The applicant should take note of any conditions of approval, which may be indicated on the plan or enclosed herein. Construction must conform with approved plans as well as all applicable standards including Standards for Approval of Plans and Construction for Sewage Disposal Systems for Single Family Residences. Omissions, inconsistencies or lack of detail on the plan do not release the applicant from the responsibility of having the construction done in conformance with applicable standards. Issuance of this permit shall in no way relieve the design professional of responsibility for the adequacy of the complete design. The permit(plan)expires three (3)years after the approval date.Any modification to the approved design requires the submission of a revised plan and additional fees (if applicable)for approval prior to construction. No inspections will be performed by the department if a copy of the approved site plan/survey Is not on site during construction or if the permit has expired. Permits may be renewed, transferred, or revised in accordance with the procedures described in Instructions to Renew, Extend, or Transfer an Existing Permit for Single Family Residences (Form WWM-104). It is the applicant's responsibility to schedule an inspection of the sewage disposal and/or water supply facilities prior to backfilling. This includes inspections of the sewage collection and disposal systems, water supply system components and piping, and final grading as shown on the approved plans. This can be done by calling the department at(631)852- 5754, or through the ACA Portal at. p - .,p:p j _ OF In certain cases, inspections of the soil excavation may be required to determine the acceptability of the soils for sewage disposal systems. Excavation inspections must be confirmed by calling(631)852-5700 between 8:30a.m. and 9:30 a.m.,the morning of the inspection.Article Vll of the Code, "Septic Industry Businesses,"requires that all installers of septic systems within shall possess a valid license from the Office of Consumer Affairs. This office will not perform inspections for or grant final approval for construction of projects that are installed by an unlicensed individual. It is, therefore, in your best interest to utilize a cesspool contractor with a valid license to avoid substantial delays in your project. Final approval issued by the Department is necessary prior to the occupancy of new buildings, additions to existing buildings, or for the use of sewage disposal or water supply systems. SCTM: 1000-115-11-16 ` S Q_4 AA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under.SEQRA. S1J1 FOLK CGLiN"ly AQWhLISTRALIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated July 28, 2021 stating that this application is considered a rrtatter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION:,_, This application was referred for review under Chapter 268 Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated October 5, 2021. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposal to increase the permissible lot coverage over 20 percent is INCONSISTENT with the following LWRP standards and therefore is INCONSISTENT with the LWRP. Policy No.. l-The expansion of an existing structure over the permitted 20%lot coverage is inconsistent with the above policy and it does not support a pattern of development consistent with the Southold Town Comprehensive Plan. The expansion of structures in areas vulnerable t flooding and storm damage is unsupported. Policy No.4.1 -The residential structure does not functionally require a location on the coast and is not water dependent. The installation of a I/A OWTS is recommended as CONSISTENT and LWRP findings of INCONSISTENCY will be mitigated with the installation of an Innovative Advanced FA OWTS Septic System and the conditions imposed herein ' F 1 7 C'l"S Df$ 'CR l 1, N: The subject, non-conforming 19,166.90 square feet, .44 acre, rectangular- OP' shaped, waterfront parcel measures 100.00 feet along Lupton's Point Road (a private, 20 feet wide right of way), then runs south 182.58 feet along a residentially developed lot to the east, then runs 101.64 feet along a wood bulkhead at Deep Hole Creek and returns 200.76 feet along a second residentially developed lot to the west. BASIS OF Pl?LlQA[1 ..N: Request for a Variance from Article XXIH, Section 280-124 and the Building Inspector's June 14, 2021 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single-fancily dwelling;at; 1)more than the code permitted maximum lot, coverage of 20°%; located at: 850 Lupton Point Road, (Adj.to Deep Hole Creek)Mattituck,NY. SCTM No. 1000-11541-16. RELIEF RE jES""E : The applicant seeks a variance to allow for excessive lot coverage of 22.2%where the code limits lot coverage to 20% in the R-40 residential zone. The applicant seeks relief in order to expand their home through additions and alterations allowing for the expansion of a first-floor bedroom with the addition of a walk-in closet; the creation of a kitchen pantry; enlarge the existing kitchen; create a f1•ont porch, an entry hall with closet, and laundry room;and to reconstruct the second floor with a loft, office and balcony over the first floor. The applicant proposes the removal of approximately 338.2 square feet of exterior decking and adding an additional 854.9 square feet of habitable space and exterior decking. N, DFI-10lA.,l:N ^OR ATIf l No member of the public or immediate neighbor spoke in favor of or against this application, however, several letters of support were received from neighbors prior to the public hearing.. The property is covered by the following Town of Southold issued documents: • Certificate of Occupancy Z=1662 dated July 29, 1963 fora private one family dwelling • Certificate of Occupancy Z-3524 dated July 11; 1969 for a private one family dwelling • Zoning Board of Appeals..decision#3397 dated November 6, 1985 for construction of a deck 45 feet from the bulkhead • Certificate of Occupancy. Z=15522 dated December 19, 1986 for additions to a one family dwelling • Pre-Existing Certificate of Occupancy dated November 21, 1988 for a one l"amily dwelling • Zoning Bard of Appeals decision #4106 dated July 6, 1992 for construction of a.deck 37 feet from the bulkhead at its closest point • Certificate of Occupancy Z-28083 dated November 14, 2001 for additions to a one family dwelling FINDINGS C :I The Zoning Board of Appeals held a public hearing on this application on November 4,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 267-b :I b 11. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Lupton's Point is a private, residential, neighborhood developed over the past 100 years and is accessed via a 20-feet wide right of way that meanders through the peninsula offering residences on both side of the lane waterfront access from rear-yards. The terrain follows the coastline and is irregular establishing a unique community of a variety of house sizes and styles. Most homes are built at non- conforming locations, many do not meet required setback and several properties appear to exceed allowable lot coverage. The requested relief of 2.2% excessive lot coverage over the allowable 20% will not create a noticeable or undesirable change in the character of the community. Page 3,November 18,2021 #7556,Rosen SCTM No. 1000-115-11-16 2. Town Law 267-b ; b 2 . The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Presently, the site is developed at 19.5% lot coverage so, virtually any increase in the expansion of the existing dwelling will require variance relief. 3. Town Law 267-b b . The variance granted herein is mathematically substantial, representing 11%relief from the code. However, most of the proposed renovation is within the existing footprint and the, applicant proposes a very inodest addition of 425 square:abet of living space 4. Town Law §267-b('3)(h)(IL No evidence. has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 267-Ir b 5' . The difficulty has been self-created. The applicant purchased the parcel after.the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law $267-4. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations to their single-family dwelling resulting in 22.2 percent lot coverage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. I l SC f Il l°°IC 11 I Q I lI RQARR: In considering all of the above factors and applying the balancing test under.New Fork Town Law 267-B,motion was offered by Member Planamento, seconded by Member Lehnert, and duly, carried, to GRANT the variance as applied for,and shown on the Site Plan and Architectural Drawings illustrating the existing conditions and proposed work designed by Mark Keith Schwartz,Architect labeled S-la*b,A-1-through A=4,A- 4a,A-5 through A-7 and dated May 26, 2021.
