We find that whatever nuisance may be caused to others by such uses and activities, so conducted, is more than offset by the benefits from farming to the community. (B)These activities can and do generate dust, smoke, noise, vibration and odor. These activities may occur on holidays, Sundays and weekends, at night and in the day. Such activities are presumed to be reasonable. Such activities do not constitute a nuisance unless the activity has a substantial adverse effect on the public health, safety and welfare. Chapter 9 of the Southold Town Comprehensive Plan is dedicated to agriculture, and it states, "Agriculture and related businesses are in the top five economic engines of our economy." The first goal of Chapter 9 is to "Retain and Advance the Industry of Agriculture." This proposed agricultural storage building meets the goal of retaining and advancing the industry of agriculture by providing needed storage infrastructure for the active vineyard on site. Farmers provide fresh food, clean air, economic diversity and aesthetic open spaces to all the citizens of our Town. In addition, land in agricultural uses requires less tax dollars for services than does land with residential or commercial development. Accordingly, farmers shall have the right to farm in Southold without undue interference from adjacent landowners or users. For the purpose of reducing future conflicts between people residing on tracts adjacent to farmlands and farmers, it is necessary to establish and give notice of the nature of the farming activities to future neighbors of farmland and farming activities. (B) Agricultural activities conducted on farmland, undertaken in compliance with applicable federal, state, county and Town laws, rules and regulations, are presumed to be good agricultural practices and presumed not to adversely affect the public health safety and welfare. We find that whatever nuisance may be caused to others by such uses and activities, so conducted, is more than offset by the benefits from farming to the community. Such activities are presumed to be reasonable. Such activities do not constitute a nuisance unless the activity has a substantial adverse effect on the public health, safety and welfare. Chapter 9 of the Southold Town Comprehensive Plan is dedicated to agriculture, and it states, "Agriculture and related businesses are in the top five economic engines of our economy." The first goal of Chapter 9 is to "Retain and Advance the 3 Industry of Agriculture." This proposed agricultural storage building meets the goal of retaining and advancing the industry of agriculture by providing needed storage infrastructure for the active vineyard on site. We are a 20 acre vineyard with 16.5 acres planted of Merlot, Cabernet Franc, Cabernet.Sauvignon, and Petit Verdot. manage the farm and produce over 50 tons of grapes every year. Most of our grapes are purchased by other vineyards and wineries throughout Long Island and New York State. The reason we want a barn on our farm is to store farm equipment. We own two large vineyard tractors and a smaller tractor. We have an air blast sprayer, a flail mower, a bush hog, hedgers, tractor implements, and many other tools like weed wackers, shovels, pruners, wrenches, hammers, etc... that we use on the farm. There are fungicides and pesticides that are also used on the vineyard that need proper storage and care. We have over 400 yellow plastic grape lugs that are used during harvest that need to be stored. We have ten 1 ton macro-bins that we use to transport our grapes for processing at Premium Wine Group. Presently, most of our equipment and supplies are exposed to the elements during the winter. We had mice eat the wiring in one of our tractors last year. Our sprayer which was left out on the farm had broken nozzles which evidently had been tampered with. A lot of our smaller tools have become rusted or missing. In order to do maintenance and repair, I have to lay on the grass and dirt to work on my tractors and farm equipment. There isn't a clean cement slab to work on like in a barn. I am left to work outside in the elements. I have had Lyme disease twice in the last couple of years. As you know, farming is a challenging business with rainy weather, insects and disease.
