Instructions
A, This application must be filled in typewriter OR ink, and submitted in duplicate to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with accurate location of alt buildings, property ~ines, streets, and unusual
natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal-(S-9 form or equal),
3. Approval of electrical installation from Board of Fire UnderWriters,
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building,
5. Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-coniorming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of peoperty showing all property lines, streets, buildings and unusual natural or
topographic features.
2, Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent informa-
tion required to prepare a certificate.

ZONING BOARD OF,APPEALS
After investigation and inspection, the Board finds that the
applicant requests permission to construct swimming pool with in-
sufficient side yard and modification of fence requirements, Bay-
berry Road Ext., Cutchogue, New York. The findings of the Board
are that the Board is in agreement with the reasoning of the
applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.
THEREFORE IT WAS RESOLVED, Mrs. William J. Fleming, 109
Stewart Avenue, Garden City, New York, be GRANTED permission
to construct swimming, pool with insufficient side yard and
modification of fence requirements, Lot 119, Bayberry Road
Ext. (Pvt. Rd.), Nassau Point, Cutchogue, New York, as applied
for, subject to the following condition:
The southerly fence must Conform to the Ordinance.
The locking device on the. gate shall remain as is"'
as long as the present occupants use the house.

Dear Ed:
I want to thank you for your note of July llth concerning the
Certificate of Occupancy for Permit No. 8923 covering the swimming
pool at my Nassau Point home. After a lot of digging, I have found
the enclosed copy of the Fire Underwriters certificate dated April 27,
1977, which was submitted to your office in 1978, just after the
variance hearings.
I am also enclosing a check in the amount of $500 drawn to the
order of the Town of Southold as well as a copy of the application
for Certificate of Occupancy. I trust this will finish this up and
I would appreciate your mailing the Certificate of Occupancy to me at:
