I received the "final surveys" of your plot with houset
well and sewerage system shown from Chandler.?al~er & Xi~g~ and
forwarded them to the Suffolk County Health 'Dept. for' f[naX approval.
Today I received the enclosed letter fromCalvin S~ith~
He has been over there and checked the water line~ sewer line~
septic tank and leaching pools etc and has given verbal approval
to the system.
The well driller's certificate he mentions is a statement from
the person who drove the well point as to it's size (2~)~Ie~gth (30"
3ft or what ever it ~t) and the depth of water in the Pipe..
The cesspool certificate is a statement fro~ the installer
as to the size (capacity) of the septic ta~k and each of the leaching
pools~ connecting pipe diameter, and that there is a gravel back-
fill collar areond each leaching pool.

I have checked with Justice Doyen on Fishers Island, and
he tells me that nothing has been done on the road as of
Hr Zabohonski promised the road would be done this week,
I have called hi~t about thist he has ~ade arrainge~ents to ~s~ sole
of John Gada's Equipment, which at this time is broken down have
confirmed this through Gada's Office.
Justice Doyen is going to check Tuesday, it nothing is done,
we will bring an action in Justice Court to move it.

On June 13, 1974, around 2~00 P.M., Ed Hindermann and
I stopped to check construction on the south side of
Crescent Avenue (Private R.O.W.), Fishers Island, New York.
A hole had been dug and some footings poured. While
there, Mr. Dick Foyle stopped and said he was applying
for the Building Permit for Mr. Duff to build a house on
this parcel. There had been no building permit issued.
A Deed from Henry M. Zabohonski and Annette M.
Zabohonski to Thomas D. Duff, Jr. and Elaine G. Duff
recorded in Suffolk County, New York, Liber 7689, Page
141, describes this parcel.
On the same day, some members of the $outhold Town
Planning Board also visited this site.

The facts upon which this information is based are as follows:
Application for building permit was received from ~os Duff
on said private ro~d. Permit was denied on basis of lack of approved
access.
Appeals was ma4e to Board of Appeals who made conditional
approval~ ~ 19~3 Sapt 12~ 197~.
Permit was issued subject to access improvement and approval
proir to final certificate of occus~aney. Dwelling no~r is r~ady for
occupancy and access is not improv(;d or accep'~able.

I, Edward F. Hindermann, Deputy Building Inspector and
Housing Inspector, residing at 2?45 Vanston Road, Cutchogue,
New York, deposes and says that on Tuesday, August 13, 1974,
at approximately 2:00 in the afternoon, in the company of
George Fisher, Building Inspector, Town of Southold, did
visit property owned by Thomas D. and Elaine G. Duff, Jr.
The property, as recorded with the Clerk of Suffolk County
on August 6, 1974, Liber %7689, Page 141, is located on the
southerly side of R.O.W. known as Crescent Avenue, Fishers
Island, Town of Southold, Suffolk County, New York, and is
bounded north by Crescent Avenue; east by H. Zabohonski;
south by H. Zabohonski; and west by P. Nitre.
I saw the beginning of a foundation for a dwelling in
the form of footings which were completed. A short time
after we arrived on the premises a station wagon arrived
and the driver introduced himself to George Fisher and
myself as Dick Foyle, the contractor for the proposed dwelling
on this property. We instructed him in the form of · verbal
order not to proceed any further with this construction since
his application for a Building Permit had been disapproved.
He agreed he would not proceed any further until all the
regulations for a Building Permit,as required by The Town
of Southold, had been met since he did not want to be in-
volved in any complications.
Before visiting the Duff property I hand delivered an
envelope to Mr. Fred Grebe, member of the Planning Board,
which was addressed to Mr. Richard Foyle and contained a
letter of disapproval of application for Building Permit of
proposed dwelling for Thomas Duff on these premises, along
with the check for fee.
