TERMS AND CONDITIONS The Permittee James &Linda Gemmill residing at 6004 Indian Neck Lane Peconic, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Herrmann En-Consultants 1319 North Sea Road Southampton, NY 11968 RE: JAMES & LINDA GEMMILL 6004 INDIAN NECK LANE, PECONIC SCTM# 1000-98-5-18 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, October 19, 2022 regarding the above matter: WHEREAS, En-Consultants on behalf of JAMES & LINDA GEMMILL applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 20, 2022, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the proposed action be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the as-built 11'x19.7' section of deck to remain, be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program Policy to the greatest extent possible through the imposition of the following Best Management Practice requirements: current permit is replicating a similar permit previously issued by Trustees; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 19, 2022, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of the JAMES & LINDA GEMMILL to remove existing 16' x 20' wood deck and embankment stairs with two landings; construct a 10' x 20' grade-level masonry patio and a new embankment stairway, consisting of a 4' x 8' top landing with two entry steps from patio, 4' x 12'-6" stairs, a 4' x 8' middle landing, and 4' x 9'-2" stairs to existing 11' x +36' deck; remove easterly 11' x 16' portion of existing 11' x +36' deck, and shift existing 8' x 12' shed approximately 36" west on westerly 11' x 19.7' section of deck to remain; replace and relocate existing 4' x 6' steps to beach off bulkhead; and establish a 10' wide non-turf buffer landward of top of bank; all as depicted on the site plan prepared by Richard C. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the LWRP. The existing as-built 11' x 19.7 section of deck to remain is recommended as INCONSISTENT with the below-listed policies: Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees Caws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permitconditions The as-built deck and shed structures were constructed without a Wetlands Permit. The 11' x 16' on-grade platform/deck does not comply with the following Town Code section: §275-11. Construction and operation standards, (6) Platforms I [Amended 10-11-2005 by L.L. No. 17-2005; 10-9-2012 by L.L. No. 12-2012] (a) Platforms associated with stairs may not be larger than 100 square feet. [Amended 1-29-2013 by L.L. No. 1-2013] (b) Platforms may not exceed 200 square feet and must be landward of the top of bluff. The platform associated with stairs with as built shed is located seaward of the top of bank equals 216.7 square feet and does not comply with above regulations. There are no vegetated wetlands located on or adjacent to the site,and the project will not cause any adverse impacts to the adjacent beach,shoreline,or tidal waters of Peconic Bay.
