WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lyingandbeingiDltJ(O( at Mittituck, Town .of Southold, Suffolk County,
New York, being more particularly bounded and described as follows:
BEGINNING at a point on the westerly side of Deep Hole Drive where
the same is intersected by the southerly side of land now or
formerly of Nelson, said point also being distant 126.68 feet
southerly as measured along the westerly side of Deep Hole Drive
from the corner formed by the intersection of the westerly side
of Deep Hole Drive with the southerly side of New Suffolk Avenue;
RUNNING THENCE from said point of begi 1 the westerly side
of Deep Hole Drive South 20 40' 40" W st 137.60 eet to land now or
formerly of Kalk;
RUNNING THENCE along said land North 870 19' 20" West 229 feet to
the mean high waterline of Deep Hole Creek;
RUNNING THENCE along the mean high waterline of Deep Hole Creek on
a tie line North 80 43' 20" East 106.95 feet to land now or formerly
of Nelson;
RUNNING THENCE along said land the following two (2) courses and
distances:
1. North 840 07' 00" East 190.00 feet;
2. North 870 01' 20" East 30 feet to the westerly side of Deep
Hole Drive at the point or place of BEGINNING.
Being the same premises conveyed to Grantor herein by Deed dated
8/29/83 and recorded in the Office of the Clerk of Suffolk County
on 9/16/83 in Liber 9426 cp 44.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that lhe party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied lirst for the purpose of paying the cost of the improvement and will apply
the same lirst to the payment of the ~ost.of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed il.$ if it read "parties" whenever the sense of this indent"re ~o requires.
