B. Neighbor is the owner of real property commonly known as known as 515 Moose
Trail, City of Cutchogue, NY, County of Suffolk, New York, more particularly
described in a deed dated 9/9/2016 recorded on 9/26/2016 in Liber 12881 page 352,
which adjoins the Owner's Property, ("Neighbor's Property"). S " -I-
There is a fence that lies between 4 feet West of the Owners Easterly line lying
within the boundaries of Owner's Property.
C. The parties wish to establish the common boundary line between Owner's Property '
and Neighbor's Property.
NOW THEREFORE, in consideration of the premises and mutual promises made in this
Agreement, and the sum of One Dollar($1.00) and other good and valuable consideration by
each of the parties to the other in hand paid, the receipt and sufficiency of which is hereby
acknowledged, the parties covenant and agree as follows:
1. The Neighbor hereby conveys, releases and quit claims unto the Owner and
Owner's successors and assigns forever all of Neighbor's right, title and interest in and to:
All lands lying West of the Owner's Easterly boundary line, which boundary line runs between
lots 10 and 11 shown on the survey.
2. Owner hereby conveys, releases and quit claims unto the Neighbor and Neighbor's
successors and assigns forever all of Owner's right, title and interest in and to:
All lands lying East of the Owner's Easterly boundary line, which boundary line runs between
lots 10 and 11 as shown on the survey.
3. The placement of the fence upon Owner's Property does not and shall never ripen
into nor become a right to use any portion of the Owner's Property by the Neighbor, but is and
shall continue to be only a use by sufferance of that portion of the Owner's Property.
4. The parties agree that this Agreement will inure to the benefit of the mortgagees,
current or future, of their respective Properties.
5. Owner's successors, including 25 Nicholas LLC, at their own expense and cost,
shall have the right to move the location of said fence, which has been inadvertently placed West
of Owner's Easterly Line as shown on the survey, to the common boundary line separating lots
10 and 11.
IT IS MUTUALLY COVENANTED AND AGREED by the parties that this Agreement
shall run with the land and inure to the benefit of and be binding upon the parties,their heirs,
distributees, legal representatives, successors and assigns_
IN WITNESS WHEREOF, this Agreement has been signed as of the date and year first
above written.
