of the subdivision shall be filed in the office of the County Clerk. No new sanitary disposal facility shall be constructed or located within 100 feet of the easterly boundary line of the property. No stormwater runoff shall be directly directly discharged into Mattituck Creek or into the tidal wetlands bordering the creek. (2) Sept. 24, 1981 Clearing and grading within each lot shall be limited to that necessary for siting and constructing a house with the intent of preserving as much of the natural vegetation on the site as possible so as to minimize stormwater runoff and erosion, and also to help preserve that part of the swale that is located within the sub- division. Erosion and sediment control measures shall be required during and immediately after construction on each lot to insure that stormwater runoff will not carry eroded soils and other deleterious materials into Mattituck Creek and the tidal wetlands bordering the creek. The above conditions shall be filed as covenants and re- strictions in the office of the County C~erk on or prior to the granting of approval to this subdivision. I was very upset when I learned that George FrieSmann, the builder of the house dj8 not complete the work of getting the approval of the Planning Board for the Sub-~ivision. I assumed that everything was in order since the house was completed and the inspections completed. There was some confusion among us at the time because ~ir. i,'riedmann w.~.s communicating sometimes with me and sometimes with my da~ghter, who was sort of supervising the plans of the house. ~'~.r. Friedmsnn sent some of the records to me andsome to my daughter an~] I thought that she woul~ have the records that I didn't have. i don't remember ~r. Priedmann telling ~ae that any records were lacking. But I ~u trying to get all the necessary doc~aments to the ~lanning Board as q~ickly as i can. I don't know why ~r. Friedmann did not tell ~r. Tranchon, the surveyor, to send,~the sketch maps to the planning Board after he completed the surveys. So that has to be done over again. I have contacted mr.
