SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 26, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject 22,250 square feet irregularly shaped parcel, with three road frontages, located in the R-40 Zoning District measures 126.23 feet along Navy Street,then runs 133.09 feet along Bay Avenue, then runs east 125.98 feet along a residential neighbor and turns north 85.60 feet along the same neighbor to 52.49 feet along Willow Street with an eastern lot line of 207,70 feet along a second residential neighbor. The property is developed with a one and one half story,wood-frame single family residence with wood front stoop and steps, an enclosed porch, slate patio, accessory detached garage with stone driveway and stone garden wall as shown on the site survey prepared by John C.Ehlers Land Surveyor,dated February 22,2018. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-15 and the Building Inspector's February 27, 2018, Amended March 20, 2018 Notice of Disapproval based on an application for a building permit to construct an accessory shed; at; 1) located in other than the code required rear yard; located at: 2395 Village Lane, Orient,NY. SCTM#1000-26-1-12.1. RELIEF REQUESTED: The applicant requests a variance to construct and place an accessory garden shed of approximately 120 square feet in size and measuring 10 feet by 12 feet,with a traditional pitched roof, in the front yard where such accessory structures are required to be located in the rear yard, ADDITIONAL INFORMATION: Prior relief was granted for this site under file#5218 dated April 17, 2003 for a minor subdivision. Review by Southold Town Landmarks Preservation Commission requests the accessory shed to be located, as applied for, on the west side of the Willow Street access to the residence. A Certificate of Appropriateness, endorsed by them, is required to be issued prior to the Building Department issuing the Building Permit. An immediate neighbor to the north, living opposite the Willow Street site access, spoke against the Page 2, June 21,2018 #7172, Lewis SCTM No. 1000-26-1-12.1 placement of the shed as applied for, requesting that the shed be placed on the opposite side of the access along the eastern lot line between existing evergreen landscaping,thereby screening her view of the shed from her residence. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 7,2018 at which time written and oral evidence were presented, Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. _Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Orient Village and the homes surrounding the applicant's property was developed well over two centuries before current Zoning was put into place. The immediate neighborhood is made up of homes of varying sizes and scale, architectural design, roof pitch and lot size and coverage, many of which have accessory structures including several in front or side yards which the current Code does not allow. The subject property has three road frontages making it among the most unique in the immediate area. The addition of a customary accessory garden shed to a primary residence is common among all homes in Southold Town and many in the Village of Orient. The location applied for, as approved by the Town of Southold Landmarks Preservation Commission strived to place the accessory shed in a position compatible with the neighbor to the west's accessory structures. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Challenged with three road frontages and three front yards it is impossible to place the accessory shed in a Code compliant rear yard. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the Town of Southold Landmarks Preservation Commission approved the siting of the shed, as applied for, and as a result of the triple front yards does not have a Code compliant location to place the accessory structure. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The chosen placement of the shed is consistent with various shed locations of the surrounding properties. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created, The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garden shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Dantes, and duly carried, to GRANT the variance as applied for, and shown on the survey prepared by John C. Ehlers, Land Surveyor, dated February 22, 2018. - a Page 3, June 21,2018 #7172, Lewis SCTM No. 1000-26-1-12.1 Any deviation from the survey, site plan andlor architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms.
