Instructions
A. This application must be filled in typewriter OR, ink, and submitted in DUPLICATE to the Building
Inspector with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and
unusual natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal--(S-9 form or equal),
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and
installations, a certificate of Code compliance from the Architect or Engineer responsible for
the building.
5, Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of property showing all property lines, streets, buildings and unusual natural
or topographic features.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent
formation required to prepare a certificate.

BOARD O~ HOUSING APPEALS
TOWN OF SOUTHOLD
OCTOBER 6, 1975
A hearing was held by the Board of Housing Appeals,
Town of Southold, at 8:00 P.M. (E.D.S.T.), Monday, October
6, 1975 at the Town office, Main Road, Southold, New York.
There were present: Messrs: E. Kenneth Tabor, Chairman;
John J. Talbot; Frank A. Lekich.
Also present: Mr. George Fisher, Building Inspector of
the Town of Southold; and Mr. Guy Martin, President of G. & M.
Construction Corporation.
The Chairman called the hearing to order, and opened the
hearing by reading the Request for a Variance in the matter of
the Appeal of G. & M. Construction Corporation. (Copy attached).
THE CHAIRMAN: We will hear first from. Mr. George Fisher.
MR. GEORGE FISHER, Building Inspector: For the Board's
inspection, I submit Building Permit No. 7748Z and a set of
blueprints. The notations are in "red". I also have here
the Notice of Violation signed by Mr. Howard Terry. At the
time of the second inspection the house was being framed, it
was not completed, and the windows were checked at tha~ time
and okay'd.
THE C]LAIRMAN: Were just the windows okay'd at that time?
MR. FISHER: Yes. Concerning the floor area of the two
bedrooms, they were found to be undersized at a later inspection
after the closets had been installed. A Certificate of Occupancy
was denied and an appeal was made. Here is a copy of the notice
sent to the builder on the 23rd of September.

(The Board inspected all material submitted by Mr. Fisher).
THE CHAIRMAN: We would now like to hear from Mr. Guy
Martin, President of G. & M. Construction Corporation.
MR. GUY MARTIN: This is a partially pre-fabricated house.
You can frame or enclose the shell house without partitions
inside. Having seen Mr. Terry's notations on the plan, I did
not know whether he meant windows or floor area. I think it
was on the second inspection that all the floors were open.
I said "let's see what this means", which we did. We
measured all walls both ways without having our closets there
which served both bedrooms. The house was enclosed but did
not have those closets. We kept coming up with more than
enough floor area. Based on the notations on the Inspector's
plans, we c~ne up with way over what was required. We felt
that the Inspector probably meant the windows. We had more
than enough glass there. So, we determined that it was
probably just an error. I was told that it was okay to go
ahead and complete. This error was picked up on the last
inspection. The rooms were remeasured and we came up too
short, 2" short.
MR. FISHER: I did not take the final measurements.

measured the actual floor area.
MR. JOHN TALBOT: Is a set of plans on the job?
MR. MARTIN: Yes.
MR. TALBOT: Did not Mr. Terry measure the plans? The
origlnal drawing says they are too small.
MR. MARTIN: We did not know what it was because while
we were measuring,these rooms were open. While we were both
on our knees we came up with more room than we needed. The
closets were not there. When he came in for the first in-
spection and the second, this was wide open. We were not
thinking about closets. We measured again at the time of
the final inspection.

MR. JOHN TALBOT: Have you ever built this type of
house before?
MR. MARTIN: Not this house.
THE CHAIRMAN: DO you have some comments to make on this,
George?
MR. FISHER: As Mr. Martin

MR. FRANK LEKICH: If this was not clear to you, did you
check with Mr. Terry when you got back to the office?
MR. FISHER: I could not say. I don't recall now, Frank.
MR. LEKICH: What solution would there be in order to
make these rooms the proper size without costing a great deal
of money?
MR. MARTIN: I suppose the whole wall could be eliminated.
When we went over these things to try to solve the problem
quickly, Mr. Tasker said "what if we remove the closet doors?"
That would give us 80 sq. ft. of floor space. Then we said
we would go to appeal to see what the Board thinks about it.
The rooms are a bit small but these people have two very
small children. The house is 78 feet long so they have more
than enough room. These bedrooms, aside from the master bed-
room, are small. One is for one of the children and the other
for a TV room.
MR. LEKICH: You have an open basement, a full cellar.
MR. MARTIN: It's 8 feet high.
THE CHAIRMAN: This has nothing to do with the rooms in
question but we were wondering, when we looked the whole job
over, how you are allowed to install such stairways. As

MR. MARTIN: I am against this sort of stairway but some
people insist on paying as much as $5,900 for them.
THE CHAIRMAN: They seem to be dangerous.
MR. MARTIN: Especially for a tall person.

of the Board would like to ask?
MR. JOHN TALBOT: If you were able to cut down the closet
area by putting sliding doors in, would that help the situation?
MR. MARTIN: We have closets to service each room. I
think each is 5 feet wide. If we opened up the front of them
it would give us 80 sq. ft.
THE CHAIRMAN: You would take out the whole front.
MR. MARTIN:

here because this closet door (referring to blueprint) swings
in here and here the opening swings out into the hall. So,
it's difficult to set a bed up.
MR. MARTIN: I sometimes feel that the salesmen from the
pre-fabricated companies should be more concerned with their
clients. I even discovered 'there were no shelves for linens.
MR. JOHN TALBOT: You probably make those suggestions to
your clients and they do not abide by them. It seems a shame
that people sacrifice their safety. It's a fairly expensive
house.
MR. MARTIN: It's a $65,000 home without land. I think they
purchased it three or four years ago. When they came to
me they would not allow me to do their final painting because
it is so expensive. I have been in this business for 24 years
so I know you have to work with what their wishes are. Even if
your personal feeling is not the same.
MR. FRANK LEKICH: Is most of your lumber pre-cut?

MR. MARTIN: Yes, except the inside partitions. This
house is over-built, there is a lot of wasted material.
THE CHAIRMAN: Does the Board have any
to ask Mr. Martin? If not, we will discuss

house to any extent if those two closets were removed?
MR. MARTIN: They have two small children and it seems
that these were to be their bedrooms when they became old
enough to use these rooms. These materials, as far as the
basic structure is concerned, could be removed but it
would not serve their purpose. We have a loft up there
that is very large. We have a very small bedroom which they
want to use as a TV room or Printing Room which could have
been left wide open. By removing this wall it would become
only one bedroom. They wanted two separate bedrooms.

we were there.
MR. FISHER: At the time, I figured we had two legal sized
rooms and enough windows.
MR. LEKICH: They did not take into consideration that
these closets were going in there.
After investigation and inspection the findings of the
Board are that the measurements of the two bedrooms were taken
before the closets were installed and, at a later inspection,
the bedrooms were found to be undersized after the close[s had
been installed. The Board finds that due to the cathedral
ceilings in each bedroom, there is very much more cubic footage
in each room than a standard room would require. Therefore,
the Board finds that granting the variance would be justified.

On a motion regularly made and carried, it was
RESOLVED, G. & M. Consqruction Corporation, East Hampton,
New York, as general contractor for Gianfranco and Eugenia
Monacelli, the owners of property~at Orient, New York,
known as Lot No. 2 on a certain subdivision map entitled
"Peqty's Bight", be GRANTED a variance, as applied for.

on September 22, 1975.

In the Matter of the Appeal of G AND M
CONSTI~UCTION COt~POI~ATION.
: REQUEST FOR
VARIANCE
TO THE BOARD OF HOUSING APPEALS OF THE TOWN OF SOUTHOLD:
1. That appellant, G and 1VI Construction Corp. of East Hampton, New York
is the general contractor for Gianfranco and Eugenia Monacelli, the owners of
property at Orient, New York, known as Lot No. 2 on a certain subdivision map
entitled "Perry's Bight".
2. That appellant hereby requests that the Housing Board of Appeals grant a
variance to the provisions of Section 52-22 A (1) of the Housing Code of the Town of
Southold pursuant io the provisions of Section 52-103 of said code for the reasons
hereinafter set forth.
3. That heretofore appellant, on behalf of the owners of the above mentioned
lot, applied to the Building Inspector of the Town of Southold for a building permit to
construct a dwelling on said premises. That in conjunction therewith, appellant
filed with the Building Deparlrnent plans and specifications for said,dwelling which
consisted of a partially prefabricated dwelling manufactured by Boise Cascade of
Livingston, Massachusetts. That said plans and specifications were prepared by
Boise Cascade.
4. That upon the issuance of lhe building permit, the Building Inspector noted
on the plans that two of the three bedrooms were "undersized".
5. That after the main structure was erected and before partitions were
installed, appellant and one of the ]Building Inspectors rneasured the bedrooms in
question and concluded that the floor area of each bedroom exceeded eighty (80)
square feet and that accordingly they complied with the provisions of the Housing
Code. Since the Buildin~ Inspector at the site and appellant both believed that the
original notation on the plans resulted from an erroneous computation of the floor
areas, appellant was advised by the t~uilding Inspector at the site to proceed with
construction.
8. That construction was substantially completed on or about September 1,
1975 and on September 5, 1975, appellant applied to the ]Building Inspector for a
Certificate of Occupancy.
7. On September §, 1975, one of the Building Inspectors inspected the dwelling
and advised appe~llant that the two bedroo~ns in question did not comply with the
Itousing Code in that the floor area of each bedroom contained approximately
seventy-seven and one-third (77-1/3) square feet instead on the required eighty (80)
square feet.
8. That upon discovering this violation, both appellant and the ]~uilding
Department of the Town reviewed this matter in detail and have both concluded that
the violation came about by reason of the fact that the measurements were taken at
the site prior to the installation of the closet partitions in each bedroom and this
fact was not taken into account when said measurements v~ere made on the site.
9. That appellant does hereby urge that since such violation arose by a
mutual mistake by both appel].ant and the ]Building Department of the Town of Southold
and that to require the correction of such defect after the building has been com-
pleted, would entail substantial sums of money thereby imposing an extreme
hardship on the owners of the premises. Appellant further states that the variation
in floor area amounts to less than three (3) square feet which results in the bedrooms
in question having a floor area of less than four (4~0) percent of the required eighty
(80) square feet.
10. Appellant respectfully submits that the granting of the variance requested
herein will not adversely affect the public health and safety of the Town of Southold.
WHEREFORE, appellant respectfully requests that the Board of Housing
Appeals of the Town of Southold grant the variance requested herein.
