WORK SESSION
Present: Supervisor Francis J. Murphy, Councilman Joseph L. Townsend,
Jr., Justice Raymond W. Edwards, Councilman Paul Stoutenburgh, Councilman
James A. Schondebare, Town Clerk Judith T. Terry, Superintendent of High-
ways Raymond C. Dean, Town Attorney Robert W. Tasker.
9:00 A.M. - Supervisor Murphy apprised the new Councilmen of the on.qoin,q
Town projectsf budqet methods, problems facinq the Town --The question
the vacant' Councilman seat was brouqht forward by Supervisor Murphy with
the proposal of the names of William Grigonis, William Pell. He said he had
spoken with Joseph Sawicki St. who was not interested. Councilman Townsend
proposed the names of Louis Demarest and James Homan. The Board members
could not agree on one individual, and Councilman Townsend proposed that
special election be held on Presidential Primary Day April 3rd to decide the
question.--The problem of the backloq in the Office of the Planning Board was
discussed and the Board will invite Chairman Henry Raynor to the January 17th
work session to discuss his views.--The question of the Deouty Commissioner
of Public Works' position was discussed. Councilman ToWnsend stated he has
received several job descriptions for similar type positions from the Suffolk
County Department of Civil Service. They all must be reviewed and a single
job description written which may or may not be competitive. All of the Board
members agreed that such a position would be a possible long-range solution
for the landfill problem.--Councilman Stoutenburqh requested telephone credit
cards fOr the Councilman saying he resents using his Personal telephone for
Town business. Councilman Townsend agreed this can be a problem. Super-
visor Murphy will look into obtain the cards.--Councilman Stoutenburgh also
asked :where the Town is on the landfill compliance. Supervisor Murphy
stated that Holzmacher, McLendon & Murrell is workinq on this and will have
an engineering proposal for a Town Board resolution (~n January 17th.--Mr.
Stouqenburqh questioned Superintendent of Highways Dean on the severe.
water drainage problem at the end of Skunk Lane. Mr. Dean said the only
possib!e solution would be through a capital project as the money is not in
the budget and such a project would cost many thousands of dollars.

ORGANIZATIONAL MEETING
The 1984 Organizational Meeting of the Southold Town Board was .held at
3:00 P.M., Tuesday, January 3, 1984 at the Southold Town Hall, Main Road,
Southoid, New York. Supervisor Murphy opened the meeting with the Pledge
of Allegiance to the Flag.

SUPERVISOR MURPHY: As my first official meeting as the new Supervisor, 1
would like to thank everybody for Ihe opportunity and look forward to working
with this new Town Board. We have a lot of things to solve and I think if we
all work together we could do a pretty good job for the Town.

WHEREAS, WILLIAM R. PELL, Illf a most esteemed member of the Southold Town
Board, retired for public service on December 31, 1983, and
WHEREAS, WILLIAM R. PELL, I!1 has given generously of his time and talents
in his faithful service to the Town of Suthold residents as Supervisor since Jan-
uary 1, 1980, and as Councilman from January 1, 1978 to December 31w 1979, and
WHEREAS, his record of fine service, diligence to duty and dedication to the
Town of Southold and its people deserves the sincere gratitude of those with
whom and for whom he served, and
WHEREAS, the Town of Southold will be deprived of his wise counsel and
judgment as Supervisor of the Town of SOuthold, now, therefore, be it
RESOLVED that the Town of Southold hereby expresses its most sincere
appreciation to WILLIAM R. PELL, Iii for his unselfish and wholehearted
cooperation and untiring efforts on behalf of the Town, and extend their
best wishes for the years ahead, and be it further
RESOLVED that a copy of this resolution be presented to MR. PELL, and ~
entered in the permanent record of this Town Board meeting.

in his faithful service to the Town of Southold residents as a Councilman
since July 24, 1979, and as a Town Trustee from January 1, 1978 to July
23, 1979, and
WHEREAS, his record of fine service, diligence to duty and dedication to the
Town of Southold and its people deserves the sincere gratitude of those:with
whom and for whom he served, and
WHEREAS, the Town of Southold will be deprived of his wise counsel and
judgment as a member of the Southold Town Board, now, therefore, be it
RESOLVED that the Town of Southold hereby expresses its most sincere
appreciation to JOHN J. NICKLES for his unselfish and wholehearted coopera~-
tion and untiring efforts on behalf of the Town, and extend their best w~shes

SUPERVISOR MURPHY: In this meeting there is only resolutions and
appointments as the only order of business. There is another meeting
tonight at 7:30.
1. Supervisor Murphy appointed William R. Pell, I11 Deputy Supervisor of the

WHEREAS, it is required by Section 27,Subdivision I of the Town Law that the
Town Board fix, from time to time, the salaries of all officers and employees of
the Town, whether elected or appointed, and determine when the same shall be
payable, now, therefore, be it
RESOLVED that the annual salary of William R. Pell, !11, Deputy Supervisor of
the Town of Southold, be and hereby is set at $1,760.00 per annum effective
January 1, 1984, and the same shall be paid in regular semi-monthly payments.

Moved by Justice Edwards, seconded by Councilman Stoutenburgh,
WHEREAS, Section 64 of the Town Law requires the Town Board to designate,
by resolution, banks in the State in which the Supervisor or any other officer
of the Town shall deposit ali moneys coming into their hands by virtue of their
offices, and
WHEREAS, the Town Board may require any bank, so designated, to deposit
with such Board bonds or certificates of the United States, of the State of
New York, or any county, town, city, village or school district of the State
of New York, as security for such funds so deposited, but such bond or
certificate shall be subject to the approval of the Town Board and shall be
deposited in such place and held under such conditions as the Town Board
may determine, now, therefore, be it
RESOLVED that the following banks are hereby designated as depositories
and the following amounts of securities are hereby required, to wit:

all checks, drafts and other instruments for payment of money drawn upon
the accounts of the Town of Southold by Francis J. Murphy, Supervisor,

RESOLVED that The Long Island Traveler-Watchman, Southold, New York, a
newspaper regularly published in the Town of Southold, which has been entered
as a second class mail matter, be and the same is hereby designated, effective
February 1, 1984, as the official newspaper of the Town of Southold for the
publication of all notices, resolutions, ordinances and other matter required to
be published.

Moved by Supervisor Murphy, seconded by Justice Edwards, it was
RESOLVED that pursuant to Section 142(1-A) of the Highway Law, the Southold
Town Superintendent of Highways be and hereby is authorized to purchase
equipment, tools, snow plows and other implements and devices without prior
approval of the Town Board in the amount not to exceed $3,000.00 for any
one item during the period from January 1, 1984 through December 31, 1984.

Moved by Councilman Schondebare, seconded by Justice Edwards, it was
RESOLVED that Supervisor Francis J. Murphy be and he hereby is desigr~ated
to represent the Town of Southold at the annual meeting of the Association of
Towns of the State of New York, to be held in New York City on February 19,
20, 21, 22, 1984, and to cast the vote of the aforesaid Town of Southold
pursuant to Section 6 of Article Ill of the Constitution and By-Laws of said
Association of Towns, and be it further
RESOLVED that Ra--~nond W. Edwards be and he hereby is designated to act
as an alternate to cast the vote of the Town of Southold at the annual meet-
ing of the Association of Towns in the absence of Supervisor Francis J. Murphy.

RESOLVED that those officers and employees of the Town of Southold attending
the annual meeting of the Association of Towns of the State of New York be
and hereby are allowed $350.00 per officer and employee for the actual and
necessary expenses to travel, meals, and lodging incurred while attending said
meeting.

Moved by Justice Edwards, seconded by Councilman Stoutenburgh, it was
RESOLVED that any Town official, elected or appointed, who is required
to use his own automobile in the performance of his duty, be compensated
for travel expenses necessarily and actually incurred in carrying out the
duties of his office, at a rate not to exceed twenty ($.20) cents per mile.

Moved by Councilman Schondebare, seconded by Justice Edwards,
WHEREAS, Section 123 of the Town Law provides that town officials and
employees who receive and disburse moneys of the Town shall on or before
January 20th account to the Town Board for all moneys received and dis-
bursed by them in the previous fiscal year, unless the Town shall engage
the services of a certified public accountant or public accountant prior to
January 20th, and
WHEREAS, the Town Board deems it necessary to engage a public accountant
to prepare the aforesaid annual account for all Town officers and employees,
now, therefore, be it
RESOLVED that the Town Board of the Town of Southold engage the services
of Elaine F. Kaldor, C.P.A., P.C. to make the annual audit of the books and
records of officers and employees of the Town of Southold for the fiscal year
1983 at a contract fee of $3,000.00 for the Town audit, and $1,400.00 for the
~3rant Programs audit; said audit to be completed within 60 days after the
close of the 1983 fiscal year.

WHEREAS, Section 11 of the General Municipal Law provides that the Town
Board may authorize the Supervisor, the chief fiscal officer of the Town, to
invest moneys not required for immediate expenditure, now, therefore, be it
RESOLVED that the Supervisor is hereby authorized to deposit or invest
moneys not required for immediate expenditure in special time deposit accounts,
or certificates of deposit issued by a bank or trust company located and author-
ized to do business in this state, provided, however, that such time deposi.t

accounts or certificates of deposit shall be payable within such time as the
proceeds shall be needed to meet expenditures for which such moneys were
obtained, and provided further that such time deposit accounts or certificates
of deposit be secured in the manner provided in Section 11 of the General
Municipal Law.

WHEREAS, it is required by Section 27, Subdivision I of the Town Law that
the Town Board fix, from time to time, the salaries of all officers and employees
of the Town, whether elected or appointed, and determine whent he same shall
be payable and that the salaries of the members of the Town Board, the elected
Town Clerk and an elected Superintendent of Highways shall not be fixed in an
amount in excess of the amounts respectively specified in the notice of hearing
in the preliminary budget published pursuant to Section 108 of the Town law,
now, therefore, be it

WHEREAS, Section 22B of the Town Law allows the Town Board of any town
having more than one assessor to establish the office of Chairman of the Town
Assessors, who, in addition to his regular duties, Shall perform such services
in connection with assessment and taxation of property for state, county and
town purposes as the Board shall direct, now, therefore, be it
RESOLVED that Assessor~Charles £. Watts, be and he hereby is designated to
hold the office of Chairman of the Board of Assessors until the first day of
January next succeeding such designation, at the pleasure of the Town Board,
all in accordance with Section 22B of the Town Law, and be it further
RESOLVED that the compensation for such appointment be fixed at $If000~0C
per annum, payable in regular semi-monthly payments.

the calendar year 1984~ and be it further
RESOLVED that the Chairman of the Southold Town Planning Board be paid
a salary of $2,000.00, effective as of January 1, 1984, and the same shall be
paid in regular semi-monthly payments.

RESOLVED that pursuant to Section 267(1) of the Town Law, Gerard P.
Goehringer is hereby designated Chairman of the Southold Town Board of
Appeals for the calendar year 1984, and be it further
RESOLVED that the Chairman of the Southold Town Board of Appeals be paid
a salary of $2,000.00 effective as of January 1, 1984, and the same shall be
paid in regular semi-monthly payments.

COUNCILMAN STOUTENBURGH: I would like to hold this for one meeting,
and therefore i'm going to have to say no on this until I find out the amounts
of moneys in the various departments that are available for lawyer fees and
what t:he amounts of moneys that were allocated for legal fees and I would then
be able to make a much clearer decision at our next Town Board meeting, so
I am voting no on this.

SUPERVISOR MURPHY: On the appointments of committees, we had a discussion
on a replacement of my vacant Councilman seat today and it doesn't appear that
it's going to be filled in the. near future. We will ask the Governor for a special
election. ! understand there is one tentatively scheduled in April and if we
could get that on to fill my vacancy.
COUNCILMAN TOWNSEND: Frank, are we going to put that on tonight's
agendaf a resolution requesting you to request the Governor?
COUNCILMAN STOUTENBURGH: No, it doesn't have to be done now.

SUPERVISOR MURPHY: The only two committees that I will set up right now,
and because we do have to act, is the Police Committee, and it will consist
of myself as Chairman, Jay Schondebare and Joe Townsend. The other one
is Disposal Area and that will be Paul Stoutenburclh, Joe Townsend (Chairman)
and myself, along with the Highway Superintendent Ray Dean, Commissioner of
Public Works also~-hold-over.

the same way, maybe to enlarge the committees a little bit, make it easier
for the Councilmen to work with different groups, and have a Councilman
assigned to various special groups, similar to the Water Management Study,
Farmland Preservation are two just off the top of my head~--With that is
the end of the prepared agenda for our Organizational Meeting. I would
like to, being that we do have some visitors here, to ask anyone if they
have any comments they would like to make? Yes, sir.
MR. PHIL BARTH, Southold: I just want to ask a question of the Attorney.
Since we only have five on the Board now, why do we have to have a four
majority? Because you'll never get it.
TOWN ATTORNEY TASKER: But that's what the law is. You need a majority
of the entire whole Board, with no absentees, no vacancies and no disabilities.
That's the law. I don't make the law.
MR. BARTH: That's why I wanted to ask, because I can see until April we're
going to have a lot of fun here.
