Tasker, Superintendent of Highways Raymond C. Dean. 9:30 A.M. - The Board. met witl5 Paul Flagg to discuss the work he has been doing in Mill 'Creek to determine the cause for high coliform counts. There are eight stations which are being monitored presently. Mr. Flagg estimates a cost to the Town of approximately $4,'000 to $5,000 for a complete study, plus laboratory costs, which would include weekly tests. Mr. Flagg was asked to submit a proposal for his services for the Board's consideration. 10:05 'A.M. - Mr. John Halsey, President of Peconic Land Trust, Southampton, met with the Board to offer their'assistance on the North Fork~ Mr. Halsey ,presented background information concerning the Peconic Land Trust, incorporated as a non- profit, tax-exempt charitable organization in':1983 to contribute to the.preservation of rural landscapes through creative development planning which includes land ac(]uisiti0n and limited development strategies. 10:45 A.M. - Community Development Director James McMahon presented the Board with the proposed Community Development, Year 11 budget and placed ReSolution No. 23 on the agenda concerning same, changing only one item from Land Acquisition for Housing Program to: Housing Assistance Project. 11:30 A.M. - The Board discussed off a~]enda items: request for funds byI the Men's Peconic Soccer League (see Resolution No. 20); request by the attorney of Reynold Blum to utilize' the Draft Environmental Impact Statement from the Dalchet, et. al. change of zone petition in relation to his petition for a change of zone [see Resolution No. 25; Upcoming Utility Conference entitled "How to Decrease your Electric Bill by 50%" planned by County Executive Cohalan. EXECUTIVE SESSION 12:15 P.M. - Discussion of possible purchase of property by the Town and personnel problems. 12:50 P.M. - Recess for lunch. 2:00 P.M. - Work Session reconvened and the Board reviewed agenda and off- agenda items and began the audit of bills. 3:.30 P.M. - Work Session recess to conduct four Wetland public hearings. 4:02 P.M..- Work Session reconvened and the Board completed the audit of bills. 4:30 P.M. - Work Session adjourned. REGULAR MEETING 7:30 P.M. A Re~lular Meeting of .the Southold Town Board was held on Tuesday, October..1984 at the Southold Town Hall, Main Road, Southoid, New York. Supervisor Murphy opened the meeting at 7:30 P.M. with the Pledge of Allegiance to the Flag. Present: Supervisor Francis J. Murphy Councilman Joseph L. Edwards SUPERVISOR MURPHY: I'd like a motion to approve the October 9th audit of the bills that was done today. Moved by Councilman Stoutenburgh, seconded by Councilwoman Cochran, it was RESOLVED that the following audited bills be and hereby are approved for payment: General Fund Whole Town l~ills in the amount of $33,277..80, General Fund Part Town bills in the amount of $26,841.71, Highway Department bills in the amoutn of $54,248.97, Fishers Island Ferry District bills in the amount of $20,515.11; Federal Revenue Sharing Fund bills in the amount of .$900.00, and Scavenger Wastewater Treatment Plant bills in the amount of $] 2, 368.~70. SUPERVISOR MURPHY: Moving on to the first item, Number I on t~he agenda, the Reports. I'd like to state in the beginning these reports are on file in the Town Clerk's Office for anyone who wants to see them and to read them. Some of them are very interesting. It's a report of various departments in the Town to the Town Board~ each month. 1. Auditor's Report from the Comptroller on the annual records that was finished up this spring from 1983. 2. Suffolk County Solar Energy Commission report. 3. Nutrition Program - August and September 1984'. 4. Home Aide Program Budget Report - September .198~. 5. Grant Programs Report - September .1984:. 6. Scavenger Waste Treatment Plant Report - September 1984:. ¥: 7. Town Clerk's monthly report - September :1984. 8. Highway Fund monthly report - September 1984. 9. Planning Associates- Szepatowski Associates, Inc. - September 1984:. Report of work that they did helping the Planning Board and various departments in the Town. 10. Building Department's monthly report - September 1984. 11. Town Trustees monthly report - September ~1984.. 12. Supervisor's monthly budget report - September 1984. This is the one that shows how the Town is staying within the budget restraints that were put on by the Town Board last year. 13. North Fork Animal Welfare League~ Inc. - September .1984 report. 14. Fishers Island Ferry District Budget report- September I984. 15. Police Department's monthly report - September 1984. 16. Councilmen's reports. I will ask Councilman Schondebare on my right. COUNCILMAN SCHONDEBARE: There was a meeting of the Code Committee with the regard to the area farm stands. All the farmers, hopefully, who have farm stands were invited to attend. We managed to get a list of those we could identify. A proposed ordinance with regards to the farm stands was sent to everyone ~and we had a meeting of about nineteen people showed up fOr the hearing. It last a coupleI~.~! of hours. We got their input with regards to what they felt as.~to the law and now it's up to us to go back. We'll have another Code Committee meeting shortly at which time we'll take the input they gave us and hopefully start redrafting it and put other ideas into a farm law. Hopefully it 'will'be one that will please everybody~ but that's impossible, so--... SUPERVISOR MURPHY: Good luck. Anything else, Jay? COUNCILMAN SCHONDEBARE: That's it. SUPERVISOR MURPHY: Joe? COUNCILMAN TOWNSEND: As you know,' Frank, there was a--we had a lot of things going on this 'week--the last two weeks. Specifically the Farmland :Preservation Committee started going over the parcels that had been submitted for their consider- ation. Going over surveys and sketch plans of the land the various applicants want to sell the Committee. I think.Frank will fill 'you in on the East End Supervisors' Meeting where we discussed various additional methods of reducing volume in the landfill. ! am a member of the Code Committee which' met with Jay. Also we had a meeting on Housing to try to formulate some ideas on the w~ay we want to handle the housing problem in Southold Town. We also had a meeting on the proposed Master Plan which was attended by the Planning Board and the Town Board and RPPW and ~ also' the Zoning Board of Appeals. Some members of the public came to that. So w<?~ had quite a bit going on. That's all I have. ~ ~ SUPERVISOR MURPHY: Paul~? COUNCILMAN STOUTENBURGH: On the 24th and 25th of last month Jim'McMahon and myself went to Albany for a meeting on the Coastal Management Program and I just. thought I'd like to read to you basically what a Coastal Zone Management or a Local Waterfront Revitalization Program is. Something that we hoping to get a grant for that will help us in utilizing our waterfront to better advantage. The Coastal Zone Management Program offers municipalities in the coastal area a unique opportunity to adopt an ongoing State program. In other words the State has their own Waterfront program, including the Federal government has one alsov-to specific local needs and objectives by preparing and implementing a Local Waterfront Revitalization Program. A Local Waterfront Revitalization Program is a comprehensive realistic proglram for the beneficial use, revitalization and protection of the community"s water resourceS. What it does is it sets up a group who will then determine goals for the Town and hopefully some of the goals would be one of the things we'~e very concerned about, is for instance this latest closing of Mill Creek and Mattituck Creek and sources of pollution that are entering into these creeks. We feel a lot of this is coming from road runoff and this is something the Town wants to have and long overdue~-a study of the drainage of the waters in this Town because to take the waters from our roads and dump them into our creek is spoiling our nest, so to speak, and we hope through this grant program there will be some funds available for this kind of thing. So we went up and found out how it function and hopefully we have good news, we thi~k we have the grant practically in our hands. I don't think we've received it as yet, have we, Frank? SUPERVISOR MURPHY: No, Paul. COUNCILMAN STOUTENBURGH: But I think we've given the green ,light. We're the only Town that has not gotten this grant in all of Suffolk COunty, so we're surely due for it and let's hope we will'have it. I also attending the meetings that were mentioned and I also attended a Water Advisory Committee meetin9 and I'd just like to report that's a pretty active group of people. This is a citizen's group who are advising the Town Board on the problems of--usually we think of it as water underneath us that is drinking water and one of the programs that came up was a developer who was putting a reverse osmosis plant in Mattituck, to give you an idea of the kind of things these people tackle, and a reverse osmosis is that we have salt water or nitrates or Some problem in our water and we can use this machine or gadget, so to speak, and get clear water out of it. The problem is we have bad water that comes from it, water that has not been cleansed and we have to dump this somewheres and they were going to dump it into our creek, and the Water Advisory Committee said they didn't think that was a wise idea, 'that the small amount of polutant, there was only about two to four hundred gallons of water being dumped into the creek--they would prefer to have it put into the Bay, so they will'make a recommendation to the Town, to the Planning Department, so that this will take place and hopefully aiming in the right direction. It's iust a small thing that they're doing, but I thought it would be worthy of letting the people know that you have an on-going citizen group representing you and they're out there in your behalf. That's about all, Frank. SUPERVISOR MURPHY: Thank you, Paul. Jean? COUNCILWOMAN COCHRAN: Being last on the line they leave very little for me to report on. SUPERVISOR MURPHY: We'll change, we'll start down that way next time. COUNCILWOMAN ~COCHRAN: That would be nice for a change. In addition to attending the meeting on the Master Plan and the Housing Committee I was also on the firing line with Jay at the Code Committee when we did have people in to discuss the farm stand code. As Jay stressed, I would just like to agree with him. The final determination will not please everyone but we certainly will work to come up with something that will please the majority. Aside from that, that's it,~ Frank. SUPERVISOR MURPHY: Thank you, Jean. The Supervisor's Report - as you can tell the Town has been very busy. Quite a bit has gone on. A couple of announce- ments I'd like to make for the general public~ I know they're concerned. One is the serious drainage problem up by Porky's Restaurant on the North Road-wthe .County Road and Route 25 meet. We're told that a dontract will' be let in December. Hope- fully if the property taking can be completed by that time and hopefully by next summer this problem will be' eliminated in the Town. Another one is that a controversy that has affected a lot of people and has gotten very heated and very emotional. I'm glad ! think we're finally coming to a very good and sensible solution. Mr. Mills informed me that they are going to withdraw their application for the Moores Woods property, much to the happiness of the people who were opposed going in there with commercial development and have found another parcel right over the Greenport line, right in the Town of Southold, on Moores Lane. It seems like an ideal site. The Planning Board, the ZBA, ~our Master Planner and our Consultant are now work- ing with the owners of this property to come up with a plan which will eventually they'll be coming before the Town Board with some zone changes. I'd like to announce-- you can see out in the hall voter registration is 'going on until 8 o'clock tonight. It will go on next Saturday from 2:00 to 9 o'clock in Town Hall. If anybody wants to vote in the next General Election and is not registered, this will be the last time to do it here and the service is offered by Suffolk County and any of your friends, family or anything, please take advantage and make sure you're registered. Joe mentioned the East End Supervisors, what we're trying to do is get the five East End Towns to get together to try to reduce the amount of volume that we're burying in our landfills and to come up with a sour~ce of material, either glass, cans, paper, cardboard, whatever we could get everybody to agree to pull out of their stream and to find a market for it. Each town is too small to do it on their 'own, but with the five towns we have quite a bit of clout and it's a good way to go. Ii. PUBLIC NOTICES. SUPERVISOR MURPHY: Moving on to the second item on the agenda, Public Notices. 1. The first one is :Army Corps of Engineers, it's Suffolk County Department of Public Works for a 10 years maintenance, beach nourishment, Dramers Cove, Great Peconic Bay in Aquebogue. Comments by October 2,Sth. 2. Notice to Shellfish Harvesters that the Arshamomaque and'Mattituck Inlet . are closed to clamming until additional--we can ihopefully get this resolved and have additional tests made. 3. New York State Department of Environmental Conservation hearing on Thomas Samuels,..c/o J. H. Rambo, inc., application to create a two lot residential subdivision and a hearing is scheduled for 10:30 A.M. on October 25th at Southold Town Hall. 4. Long Island Lighting Company, Notice to all street and highway lightin,q customers, an order granted by the Public Service Commission granting 9.5% general increase, effective September 15t. Good news for everybody. 5. New York State Department of Environmental Conservation, notice of a public hearing on the Department's proposal to adopt revised Part 701 and 702 of Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of N~w York. The public is invited to submit proposals for possible reclassification of water bodies. Written comments by November 30th. 6. Corps of Engineer§ notice of an application by Peter Ne¥1and to maintenace dredge in Gardiners Bay Estates~ East Marion~ Written comments by October 28th. 438 OCTOBER 9, 1984 7. Army Corps of Engineers notice of an application by Stanley Chase to construct three T-shaped pier assemblies on three separate lots, Mattituck Creek. Written comments by October 23rd. 8. Southold Town Plannin9 Board notice of the completion of the Draft Environmental Impact Statement by Nicholas Schick on a major subdivision in the cluster, concept at Orient. Written comments by November 10th. All of these public notices are posted on the Town Clerk's Bulletin Board and are available for anyone who is concerned. Iil. COMMUNICATIONS. SUPERVISOR MURPHY: Moving on to the order of business on the agenda, Communications. 1. The first one is very good news to a lot of people in Town, it's concern- ing the speed limit on Moore's Lane in' Cutchogue and to tie the whole thing in to reduce this. We've had some real serious accidents in there. We've had requests from people and now we've got the official notification that this is coming about. 2. Letter from the New York State DEC and it's a report on the initial efforts of the Department to identify the needs of our marine resource management procjrams and the benefits users can ~xpect if these needs are met. This report, again, is on file with the Town Clerk. 3. From Cablevision. telling us they are proceeding on their rebuild quite rapidly. There's going to be an interruption of service in the Captain Kidd Estates and the surrounding areas for a period of about two weeks from Tuesday_October 2nd between $ A.M. and 5 P.M. These people are being notified also by their television program, Channel 6. 4. Long Island State Park & Recreation Commission announcing New York State Senior Games to be held on Long Island on Saturday, October 20th and Sunday, October 21st. Anyone interested--we passed this to the Senior Citizen Clubs~ Anyone interested further it's available in the Town Clerk's Office. 5.' Letter from Legislator Patrick Neaney over on the South Shore, asking for support on the Public Works Commission to ask them to put in their budget the authority to proceed with the purchase of a County dredge again. This had been sold several ago and many people feel this was a mistake, especially oi~ the East End we feel that. 6. From Eastern Long Island Hospital' thanking the Town Board for their ,1984 Emergency Medical Week Proclamation and our cooperation with them. 7. This is one very important and one that Councilman Paul Stoutenburgh has been trying to push' and has spoken to Harold Berger, Regional Director of DEC about starting and it's a S.T.O,.P. Program - Stop throwing out pollutants. It's the start of trying to get a plan on What would be done in each 'Town in our landfill_ We'd probably have to build some kind of small holding building ~.here a safe Place for anyone who has chemicals that are outdated, don't know what to do with it,~ please don't throw them in the water, bring them to the landfill and we'll take care of them properly. COUNCILMAN STOUTENBURGH.~ .Just a follow-up on that. We're going to have a meeting here on October 11th at 10 o'clock in the morning with 'the DEC and basically it's going to be one for the home participant. This is the person who has two or three old cans of DDT or some pesticide in their garage and they have enough common sense to not throw it in our Town Dump, but they don't know-what to do with it, and I think we're going to have a program right here in the Town where we'll have a day set aside where you can bring all this material andl it will be taken care of the DEC and you, can be assured it 'will be taken care of in the proper way. Later on we're going to have, as Frank has suggested, a larger program, an on-going program, but that's going to take.time, but for the interim we're going to have this emergency one and we're going to have a meeting here right on Thursday at 10 O'clock .and anyone who Would like to be invited, we'd be glad to have. you. (Amendment to Community Development Year. 9 Program: Flint Street Housing Rehabilitation & Fleet Street Sewer Extension.) Number 3 is to engage the service of H2M to analyze our scavenger waste lagoon. Moved by Councilman Townsend, seconded by Councilwomen Cochran, it was RESOLVED that the Town Board of the Town of Southold hereby engages the · services of Holzmacher, McLendon & Murrell, P.C. to analyze quarterly samplings of the scavenger waste lagoon at the .Cutchogue Scavenger Waste Site, at a cost to the Town of $185.'00 per quarter, all in .accordance with their proposal dated September 21, 1984.. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 4 is the decision on the Wetlands Application of the Harbor Lights Property Associaiion. Moved by Councilman Stoutenburghj seconded by CouncilWoman Cochran, WHEREAS, Harbor Lights Property Association applied to the Southoid Town Board for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated June 27, 1984, and WHEREAS, said application was referred to the Southold Town Trustees and Southold Town Conservation AdvisOry Council for their findings and recommendations, and WHEREAS, a public hearing was held by'the Town Board with respect to said applica- tion on the 28th day of August, 1984~, recessed and reconvened on 'the 11th day of September, 1984,, at which times all interested persons were given an opportunity to be heard, now, therefore, be it RESOLVED that Harbor Lights Property Association be-Granted permission under the provisions of the Wetland Ordinance of the Town of Southold to dredge the canal at Harbor Lights Beach, Harbor Lights Cove Inlet, and use the resultant spoil as beach nourishment above mean high water. This permit 'shall expire on September 25, 1985 if work has not~.commenced by said date; there shall be two inspections required; and the Town Clerk shall be notified when the project is completed. Moved by Councilwoman Cochran, seconded by Councilman StoutenbUrgh, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes all Town Board Members, Plannin9 Board member William F. Mulle, and Community Development Director James C. McMahon to attend the Housin9 In. Suff01k: Status and Needs Conference to be held on Tuesday, October 30, 1984:, and Housin9 for Suffolk's Elderly Conference to be held on TYhursday, November-~7-T~84, both at the Suffolk County Legislative Building, Hauppauge, New York, and the actual and necessary expenses for travel and registration shall be a legal charge against the Town of Southold. Moved by Councilwoman Cochran, seconded by Councilman Townsend, ir'was RESOLVED that the Town Board of the Town of Southold hereby accepts, with regret, the resiqnation of James M. Wall, member of the Southold ~own Plannin9 Board· effective October 15, ,1984. SUPERVISOR MURPHY: 6.-Vote of the Town Board: Any questions? (No response.) SUPERVISOR MURPHY: At this time I would like to make a public announcement that the Town Board will be asking for resumes, anybody who is interested in servin9 on the Plannin9 Board there is'a vacancy of Mr. Wall's term. Mr., Wall did come from Fishers Island. It is not necessary that the new member be appointed from Fishers Island so you can apply. We'll take resumes from anyone interested up to November 1st and the Planning Board and the Town Board will'make a decision at our November 8th Town Board meeting. This will be advertised in the papers also and resumes are to be sent in to the Town Clerk. Moving on to Resolution No. 7, it's a renewal of a house trailer permit. 7. Moved by Councilman Stoutenburgh, seconded by Councilwoman Cochran, it was RESOLVED that the application of Ange and Barbara Boursiquot for ~enewal of their single family house trailer' permit, which expires on November 4, 1984, for trailer located at private road off of the north side of Main Road, Mattituck, New York, be and hereby is 9ranted for a six (6) month period. 7.-Vote of the Town Board: Ayes: Councilwoman Cochran, Councilman Schondebare, Councilman Stoutenburgh, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 8 is another trailer permii 'renewal. 8. Moved by Councilman Stoutenburgh, seconded by Councilwoman Cochran, it was RESOLVED that the application of George A. McCarthy for renewal of his single family house trailer permit, which expires on November 4, .1984., for trailer located on private road, off south side of Main Road, Laurel, New York, be and hereby is 9ranted for a six (6) month period. Moved by Supervisor Murphy, seconded by Councilman Townsend w it 'was RESOLVED that the Town Board of the Town of Southold hereby authorizes that the $10,000.00 received from Constantine GeorgioPoulos, in lieu of park and play- 9round in connection with his major subdivision, be placed in the Park Land Money Maker Account to hold in reserve. 10. SUPERVISOR MURPHY: Well, the two department heads, the Police Chief and the Highway Superintendent did not want to take their $8,:000 or $9,000 for equipment out of this year's budget and rather than lease it was suggested that they sell the bond anticipation note for three years and take it out of the three years budgets. COUNCILMAN TOWNSEND: As you recall, we had a discussion, iWe had a difference of opinion on this before at the Budget discussion we had a disagreement about this, so that's why Jay's bringing up the point now, because we hadn't resolved that issue. COUNCILMAN SC.HONDEBARE: Yes, we left that open. We never did resolve it. SUPERVISOR MURPHY: Well', we directed Mr. Tasker to prepare.this at this last meeting. If you didn't want to do it, why did we direct him to prepare it? COUNCILMAN SCHONDEBARE: I don't remember directing him to prepare it. SUPERVISOR MURPHY: We can put in the Budget and pay it off in one year, pay it off the next year. This way they'll be able to buy it right now and put the $9,000 in each department's budget next year to pay it off. You could do it that way. This way we'll provide the funds right now. COUNCILMAN STOUTENBURGH: In other wordsr it's like renting it and paying for it--- SUPERVISOR MURPHY: Leasing the equipment for a year at much less half the interest rate, a third the interest rate. Instead of paying 15 - 16 percent, we'll be borrowing at about 6 or 7 percent. COUNCILMAN STOUTENBURGH: They do want to get started. COUNCILMAN SCHONDEBARE: We know they do want to get started and I'm all for it and I wholeheartedly support the project, I just can't see doing the bond. COUNCILMAN STOUTENBURGH: COUNCILMAN SCHONDEBARE: layed out. Okay, how about this idea, is it all right? No, I just want it in the Budget, the $19,500 SUPERVISOR MURPHY: Lay it out in the Budget, Jay. This way they could order the stuff right now. They could order it, they COuld pay for it and then when--we could pay the bond off at any time after the first of the year we want. COUNCILMAN SCHONDEBARE: Yesr but we're not going to do that. SUPERVISOR MURPHY: You could do it any time you want. COUNCILMAN SCHONDEBARE: We're not going to do that and you know that and I know that. No, i'm against it. Moved by Councilman Stoutenburgh, seconded by Councilwoman Cochran, COUNCILWOMAN COCHRAN: i'11 second it so you can discuss it.~ BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK, ADOPTED OCTOBER 9, 1984, AUTHORIZING THE ACQUISITION OF COMPUTER HARDWARE FOR VARIOUS TOWN DEPARTMENTS, STATING THE ESTIMATED MAXIMUM COST THEREOF IS $195.00, APPROPRIATING SAID AMOUNT THEREFOR, AND AUTHORIZING THE ISSUAh~CE OF $19,500 SERIAL BONDS OF SAID TOWN TO FINANCE SAID APPROPRIATION. THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less than two-thirds of all the members of said Town Board) AS FOLLOWS: Suffolk, Section 1. The Town of Southold, New York (herein called "Town"), in the County of is hereby authorized to acquire computer hardware for various Town departments. The estimated maximum cos% of said class of objects or purposes, including preliminary costs and costs incidental thereto and the OCTOBER 9, 1984 financing thereof, is $19,5',00 and said amount is hereby appropriated therefor. The plan of financing includes the issuance of $19,500 serial bonds of the Town to finance said appropriation, and the levy and collection of taxes on all the taxable real property in the Town to pay the principal of said bonds and the interest thereon as the same shall become due and payable. Section 2. Serial bonds of the Town in the principal amount of $19~ 00, are hereby authorized to be issued pursuant to the provisions of the Local Finance Law, constituting Chapter 33- a of the Consolidated Laws of the State of New York (herein called "Law") to finance said appropriation. Section 3. The following additional matters are hereby determined and declared: (a) The period of probable usefulness of said 6~ss of objec=s or purposes for which said $19,500 serial bonds authorized pursuant to this resolution are to be issued, within the limitations of Section ll.0g a. 81.(a) of the Law, is ten (I0) years, but the purposed maturity of said serial bonds or bond anticipation notes issued in anticipation thereof shall not exceed five (5) years from the original issuance of obligations. (b) Current funds are not re_c/uired by the Law to be provided as a down payment prior to the issuance of the bonds authorized by this resolution or any bond anticipation notes issued in anticipation thereof in accordance with Section 107.00 d. 4 of the Law. (c) The proposed maturity of the bonds authorized by this resolution will not exceed five (5) years. Section 4. Each of the bonds authorized by this resolution and any bond anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of validity as prescribed by Section 52.00 of the Law and said bonds and any notes issued in anticipation of said bonds, shall be general obligations of the Town, payable as to both principal and interest by general tax upon all the taxable real property within the Town without limitation of rate or amount. The faith and credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of and interest on said bonds and any notes issued in anticipation of the sale of said bonds and provision shall be made annually in the budget of the Town by OCTOBER 9, 1984 appropriation for (a) the amortization and redemption of the bonds and any notes in anticipation thereof to mature in such year and (b) the payment of interest to be due and payable in such year. Section 5. Subject to the provisions of this resolution and of the Law and pursuan~ to the provisions of Section 30.00 relative to the authorization of the issuance of bond anticipation notes and of Section 50.00 and Sections 56.00 to 60.00 of the Law, the powers and duties of the Town Board relative to authorizing bond anticipation notes and prescribing the terms, form and con=en=s and as to the sale and issuance of the bonds herein authorized and of any bond anticipation notes issued in~ anticipation of said bonds, and the renewals of said notes, are hereby delegated to the Supervisor, the chief fiscal officer of the Town. Section 6. The validity of the bonds authorized by this resolution and of any notes issued in anticipation of the sale of said bonds, may be contested only if: (a) such obligations are authorized for an object or purpose for which the Town is not authorized to expend money, or (b) the provisions of law which should be complied with at the date of the publication of such resolution are not substantially complied with, and an action, suit or proceeding contesting such validity, is commenced within twenty days after the date of such publication, or (c) such obligations are authorized in violation of the provisions of the constitution. Section 7. This bond resolution shall take effect immediately, and the Town Clerk of the Town, ~s hereby authorized and directed to publish the foregoing resolution, in full, together with a Notice attached in substantially the for~' prescribed by §81.00 of the Law in "THE LONG ISLAND TRAVELER- MATTITUCK WATCHMAN," a newspaper published in Southold, New York, and in "THE SUFFOLK TIMES," a newspaper published in Greenport, New York, each having a general circulation in the Town and hereby designated the official newspapers of said Town for suck publication. 449 450 OCTOBER 9, 1984 COUNCILMAN SCHONDEBARE: On the record. I feel it's a worthwhile project. i want the Police Department to be computerized and I want the Highway Depart- ment to be computerized and in fact ! want a number of agencies in this Town computerizecl. However, I don't think you should bond for something under $20,000, so I can't see any sense in doing it that way. it should be a line right in the budget. So in that sense I can vote for this. SUPERVISOR MURPHY: There was. no money in their budgets, Jay and the Police Department budget is very, very tight. Mainly through overtime. COUNCILMAN SCHONDEBARE: When you have the money you buy it. The word "REFUSE" set forth in §48-1 thereof is hereby amended to read as follows: TI. REFUSE - Any human, [or] animal or vegetable refuse, offal, swill, cesspool and/or septic waste, sewage, garbage, paper, ashes, junk, trash, rubbish, waste, of wha%ever material composed, discarded machinery or parts thereof, discarded vehicles or parts thereof and an unlicensed motor vehicle parked, stored or standing outside an enclosed building in an inoperative condition for more than thirty (30) days. The term "REFUSE-DISPOSAL AREA" set forth in ~48-1 thereof is hereby amended to read as follows: OCTOBER 9, 1984 453 REFUSE DISPOSAL AREA -T~i~ary landfill site owned and operated by the Town o~' $~hold located north of County Route 48 at Cutchogue, New York, and any premises designated by the Town Board as [the] a refuse disposal area of [this] the %own for the disposal of--refuse by the residents of [this] the town. III. Subdivision C of ~48-3 thereof is amended to read as follows: IV. No vehicle shall be permitted to transport refuse into any refuse disposal area maintained by the Town of Southold unless such vehicle displays a valid [parking] psrmit and/or license issued pursuant %o the provisions of [~48-3 of the Code of the Town of Southold.] this chapter. ~48-4 and ~48-5 thereof are renumbered ~48-5 and S48-6 respectively. A new ~48-4 is added thereto, to read as follows: §48-4 Permit and License Fees. The fees for the issuance of permits and/or licenses for vehicles transporting refuse into any refuse disposal area maintained by the Town of Southold shall be as follows: (1) Parking permit - For non-commercial vehici~s of less than one ton.capacity owned by a resident and/or taxpayer of the Town of Southold and transporting only household refuse, provided that such vehicle displays a valid parking permit issued · pursuant to-the provisions of ~65-3 of the Code of the 'Town of Southold. (2) $.50 (fifty cent) Per Load Fee - For each non- commercial vehicle of less than one ton capacity, which possesses not permit. (3) $15. Per Load Fee - For each sinqle axle truck which (4) (5) ,.(6) .(7) 3,9) (10) does not possess a permit. $25. Annual Fee - For each commercial vehicle transportin~ liquid septic waste, together with an additional fee of $.01 (one cent) for each gallon of liquid waste discharged. $25. Annual Fee - Fo~ each commercial contractor's vehicle of less than one ton maximum gross vehicle weight. $25.. Annual Fee - For each farm vehicle of one ton or more capacity, transporting agricultural waste. $25. Per Load Fee - For each double axle truck which does not possess a. permit. $t00. Annual Fee - For each single axle vehicle transporting solid waste (garbage). $100. Annual Fee - For each commercial contractor's vehicle of more than one ton capacity. $250. Annual Fee - For each double axle and/or compactor type vehicle transportinq solid waste (~arbage). (11) $250. Annual Fee - For each commercial contractor's double axle and/or tractor-trailer combination of more than one ton capacity. B. Issuance and Duration of Permits and/or Licenses. All permits and/or licenses provided for in this chapter shall be issued by the Town Clerk. All annual permits (including those previously issued) shall expire one year from the date of the issuance thereof. 45'4 C. Refund of Fees. In the event that the Town Clerk has'heretofore issued permits for vehicles transporting refuse into the town landsite at Cutchogue, and the fees paid therefor exceed the fees provided for herein, the Town Clerk is hereby authorized to refund such excess fees to the holders of such permits and/or licenses. D. Amendment of Fees. Notwithstanding any of the provisions hereof, the Town Board may, by resolution, change, modify or repeal any of the fees set forth in S48-4 hereof. VI. This local law shall take effect upon its filing with the Secretary of State. COUNCILMAN STOUTENBURGH: But there are no penalties on this. COUNCILMAN TOWNSEND: This amended the whole the law. It merged the entire section. COUNCILMAN STOUTENBURGH: And where are the penalties? SUPERVISOR MURPHY: Bob, where would the penalties on the Local Law?: that in the Code now? Is TOWN ATTORNEY TASKER: Which penalties? SUPERVISOR MURPHY: On Local Law No. 9 in the landfill. TOWN ATTORNEY TASKER: That's in the code. SUPERVISOR MURPHY: It's in the Code presently7 TOWN ATTORNEY TASKER: Sure. There already has been a penalty in there. We did it by a resolution. Now we're doing it by adding this into that Local Law which provides for penalties and fines. SUPERVISOR MURPHY: Any other questions? (No response.) Everybody happy with it? Mr. Carlin. MR. FRANK CARLIN, Laurel, N.Y.: Why am i always the last one? What I have tonight, ladies and gentlemen of the Board, is a request and being that Ray Dean is not here I was wondering if you would be so kind to listen to this request, and I was 'disappointed that he wasn't here. I was expecting him to call me but I guess something happened and he didn't. What i would like to show you here is'these photographs--I'll pass them to you--of Cedar Drive (Southold). This is the residence of Mr. and Mrs. Bob Kramkowski on Cedar Drive and that condition you see there has been existing for between seven to eight years and perhaps over that. Now I'm going to read you a letter that Mrs. Kramkowski wrote. "At the end of June Mr. Jacobs told me that they were going to start work on this 'in two weeks. That was three months ago. He used the excuse that they were busy tarring roads. At that particular time I don't know what. roads as I haven't seen any that were done. I have been after this for about seven to eight years. I've called several times this year." Ladies and gentlemen, I think this is a disgrace. Here's people, husband and wife, residents of Southold Town all their lives, taxpayers, and they have to put up with something like this.' The statement was made by Mr. Jabobs that, "Well after seven years I guess we should do something about it." It's a plain disgrace. It got so bad that they had to replace their wooding fence, that's how much water they had there when it rains and nothing has been done about it for seven to eight years or more. The Town has been called up like I read and nothing was done. The piciure is worth a thousand words and there's fifteen thousand there, as far as I'm concerned, and I don't think this is fair. I think something should have been done about this before now. They are taxpayers and right is right. I am disappointed that Ray Dean is not here. I invited him last month to come here and I figured that he wouldn't be here for two reasons. One, that he's afraid to face me. Two, that he don't care. And I come to the conclusion both are valid. The man belongs at a Town Board meeting, especi:ally the night one, so things like this can be discussed with him face to face. That's his responsibility. That is 'why he's getting almost $40,000 a year. That is his responsibility. When is he going to realize this? And Frank, if from now coming if more. A right for please do you may, please take this back to Ray. If he don't want to debate me on, say so and ! won't waste my time coming here no more. When is he he don't want to face me face to face and we discuss these things. I have lot more. This is only the beginning, and ladies and gentlemen, it's not these people to have to put up with this kind of nonsense, so I ask you, something about it. I think they waited long enough. No promises, please do something for them. MRS. DOLORES KRAMKOWSKI: Actually that has been, I would say, over thirteen years. When that was first taken care of a long time ago, we were having problems. They put a drain. At that time my father, who's long since retired, worked for the Town and when they did' that drain he was working then and he told them at that time, this isn't going to work. This is clay. They didn't go down far enough. As a result, it never worked. Judy, ! think you probably know, you go through there and i'm sure you've gone through that puddle many a time. TOWN CLERK TERRY: At least twice a day. SUPERVISOR MURPHY: She iust told me that. MRS. KRAMKOWSKI: I called many a times. About thirteen years ago, as I recall, before we remodeled that house, I called the Town. They send two men, two young men, they came to the door. They said to me, "Yes, lady, ! think you do have a problem." They left. That was it. That's it. I kept calling. Now I got the excuse, "it's only on a heavy rain. It's only on a heavy rain." It wasn't on a heavy rain. It was on any rain. In fact last year one time I called and called 8 o'clock in the morning. I said, "Mr. Jacobs---Mr. Dean, did we have a heavy rain last night?" He says, "No." I said, "Then please come check my pond in front of my house, because it is across the road." This year I called three times. The one time i called, I said, "Mr. Dean, .there's ducks swimming out in front of my house. They're' diving. They're actually diving in the water." That's how deep it was. From across the street the dirt from the driveway all comes in my driveway. We want to get our driveway fixed, we can't. To get in the car we have to step in two, three inches 456 OCTOBER 9, 1984 of water by our garage. We've replaced our fence posts, they rot out. We've had roses, they drown. It got to the point,to get our mail we have to put boots: on. We have to put boots on. It got to the point we're joking around, we're going to buy a rowboat to go get our mail in front of our house. It's really bad. Now, when he came by in June, Mr. Jacobs came, he came to the door, inspected, and he said, "We definitely are going to do something. We will be starting in 'two weeks. Well, two weeks came, two weeks went. A month came, a month went, Two months, three months. They never came back. They just don't do a thing and they did say that they have to dig deeper for another drain or have it go across the road, because it's getting worse, it's not getting better. It's getting worse and worse and the cars go through there, they have to go one at a.time. The kids used to go to school, they have to go on neighbors yards to get the bus, they couldn't go through our d rivew ay. ~ SUPERVISOR MURPHY: Ray and ! will go there Thursday. I have to go into New York on the Farmland bond issue tomorrow and so I can't go, but Ray and I will be there on Thursday, I guarantee you. MRS. KRAMKOWSKI: He himself told me jokingly, "Well after seven, years of complaining i think we really should do something." This was early this year. SUPERVISOR MURPHY: Ray will do something, he will. MRS. KRAMKOWSKI: We really would appreciate having something done because it's getting hazardous there and we've got little children on our road now, ,across the street and it's going to be very haza'rdous for those little children. SUPERVISOR MURPHY: It's very bad in'the wintertime with ice, too. MRS. KRAMKOWSKI: It is, when it gets iced up, it's just total ice. SUPERVISOR MURPltY: It will be taken care of. MRS. KRAMKOWSKI~ I thank you very much. SUPERVISOR, MURPHY: Thank you for bringing this to our attention. MR. CARLIN: One more thing, I did not receive a notice, Frank, of the stand meeting, you know, which I have a stand at. I don't sell that much, but I have a stand there. I didn't know there was a meeting, so I did not receive the notice that there was a meeting. I have a stand, as yoUknow, i don't sell only raspberries. TOWN CLERK MR. CARLIN: a farm or just COUNCILMAN COUNCILMAN district? TERRY: I believe they were sent to farmers, specifically. Well, what am I considered, I have a whole stand. Am I considered a hobby? STOUTENBURGH: They didn't do all the little ones. SCHONDEBARE: Are you selling retail in an agricultural-r~sidential MR. CARLIN: What? COUNCILMAN SCHONDEBARE: in a residential area? MR. CARLIN: I'm agricultural. COUNCILMAN SCHONDEBARE: Are you selling? Are you conducting a business I just sell raspberries. I don't understand. Are you conducting a business in a residential area? Are you selling something? MR. CARLIN: No, this is agriculture, this is faro area, this is rated as faming where I am at. COUNCILMAN SCHONDEBARE: Are you conducting a business in an agricultural--- MR. CARLIN: This is no business. COUNCILMAN SCHONDEBARE: No? MR. CARLIN: No, it's no business. Just one thing on Why I was disappointed 'in not seeing Mr. Ray Dean here tonight. I don't want to let you in on a,II my secrets, but I have so many cases, you see all these here. ! have so many things I have to discuss. Do you see all these pictures here? That's only the beginning. You see, I've got alt these cases I wanted to discuss with Mr. Dean and I must see him face to face to get these things answered, you know? OCTOBER 9, 1984 , 57 SUPERVISOR MURPHY: I'll see if J.i.can~ a~ange something. MR. CARLIN: I hope so. If not, then he should tell me. I think it was fair enough for me if I couldn't make it, and I have a cold tonight, I could have stayed home, but I came and I would have called him if I couldn't have made it. COUNCILMAN TOWNSEND: Have you gone to his officer Frank? MR. CARLIN: Excuse me? COUNCILMAN TOWNSEND: Have you gone to his office to see him? MR. CARLIN: No, I figured that--- SUPERVISOR MURPHY: We'll set an appointment up for you at his office. MR. CARl_IN: Well, I'd like to have the debate here' inlthe hall. SUPERVISOR MURPHY: Mr. Dean does not have to attend, and his wife is sick right now. MR. CARLIN: Oh, okay. SUPERVISOR MURPHY: And he's not going--- MR. CARLIN: But he could attend the Board meeting, the public meeting. SUPERVISOR MURPHY: He was at the Work Session all day. MR. CARLIN: Yes, but he should attend this meeting here tonight. I know other towns do it. I mean, Riverhead Town's Highway Supervisor makes every meeting they have at night. COUNCILMAN TOWNSEND: Well, we can't order him to do that. MR.. CARLIN: But this isn't the policy. I mean, he belongs here. He's being paid by the taxpayers. COUNCILMAN TOWNSEND: He's an elected official. MR. CARLIN: He's an elected official, .they pay his salary. Many times there are questions are brought up here which I've noticed are in his area. He could answer and he's not here to answer it. SUPERVISOR MURPHY: Like an elected official does not every have to show up for work. MR. CARLIN: Then what's he getting paid for? COUNCILMAN TOWNSEND: If he wants to stay elected he will. MR. CARLIN: I mean, but if other towns can do it,' why can't he, he belongs here as well as you do, Frank. SUPERVISOR MURPHY: Frank, Mr. Dean has done a very good job over the years for the highways in the Town. ! think we have snowplowing--I don't any Town could match us--the condition of our roads. There are some cases, like this one, I don't know what happened, but we'll find out. MR. CARLIN: There are a lot more cases. SUPERVISOR MR. CARLIN: SUPERVISOR MURPHY: But we'll find out, we'll find out. That's what I want to get settled. MURPHY: And I think they can be straightened out properly. MR. CARLIN: Because this should be done. But he--should make at least the evening Town Board meeting. Riverhead does. Frank, I spoke with Charlie Bloss this morning, he said, "i make the Town Board--especially the one in the evening. I belong there." SUPERVISOR MURPHY: Okay, that we can't do anything about. MR. CARLIN: I have the. menu with me here and it's right on there who makes the Town Board meetings in Riverhead. 458 z s4 SUPERVISOR MURPHY: Anything further? Thank you, Frank.
