For a Variance to the New York State PETITION NO. 1999-1560 Uniform Fire Prevention & Building Code Upon the application of Deborah Dory Esq, filed pursuant to 19 NYCRR 450 on November 15, 1999, and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to an addition and renovation of an existing building of Al(single family residence) occupancy, two story in height, of type 5 (wood frame) construction, approximately 2,700 square feet in area, located at 21055 Main Road, Orient, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 9 NYCRR 7'11.'1 (a)(2), which requires that habitable space shall have a minimum height of 7 feet 6 inches. [The petitioner requests permission to allow a ceiling height of 6 feet 8 inches in an approximate 144 square foot bedroom addition to an existing single family dwelling,] FINDINGS OF FACT 1. The building that is the subject of this petition was constructed prior to the inception of the Uniform Code and is pre-existing and non-conforming. 2. The design of the new addition required alignment of the new and existing roof lines as well as existing interior ceiling heights. 3. The ceiling height in the new bedroom addition is 8 inches lower than the 7 feet 6 inches as required by the Uniform Code which represents a less than 9 percent deviation. 4. Section '1233.3(b)(4) allows an existing ceiling height of 6 feet 8 inches to remain for a building of an A1 occupancy whose substantial completion date is 10 years or more prior to the date of a permit application when the building has undergone a conversion. The bedroom in question has multiple windows which provide more than the required light, ventilation and openings for emergency use which would be beneficial in the event of an emergency. 6. As per 9 NYCRR 721, the petitioner is installing smoke and fire detecting alarm devices in the new bedroom as well as in the corridor outside the bedroom. 7. The local Code Enforcement Official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6 CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.1 (a)(2), to permit a ceiling height of 6 feet 8 inches in an approximate 144 square foot bedroom addition to an existing single family dwelling; be and is he?eby PROPOSED TO BE GRANTED with the following conditions: 1. That the petitioner install smoke and fire detecting alarm devices in the new bedroom as well as in the corridor outside the bedroom as per 9 NYCRR 721. This DECISION is issued under 19 NYCRR 450.6. Unless obiected to by the petitioner in a writin,q received bY the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties. This decision is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application.
