Located: 465 Old Harbor Road (waterfront parcel at end of right of way), New Suffolk. SCTM# 1000-117-3-12 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. The LWRP form indicates that the backfilled area will be replanted with native plantings. The details of the planting (spacing, density, and survival) are not shown on the plans or included in the description. It is recommended that the backfilled area is replanted to further Policy 6. Town records indicate that a Wetland Permit(5878) for the deck proposed to be replaced was issued in 2003. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Cc: The Honorable Lori M. INSTRUCTIONS 1, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si nificant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III- Policies Pages 8 through 16 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The project seeks to replace an existing bulkhead with a vinyl bulkhead in the same location to maintain the property's historical method of protection against erosion and flooding. The site has been improved with and supported and protected from flooding and erosion by a bulkhead since prior to 1977,and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the bulkhead,the subject property and the adjacent,bulkheaded properties would be exposed to severe erosion,flooding,and potential damage to the residential structures located thereon. And the disturbed portion of the naturally vegetated slope landward of the bulkhead will be revegetated with native plantings upon completion of bulkhead reconstruction (e.g.,Cape American beach grass,Virginia rose). Thus,consistent with Policy 4,the project will continue to effectively protect against the potential loss of the adjacent upland and residential structures without causing significant change to or adverse impacts on the adjacent beach,tidal waters,or adjoining properties.
