TERMS AND CONDITIONS
The Permittee Karnick&Haci Garipian,residing at 54715 North Rd., Southold, as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to'the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant,request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board. .
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation,the said Permittee will be
required,upon due notice,to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety(90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion'of the work
authorized.
10. That the Permittee will obtain all other permits and consents thatiiay be required
supplemental to this permit,which may be subject to revoke uponAilure to obtain same.

Dear Ms. McGivney:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., November 15, 2006 regarding the above matter:
WHEREAS, Julie M. McGivney, Esq. on behalf of KARNICK & HACI GARIPIAN
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated September 26, 2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the Board of Trustees has furthered Policy 6 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the installation of gutters and
drywelis to contain the roof run-off, a line of staked hay bales in place during
construction, and a 10' non-turf buffer along the top-of the bulkhead, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on November 15, 2006, at which time all interested persons were given an
opportunity to be heard,.and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of KARNICK & HACI
GARMAN to replace, in-place, the existing bulkhead with vinyl sheathing and helix
anchors, dismantle the dilapidated steps to beach, cap off the unused clay drain hole
leading to the beach, remove existing portion of deck landing seaward of the bulkhead,
and plant a 10' non-turf buffer east of deck along the top of the bulkhead. Remove
existing enclosed porch and renovate and enlarge the existing dwelling, replace the
existing foundation, if required, and a new sanitary system, if required, and all with the
condition gutters and drywells are installed to contain the roof run-off and a line of
staked hay bales is placed down prior to construction.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

Dear Mr. Garipian:
Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that:
The property landward of the "Top of Bluff' line at about elevation 19, as shown on the survey
prepared by Destin Graf dated 5/25/06, is beyond Article 25 (Tidal Wetland)jurisdiction.
Therefore,in accordance with the current Tidal Wetlands Land Use Regulations(6NYCRR Part 66 1)
no permit is required under the Tidal Wetlands Act. Please be advised, however, that no
construction,sedimentation,or disturbance of any kind may take place seaward of the tidal wetlands
jurisdictional boundary,as indicated above,without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance
to the ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your
project. Such precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence,barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of the responsi ity of obtaining a y
necessary permits or approvals from other agencies. a

plant a 10'non-turf buffer east of deck along the top of the bulkhead.Remove existing enclosed porch and renovate
and enlarge the existing dwelling,install drywells and new sanitary system,if required.Located: 54715 North Rd.,

The proposed action has been reviewed to Chapter 268,Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the
information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the
records available to me,it is my recommendation that the proposed action is INCONSISTENT with the denoted
following Policy Standards and therefore is INCONSISTENT with the LWRP.
Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee-regulations and recommendations as set forth in Trustee permit
conditions.
The proposed distance of the 1" story of the residence is proposed at 9.1' from a ton of bluff; a minimum
setback distance of 100 feet is required pursuant to Chapter § 275-3. Findings; purpose; jurisdiction;
setbacks. Please require that the applicant amend the application to meet the above policy.
Pursuant to Chapter 268,the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

Applicant is seeking a Coastal Erosion Permit for the following proposed work:
1. In place replacement of existing;bulkhead or repair of same;
2. Dismantlingof f dilapidated steps to beach and replanting in their place;
3. Cap off unused clay drain hole leading to beach;
4. Remove portion of existing landing on steps to beach which is seaward of the
bulkhead by pproximately three feet. Applicant will replace railing with appropriate
materials;
5. Plant a ten foot nonturf buffer which will run east of existing wood deck along the
top of the bluff; and
6. Removal of enclosed porch in which the CEHA runs through
Applicant also seeks a Wetlands Permit for the following proposed work:
1. In place replacement of existing;bulkhead or repair of same;
2. Renovate and enlarge existing house within the proposed building envelope with
installation of dry wells;
3. Repair existing decking with either pervious material or pavers. If pavers are selected,
the applicant will ensure the runoff is lead into the new dr w
4. The applicant requests a location less than 100 feet from the top of the bluff for the new
septic system, if required by the Suffolk County Board of Health; and;
5. Foundation permit, if required by the Southold Town Building Department.
During; the construction, the applicant will use hay bales or other requested erosion control
structures and plant all necessaryyplantings to mitigate any potential erosion or runoff.

Board of Trustees Application
WETLAND/TRUSTEE LANDS APPLICATION DATA
Purpose of the proposed operations: To update the existing bulkhead by in place replacement
or repair of same and renovate and enlarge the existing` house within the proposed building
envelope and include possible foundation work. Additionally, the applicant seeks to install
drywells for runoff and if necessary, install new sanitary system as far as the bluff possible
without encroaching on the neighboring well area. The purpose of this project is to make the
bulkhead stronger and to rebuild an environmentally and energy efficient house which will not
only be environmentally friendly and compliant with current codes but will also be completely
landward of the existing structure away from the bluff in an attempt to be more compliant with
the Trustees requirements.
Area of wetlands on lot: 0 square feet as the high water mark is the rear,yard.
Percent coverage of lot: approximately 10%
Closest distance between nearest existing structure and upland edge of wetlands: 9.5feet
from the top of the bluff to the westerly portion of the one family. The existing wood
deck/platform borders the top of the bluff.
Closest distance between nearest PROPOSED structure and upland edge of wetlands:
Same. Any additional structures will be landward of existing structure and in conformi, with
homes on either side.

The effect will be wholly positive. The current rundown structure will be renovated and
enlarged. The additional structure will be constructed further from the bluff and landward of the
Coastal Erosion Hazard Area The applicant proposes to additionally do an in place replacement
of the bulkhead or repair of same This application is made in attempt to rebuild enlarge and
update the existing house and to in place replace the bulkhead all to delicately balance the
environmental concerns of shoreline property as well as to build an environmentally and energy
efficient house which enables the owners to enjoy the coastline that they have enjoyed for over 20
ears.

COASTAL EROSION APPLICATION DATA
Purpose of proposed activity: Applicant seeks to obtain a permit to do an in place replacement
of the bulkhead or repair of same,to dismantle the dilapidated stairway to beach and replant in its
location,to cap off the unused clay drain,remove portion of deck landing which is seaward of the
bulkhead and install railing with untreated lumber or other permissible material. The applicant
also seeks to replace the existingdecking, landing and steps with a pervious material. If the
applicant seeks pavers for the decking, a plan for the runoff into the new dWyells will be
submitted. The applicant will also plant a 10 foot nonturf buffer east of the existing wood deck.
Additionally, the applicant seeks to demolish the existing enclosed porch to keep all structures
out of the Coastal Erosion Hazard Area.

The nature and extent of the environmental impacts reasonably anticipated in requesting the
Coastal Erosion Permit will also be wholly positive. The existing wood deck with steps appear
structurally sound and have been in existence for years but the owner seeks to either replace
them with a pervious material or pavers with leaders into drywells The bulkhead will be in place
replaced or repaired to bringer to current standards and safety for the homeowner and
environment. The owner is removing the existing portion of the house which the Coastal Erosion
Hazard Area runs through and then regrading and reseeding. A 10 foot nonturf buffer
will be added east of the existingd_ecking. All these changes are a benefit to the
environment as well as the homeowner in that the owner is seeking to comply with the
current standards of environmental safety and sqfqty of his property and family.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
malting a determination of consistency. *E.xcept,,ninon exempt actions including,Building Permits
and other ministerial permits not located 1Vithh7 the Coastal Lrosio Z Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town Of Southold .Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Towyn).
3. If any question in Section C on this form is answered "yes",then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency.review law.
Thus, the action should be analyzed in more detail and; if necessary, modified prior to makino a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.

There will be measures taken to ensure that no erosion or runoff is caused due to the
construction and the proposed renovation. Also included in the work is the repair of existing
bulkhead, decking and bluff area. The work will also ensure the project minimally affects the

added. The enclosed porch will be removed, taking it out of the CEHA. The bulldiead will be

LWRP- LANDSCAPING/ACTIVITIES NEAR COASTAL
ZONE MANAGEMENT AREA
Pursuant to the attached Map,the proposal seeks to minimally affect the Coastal Zone. The
existing wood deck will remain but will be replaced with a pervious material or,if pavers are
selected,then they will be attached to the new drywells to be installed. The concrete platform
will either remain or pavers will be used with the drywells. The enclosed porch will be
demolished.The area of the enclosed porch will be regraded. A ten foot nonturf buffer will be
added at the top of the bluff east of the wood deck. The unused staircase will be dismantled and
vegetative plantings will be placed in that location.
Additionally,the only landscaping will be adding plantings,regrading and reseeding.
