WORK SESSION

9:00 A.M. - The Board audited outstanding vouchers.
EXECUTIVE SESSION
9:30 A.M. - Executive Administrator Victor Lessard met with the Board to discuss:
personnel matters; conflicts between the Building Department and Board of Appeals;
impending resignation of a Building Inspector; need to create a new position in the
Building Department; need for a new telephone system; and request for more space
for the Building Department.
WORK SESSION (continued}
10:20 A.M. - Merlon Wi99in, Peconic Associates, Inc., and Joseph Schoenstein met
with the Board to request consideration of a change in the proposed Master Plan
Zoning for the property of Mr. Schoenstein, owner of North Fork Welding, located
on the south side of Route 25, west of Pipes Neck Road, Greenport. The proposed
zoning is LB, would place Mr. Schoenstein's property in a non-conforming pre-exist-
ing use category, therefore LI or LIb is requested for this parcel. The present
zoning is B-1 and a use variance was granted in 1979 for a weld~ing and fabrication
shop, with the restriction that all work be done indoors. Mr. Schoenstein now wishes
to construct an additional building to accomodate his increased business.--It was
decided the Board would review the proposed zoning classification with the Planning
Board when they next meeting for a map,review on November 15th.
10:55 A.M. - For Discussion Items: (1) Determined to hold a public hearinq on the
Draft Environ~--~t~-[ ~ ~tat-~nt of Matt-A-Mar Marina at 8:00 P.M., TUesday,
December 3, 1985. (2) Expiration of terms of three members of the Housing Advisory
Committee. Councilwoman Cochran will discuss with Committee members what they see
as their direction for the future. (3) Request veteran orqanizations to submit their
1986 recommendations for candidates to the Council on Veterans Affairs. (4} Not
an item for discussion at this time--request of Rudolph H. Bruer, on behalf of Henry
J. Smith, for zoning district change on proposed updated zoning map. (5) Request
of William D. Moore, on behalf of Richard T. Cart/Shamrock Properties, Inc. for a
waiver under Local Law No. I4 - 1985 (see resolution No. 16).
EXECUTIVE SESSION
11:25 A.M. - (Discussion Item. 6) The Board reviewed the proposal of the Village
of Greenport with respect to the proposed 1986-1990 East-West Fire Protection District
Agreement.
WORK SESSION
11:35 A.M. - Thomas Thompson, proprietor of Fine Care Landscape, Inc., Bridge Lane,
Cutchogue, met with the Boardlto discuss the proposed zoning on a parcel-.,of property
he wishes to purchase from Isadore Krupski on Cox Lane, Cutchogue, for the relocation
of his landscaping business. 'l~he proposed zoning is Agricultural Conservation and a
landscaping business would require a LB zone. The Board will review this request with
the Planning Board at their No~ember 15th ~oning map review meeting.
12:05 P.M. - For Discussion Items continued: (7) Request of James and Mary Tyler
for a waiver under Local Law Nb. 14 - 1985 (see resolution No. 17). (10) Request
of Janet Geasa, on behalf of Joseph Crenshaw, for a waiver under Local Law No. 14 -
1985 to construct an office building at Route 25, Mattituck. The Board has questions
concerning this request, since Mr. Crenshaw presently has a masonry business at the
site in question and will request Ms. Geasa or Mr. Crenshaw to meet with the Board at
their November 19th work session.

Discussion Items: (8) Request of James L. Gray, Sr., on behalf of Pudge Corp. for
a waiver under Local Law No. 14 - 1985 (see resolution No. 19). (9) Request of
Leander B. Glover, Jr. for a waiver under Local Law No. 14 - 1985 for permission
to subdivide industrial property on the southerly side Oregon Road and westerly side
of Cox Lane, Cutchogue (see resolution No. 20]--Mr. Don Grim, a prospective purchaser
of one of the parcels, was in attendance during this discussion. (11) Request of
Margery Dickinson Burns for a waiver under Local Law No. 14 - 1985 (see reso~uti0n
N. 21).
2:50 P.M. - Recess.
3:00 P.M. - Public Hearin9 on the 1986 Prel!,minary Budget.
3:05 P.M. - Public Hearing on the 1986 Intended Use of Federal Revenue Sharing Funds.
3:10 P.M. - Public Hearing on the 1986 Community Development Year I2 Funds.
At the close of the above public hearings they were recessed to 7:45 P.M., 7:50 P.M.,
and 7:55 P.M. respectively.
3:25 P.M. - Work Session reconvened and the Board continued For Discussion Items:
(12) Memorandum from Community DeveloPment Administrator James McMahon relative
to request of the New York State Urban Development Corporation l~or pF0posals for
innovative .aquaculture programs.--To be further discussed at the November !9th
Board Work Session. (13) Letter from the Planning Board the John Simon Estate
Subdivision, Peconic, and propOsed Soundview Avenue Extension at the northerly
end of the property near Long -Island Sound. The Board will discuss this with the
Planning Board when they meet on November 15th.
3:45 P.M. - The Board reviewed regular meeting agenda resolutions.

I. REPORTS.
DEPUTY SUPERVISOR KUJAWSKI:

The~ reports for the month are:

4. Building Department's monthly report from Victor Lessard for October 1985.
5. Councilmen's reports. Would anyone like to say anything about their report?
COUNCILMAN SCHONDEBARE: Yes, thank you, Frank. There was a Code Committee
meeting on October 25th, 1985 at which time we were struggling with the problem of
landscapers and nurseries and the definitions pertaining to them and other what we
would call a "service business" being in an agricultural-residential area where they
should not be iocated. We also brought up the question with regards to inspection
fees and the fact that the inspection of Brecknock Hall and all the work contained
in that we received the magnificent sum of $100. So I think we're going to be chang-
ing some of the fees around to be more reflective of the cost as it affects the Town.
Also there is another Code Committee meeting 4:30 tomorrow afternoon, at which time
we will be dealing with the 75 foot and 100 foot setbacks from our wetlands and the
bluffs on the Long Island Sound and accessory uses contained therein, and also the
problem of foundations being placed on plots and surveys or surveys not being
conducted and iust to see that our Code is up to par and make sure that there's
nothing being omitted. Also it appears from reading Newsday today that the committee
who is siting or selecting a site for the ashfill dump or landfill, if they want to call
it that, has found their site evidentially, and I'm happy to say none of them are in
the Town of Southold. They appear to be in the Town of BrOokhaven, the Town of
Southampton, and perhaps the Town of East Hampton, and that's one less battle that
we have to get engaged in. Nothing else, thank you. Oh, congratulations to the
candidates who were renominated and re-elected. Congratulations to everyone who
ran and fought hard. Both sides.

COUNCILMAN TOWNSEND:
It's been a quiet 'couple of weeks for me. All but last
Tuesday. I attended Jay's Code Committee and the entire Town Board, i think,
attended the Map Review. We got the revised map back from RPPW. At this point
I think it's time we went probably and scheduled meetings. We're going to have one
more meeting and I'd like to set the dates at those times for the first meeting. That's
about all i have this week. I hope to get back into the grind of the Councilman's job
pretty soon. Take it away.

COUNCILWOMAN COCHRAN: I'd just like to report that I attended the Code Committee
on which Jay reported and the Zoninq Map Committee on which Joe reported. The
only other announcement I'd like to ~ake is that the Housinq Advisory Committee will
be meetin9 on November 21st, at 5:00 o'clock. That's it.

JUSTICE EDWARDS: Just that I'm glad the campaign is over and I can't wait to get
back to Fishers Island and get back to a normal life. It's fun living over here but
you can't beat home. Thank you.

COUNCILMAN SCHONDEBARE: Excuse me, Frank. I think one thing I forgot to do.
We set the date l~or the Economic Advisory Council to meet for the first time, which
is November 21st at' 7:30 in the Town Hall~
JUSTICE EDWARDS: Jay. Another thing about that resolution Number 26, should we
mention that about the Consolidate Report of the Airport meeting, should that be at
the Senior Citizen Center?
COUNCILMAN SCHONDEBARE: Oh, good for you, Ray. Yes, when we get to that
one--the last resolution that we set down for the informational hearing. Maybe we
ought tO put that down at the Peconic Youth Center.

Application from James N. Bailey to construct stone terraces, wooden decks, stair-
case, concrete retaining walls on face of existing cliff, construct walk, deck above
and below mean high water, attaching a hinged ramp and two floats, pave driveway
in the adjacent area to freshwater wetland, clear vegetation in and adjacent to fresh-
water wetland to allow unobstructed views of freshwater wetland, replant disturbed

12. N.Y.S. Depa!rtment of Environmental Conservation, Notice of Complete
Application from Harry Mitchell Family Corp. to reconstruct and straighen timber
bulkhead by filling-in~ 7,530 sq. ft. of littoral zone and excavating 6,720 sq. ft. of
upland to 8 ft. below mean Iow water, resultant dredge spoil shall be utilized as
backfill for new bulkhead, install floating docks and associated finger floats, install
waive curtain offshore end of proposed marina. Project located at 115 Front Street,
Greenport, Greenport Harbor. Comments by November 22, 1985.
III. COMMUNICATIONS.
DEPUTY SUPERVISOR KUJAWSKI: We have three communications.
1. From Millicent Hamburger, Secretary of the Brown's Hills Assocation, Orient:
"Dear Supervisor Murphy, The residents of Brown's Hills, Orient, thank you most
sincerely for your help during the recent hurricane. If it had not been for you we
would have been without help of the National Guard. They provided us with protection,
a generator for the pump so that we could have water, and the manpower to clear the
roads. Thank you for your assistance!. Sincerely, Millicent Hamburger, Sec."
2. The next one is a thank you again along the same vein from Adelaide F.
Silkworth, Director of the Office for the Agin~7, County of Suffolk.
3. The last one is a communication to Ray Dean and the Highway Department,
thanking them for their help also during Hurricane Gloria, from Lon~t Island Lighting
Company.
IV. PUBLIC HEARINGS.

RESOLVED that the Town Board of the Town of Southold hereby calls a recess of
their Regular Meeting at this time 7:45 P.M., to conduct the following public hearings:
7:45 P.M. - Reconvene public hearing on the 1986 Preliminary Budget.
7:50 P.M. - Reconvene public hearing on the 1986 Intended Use of Federal Revenue
Sharing Funds.
7:55 P.M. - Reconvene public hearing on the 1986 Community Development Year

V. RESOLUTIONS.
DEPUTY SUPERVISOR KUJAWSKI: I'd like to reconvene the regular meeting and
we can start off with Resolution No. 1.
1. Moved by Justice Edwards, seconded by Councilwoman Cochran, it was
RESOLVED that the Town Board of the Town of Southold hereby designated Martin
H. Garrell as the Conservation Advisory Council representative on the Lonq Island
Sound Study Citizen Advisory Committee, sponsored by the United States Environmental
Protection Agency, and authorizes the payment of mileage to Mr. Garrell for attendance
at meetinqs which have been conducted, or will be conducted in the future, and be it
further
RESOLVED that the Town Board hereby authorizes the payment of mileage to a Conserva-
tion Advisory Council member attendinq said meetings as a representative of Mr. Garrell.

DEPUTY SUPERVISOR KUJAWSKI: The second resolution is regarding an appointment
to the Southold Town Board of Assessment Review.
2. Moved by Councilwoman Cochran, seconded by Justice Edwards, it was
RESOLVED that the Town Board of the Town of Southold hereby appoints Carol A.
Bolger as a member or.the Southold Town Board of Assessment Review, to fill the
unexpired term of Andrew Pitre, effective November 7, 1985 through February 24, 1986.

Councilman Stoutenburgh, Justice Edwards, Councilman Townsend.

WHEREAS, the Town Board of the Town of Southold, by resolution dated August 14,
1984, declared itself lead agency in the matter of the application of Richard J. Cantwell
for a Wetlands Permit, and requested said applicant to complete a Lon9 Environmental
ASsessment Form, and
WHEREAS, Richard J. Cantwell has failed to submit said Long Environmental Assessment
Form, after a second request dated AuguSt 28, 1985, now, therefore, be it
RESOLVED that if the said Long Environmental Assessment Form is not received from
~the applicant by December 9, 1985, Wetland Application No. 207, by Richard J. Cantwell,
shall be deemed withdrawn, and all concerned agencies notified.

DEPUTY SUPERVISOR KUJAWSKI: Our next resolution is regarding a refund to
William Boylhart.
Moved by Councilman Schondebare, seconded by Councilwoman Cochran, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes the
refund of $75.00 to William Boylhart, who filed an appeal with the Board of Appeals
on October 21, 1985, and subsequently amended his building permit application~ there-
by eliminating the need for an appeal, which had not been processed ~o¥ the Board of
Appeals.

Councilman Stoutenburgh, Justice Edwards, Councilman Townsend.

DEPUTY SUPERVISOR KUJAWSKI: Next resolution is an appointment to the Assessor's
Office.
5. Moved by Councilman Townsend~ seconded by Councilman Schondebare, it was
RESOLVED that the Town Board of the Town of Southold hereby appoints Denise A.
Ross as Assessment Clerk in the Assessor's Office, from the Suffolk County Department
of Civil Service Certification of Eligibles List, effective November 16, 1985, at a salary
of $10,010.00 per annum.
5.-Vote of the Town Board: Ayes: Councilwoman Cochran, Councilman Schondebare,
Councilman Stoutenburgh, Justice Edwards, Councilman Townsend.
This resolution was declared duly ADOPTED.
DEPUTY SUPERVISOR KUJAWSKI: Number 6 we're going to hold until the Supervisor
returns and is able to shed some light (~agreement between the Town of Southold and
Town of Shelter Island for the police radio service). Number 7 would be to authorize
the Supervisor to e×e~ute an agreement between Howard Reinhart for the lease of a
building that has been leased for many years.

RESOLVED that the Town Board of the Town of Southold hereby authorizes and

directs Supervisor Francis J. Murphy to execute an agreement betwee~ Howard Re~nh~
Joseph Reinhart, and Ann Chadwick, for the lease of a forty foot by forty foot concri

directs Supervisor Francis J. Murphy to execute Change Order No. 2, under Contract
No. 1: General Construction and Mechanical Work, Southold Scavenger Waste Treatment
Facility, contractor: Ferran Concrete Co., Inc; This Change Order No. 2 is described
as follows:
(A) Providing of one (1) dump body. cover with hand crank for the sludge
transport vehicle.
(B) Change single hollow metal door in the digester building to double hollow
metal door, modify hardware and widen concrete doorway steps.
(C) Modify elevation of six-inch diameter process line and bypass line from
hydrochloric acid mixing tank to influent trough of rotating biological discs.
(D) Supply 550 gallons of No. 2 diesel fuel oil for the fuel oil storage tank.
Total net cost of Change Order No. 2 is $6,253.69, resulting in a total contract amount
change from $1,958,031.70 to $1,964,285.39, and has been reviewed by the Town's
Engineer Holzmacher, McLendon & Murrell, P.C., who find the change to be in order.

COUNCILMAN SCHONDEBARE: Just so everyone understands that we set the date
for this Airport Informational Hearing based on the response that we got from the
United States Department of Transportation, the Federal Aviation Administration,. by
their letter of October 24th, 19~5, which wa~ in response to our letter to them saying
please hurry up. Basically they say they need another 'month and then they'd
be done. We gave them a little more than a month in which we are going to set
the hearing. That letter is in the Town Clerk's Office for everyone to obtain a
copy.
COUNCILWOMAN COCHRAN: They will be notified by mail of our hearing date?
COUNCILMAN SCHONDEBARE: The FAA?'
COUNCILWOMAN COCHRAN: Yes.
COUNCILMAN SCHONDEBARE: Yes, we'll tell them too.
DAVID SPOHN: The question is, the resolution was "Informational Meeting" and
Jay was talking about "Hearing", so I just wanted to be sure which one it is.
COUNCILMAN SCHONDEBARE: if I said "Hearing" again, change it to "Informational
Meeting".
MR. SPOHN: Okay. And I would iust like to request that you give legal notice for
that at least two weeks ahead of that, okay?
TOWN CLERK TERRY: It will go in the paper next week, Dave. I can't get it in
the paper before next week, and it will be in next week.
MR. SPOHN: And that would be a legal notice in at least two weeks r that would be
good. Okay.
COUNCILMAN SCHONDEBARE: It would also be nice for the price of advertising,
that the two groups involved take out a little blub in the local paper, and pay for
a space of advertising advising the public of the same dates and make sure everybody
catches it. A lot of people don't read the legal notices as we always well hear.
MR. SPOHN: That was a sticky point where somebody was leaning on the legal notice
aspect. That's all. Thank you. I acknowledge that there will probably be a lot of
comment made before the occurance. I'm just covering the legal aspect of it, that's
