A. This application must be filled in typewriter OR ink, and submitted in DUPLICATE to the Building
inspector with the following; for new buildings or new Use:
1. Final survey of property with accurate location of all buildings, property lines, streets, end
unusual natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposol--(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and
installations, a certificate of Code compliance from the Architect or Engineer responsible for
the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey.of property showing all property lines, streets, buildings and unusual natural
or topographic features.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent in-
formation required to prepare a certificate.

With reference to the above, Edward J. Acker, and
Southold Town Violation, this case was scheduled for a
disposition on 3/31/78 and in the meantime, Mr. Acker
telephoned my secretary and requested an adjournment
for April.
On March 15th a Court calendar was sent to you, as
Counsel, Mr. Acker, and Mr. Hindermann of the Building
Department for a conference on 4/14/78, today.
Is there a reason for your failure to answer the
calendar in this matter?

Count One: That Edward J. Acker maintains and uses in ground swimming
pool that is partially enclosed and will not complete said enclosure
as required by statute.
The {acts upon which this informatioa is based are as follows: On April 28, 1976 a
building permit, ~8553Z, was issued to Skinny Dip Pools, a/c
Edward J. Acker, to construct an inground swimming pool on said
premises. On Oct. 4, 1976 an application for a Certificate of
Occupancy was received by the Building Dep't., Town of Southold, N. Y.
An inspection of swimming pool was made by said dep't, and it was
f~und that enclosure did not meet requirements and C. O o could not be
issued. At this time Mr. Acker was notified that enclosure of pool wa~
not adequate. On Aug.29, 1977 complainant spoke to Mr. Acker on said
premises and he stated he did not intend to complete enclosure
