Leif and I applied for a permit to put a 3 season room on the upper part of our back deck. It turns out
that when one of the previous owners needed a permit for the lower deck it required a variance
because it and the upper deck were too close to the property line. The upper deck was approved on
initial construction of the house. When the variance was granted for the lower deck,a restriction was
placed on the variance that said the entire deck had to remain open to the sky.
We are not removing any walls on our house and the room will not have heat or water. It will be 3 sides
glass and have a roof with 2 skylights.
When doing the research with the town it turns out that because of the back deck the shed is not
considered in the back yard. The application includes a variance for that as well.
The public hearing is scheduled for September 1,2022 at 1:10 PM.You can come in person or join on
Zoom if you have any comments to make.The details on how to tune in and make comments can be
found on the town website, http://southoldtownny.gov/agendacenter. The zoom link can be found at
http://southoldtownny.gov/calenderaagenda. The address to come in person is at the Town Hall 53095
Main Rd,Southold, NY 11971. This information is also available on the copy of the legal notice included

Section 280-15 and Building Inspector's May 27, 2022 Notice of Disapproval based on an
application for a permit to legalize an "as built" accessory shed and construct a sunroom
addition to an existing single family dwelling, at; 1) located in other than the code
permitted rear yard; 2) reverse a prior variance condition on Appeal No. 5696 that requires
the deck to remain open to the sky; located at: 1100 North Sea Drive, Orient, NY. SCTM
No. 1000-15-3-38.
