APPLICATION FOR CERTIFICATE OF OCCUPANCY
Instructions
A. This application must be filled in typewriter OR ink, and submitted in DUPLICATE to the Building
Inspector with the following; for new buildings or new use:
l. Final survey of property with accurate location of all buildings, property lines, streets, and
unusual natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal--(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and
installations, a certificate of Code compliance from the Architect ar Engineer responsible for
the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey.of property showing all property lines, streets, buildings and unusual natural
or topographic features.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code ar safety inspection of buildings or premises, or other pertinent
formation required to prepare a certificate.

MINUTES
November 1, 1976
A meeting of the Southold Town Hous.ing Board of Appeals
was held on Monday, November 1, 1976, at the Town Office, Main
Road, Southold, New York.
There were present: Mr. E. Kenneth Tabor, Chairman; Mr.
Frank A. Lekich; Mr. John J. Talbot; Mr. George Fisher, Building
Inspector; Mr. Anthony Brandi, owner of premises.
The meeting of the Housing Board of Appeals was called to
order at 7:00 P.M. (E.S.T.) for the purpose of discussing the
violations existing on the premises of Mr. Anthony Brandi, Henry's
Lane, Peconic, New York.
The Building Inspector, in inspecting the construction of
a dwelling owned by Mr. Brandi, stated that violations exist in
window height above the floor in the bedrooms and window size in
the side bedroom.
Mr. Brandi stated that he realizes that an error was made
when he had the windows changed to a smaller size than those which
existed on the plans which were submitted to the Building Depart-
ment. Mr. Tabor explained the code and asked how much it would
cost to replace one window in each bedroom. To replace three win-
dows, it would cost $480.00 for material.
The problem exists because the contractor did not call for
a pipe inspection at which time the violation would have been
noticed, and because no changes to the plans were reported to the
Building Department. Mr. Brandi stated that all pipes are exposed
and he did not think an inspection was necessary. Mr. Tabor stated
that we are all aware that a violation exists, and that the Board
is trying to resolve this with as little expense as possible to
the owner.
Mr. Brandi offered to sign a waver which would exonerate the
Town of Southold from any responsibility should there be loss of
life due to a fire on the premises. Mr. Tabor stated that the Board

would feel personal responsibility should a life be lost. Mr.
Talbot read the paragraphs in the code pertaining to these vio-
lations. Mr. Brandi offered to install a smoke detector in the
hallway on th~ ceiling near the bedroom doorways.
The violation in the side bedroom with the window being too
small to provide adequate lighting and ventilation was discussed.
At this time, Mr. Brandi stated that he came to discuss this with
the Board and that he has stated his case and wished to be ex-
cused. Mr. Brandi was excused and the Board together with Mr.
Fisher discussed the case further. In further discussion, it was
determined by the Board that because of the number of exits from
%he dwelling, that the front bedrooms do not, in their opinion,
create violation.
The Board recommends to the Building Department that the
stamp which is stamped on the approved blueprints include the
statement that "All changes must be approved by the Building
Department."
(The following is to be included in a letter to Mr. Brandi.)
After considerable discussion by the Housing Board of Appeals,
it was determined that:
1. The Board requires that in order to comply with the
New York State Building Code and Southold Town Housing Code,
Chapter 52, Section 24, Paragraph C (1) (3), Mr. Brandi replace
the window in the side bedroom to the next larger size.

Upon completing the items in ~1 and 2 above, it was the

with the existing code.
