Y, 119'71 PLANNING BOARD MEMBERS John Wlckham, Chairman Henry Molsa Alfred Grebe Henry Raynor Frank Coyle May 22, 197~ Mr. Howard Terry, Building Inspector Town Clerk's Office Southold, New York 11971 Dear Mr. Terry: The Planning Board has approved the site plan of the 7 - ll Store at Cutchogue on May 20, 1974 and authorized the Chairman to sign it subject to a review in two years, which has been done. The Planning Board recognizes that there are two deviations from this plan. First, there are woodchip planting areas instead of the grass specified. Secondly, the chain link fence has not yet been installed. We feel that proper maintenance of this property is very important and, therefore, are willing to approve it with the two year review. I have personally inspected the property and have the follow- ing comments. The planting of small shrubs was not well done. They are generally planted too high and one is not planted at all, just set in a hole. As regards the chain link fence it seems to me that the existing chain link fence on the north and west sides is adequate. It will be necessary to have a chain link fence erected along the Danowski and Kull line. In consultation with Mr. Xull, it is our opinion that at the present time the new chain link fence should commence where Kull's concrete planting area terminates some thirty or fifty feet from the street line and run from there to the back line a distance of approximately 190 feet. It is both Mr. Kull's thought and mine that maintenance of plantings and keeping it tidy are more important than the type of fence. The Planning Board for this reason has provided for a future review. Building Inspector Page Two Because of these factors, I would like to recommend that the Building Inspector issue a temporary Certificate of Occupancy for twenty or thirty days in which time the occupants must have the fence erected and the planting rechecked. A separate system of emergency lighting shall be provided with a secondary lighting source arranged to assume auto- maritally, in case of failure of the principal lighting source, the illumination of every exitway and aisle and to maintain such illumination for a period of not less than 30 minutes in any emergency. 6. An emergency switch, conveniently located and conspicuously labelled, shall be provided for shutting down the ventilat- ing fan in case of emergency. 7. (This approval is exclusive of the hcistway.) Specifications in triplicate upon the enclosed forms shall be submitted for each elevator, dumbwaiter, escalator, hoist, etc. (Form ISS-602) hoistway; also, it will be necessary for the elevator company to submit plans in triplicate and specifications in triplicate for each elevator (Form ISS-603) prior to installa- tion, and both should be submitted at the same time so they can be acted upon simultaneously. 8. Floor mounted furnaces shall be so constructed or enclosed that all inte,ior openings for intake of air which may come in contact with flame are at least 4t above the floor. b. Suspended heating units shall be iacketed and so mounted that the flame is at least 8' above the floot. c. Ceilings, purtitions and walls within 6" of the top, bottom and sides of the suspended unit shall be of fire-resisting (I hr.) construction or protected by a shield of incombustible material. There shall be at least 1" open air space be- tween the shield and the material it is intended to protect and shield spacers shall be of incombustible matetial and at least a 3'~ clearance between the unit and any shield. d. Floor mounted furnaces shall be jacketed and shall rest upon a floor of incombustible material or upon a concrete base at least 2" thick entending at least 18~* about the perimeter of the furnace. e. Ceilings, partitions and walls within 18" from the furnace shall be of fire-resisting (1 hr.) construction or shall be protected by a shield of incombustible material. There shall be a 1" open air space between the shield and the mare- rial it is intended to protect and shield spacers shall be of incombustible material. There shall be at least 6" clear- ance between the furnace and any ceiling, partition or wall and between the furnace and any shield. f. No combustible material shall be stored within 18" from a floor mounted furnace or within 48~' from the burner side, g. No combustible material shall be stored within 6" from a suspended heating unit or within 48st from the burner side. 3. Protective features shall be provided for all warm air, hot water or low pressure steam, central furnaces and all direct fired floor mounted space heaters and suspended heating units as required by Rule 26-15. a. Furnace shall rest upon a floor of incombustible mterial or upon a concrete base at least 2t~ thick extending for a distunce of at least 24't about the perimeter of the unit. b. Units shall nat be located nearer than 6' to ceilings or partitions of combustible material, unless such construction is protected by an incombustible shield mounted on incombustible spacers so that there shall be at least 1" clearance between the combustible material and shield. Where such shield is used, clearance between the ceiling and the uhit shall be not less than 3" and between the partition and the unit shall be not less than 2", Clearances shall be meas- ared/rom the outer surface of the unit to the combustible material. Ceiling protection shall extend at least 18" about the perimeter of the unit. c. No flammable matetial shall be stored within 5' of a furnace o~ heating unit. d. Where ducts pierce a floor, there shall be provided heat-actuated dampers of No. 10 U.S. gauge steel or ~" thick dgid-asbestos sheet material. 4. The central heating furnace shall not be located in an urea where persons are intended to congregate and shall otherwise comply with Rule 36-10.1. a. Floor to have incombustible surface. b. Insulated and located so as not to overheat adiacent combustible material. c. No combustible material to be stored within 5' of such furnace. d. Chimneys sod connections shall he smoke and gas tight, firmly constructed and located or insulated so as not to over- heat adjacent combustible material. Central furnaces in theatres, motion picture theatres and other places of assembly of over 600 capacity, shall be enclosed by construction having a fire-resistive rating of at least two hours and self-closing fire doors having a rating of I hr, t. All portions of ceilings less thun 5' above the unit for a radius of 5' around a point directly above its center shall be of at least lira-resisting (1 hr.) construction, or protected by a shield of incombustible material. 2. Partitions less than 18" from the unit shall be of fire-resisting (1 hr.) construction or protected by an incombusti- ble shield. 3. The protective shield shall be mounted un incombustible spacers to p~ovide a 1" space between the shield and the moterial it is intended to protect. ~l. If unit is located closer than 6" to a ceiling, a shield of incombustible material shall be interposed between the unit and ceiling. 6. PROTECTIVE LIABILITY INSURANCE COVERAGE Permittee must have protective liability insurance coverage in accordance with Department requirements. NOTIFICATIONS Notify Commissioner, through District Office, one week prior to commencing work, except emergency work by public service utillties which should be reported the next work day. Work must start within 30 days from date of permit. Notify area gas distributors 72 hours prior to any blasting. Notify Utility Companies with facilities in work area (permission must be obtained before doing work affecting utilities' facilities) before starting work. Notify land owners of abutting lands, before disturbing trees. Notify Deportment of Transportation at conclusion of work and return original copy of permit to District Office. Annual Maintenance Permit Notifications: Notify by telephone the District or Resident Office, one week in advance, each time regular maintenance work is to be performed. In emergencies, notification by telephone should be made the next work day. 4. SITE CARE AND RESTORATION An Undertaking, a bond or certified check in an amount designated by the DepartmentofZransportation may berequired by the District Office, before a permit is issued, to guarantee restoration of the site to its original condition. If the Department is obliged to restore the site of its original condition, the costs to the Department will be deducted from the amount of the permittee's guarantee deposit at the conclusion of the work. The permittee is responsible for traffic protection and maintenance, including adequate use of signs and barriers during work and evening hours. No unnecessary obstruction is to be left on the pavement or the right of way or in such a position as to block warning signs during or between work hours. No work shall be done to obstruct drainage or divert creeks, water courses or sluices onto the right of way. All faisework must be removed and all excavations must be filled in and restored to the satisfaction of the District Engineer. 5. COSTS INCURRED BY ISSUANCE OF THIS PERMIT Ali costs beyond the limits of the protective liability insurance, surety deposits, etc., are the responsibility of the permittee. The State shall be held free of any costs incurred by the issuance of this permit, direct or indirect. 6. SUBMITTING WORK PLANS The applicant will submit work plans and/or a map as required by the Department. This shall include such details as measurements of driveways with relation to nearest corner, positions of guys supporting poles and a schedule of the number of poles and feet of excavation necessary for completion of the work on the State right of way. A description of the proposed method of construction will be included. Plan work with future adjustments in mind, as any relocation, replacement or removal of the installation authorized by this permit and made necessary by future highway maintenance~ reconstruction or new construction, will be the respon- sibility of the permittee. The permittee must coordinate his work with any state construction being conducted. 7. TRAFFIC MAINTENANCE Traffic shall be maintained by the permittee on the highway, in a safe manner, during work and evening hours until its final completion. Suitable safeguards, to reduce conditions dangerous to life, limb and property to a minimum, must be provided by the permittee (including flagmen when requested by the Department). 8. COST OF INSPECTION AND SUPERVISION If, in the accounts kept by the Department, costs of supervision are found to be exceedingly high, the Department re- serves the right to bill the permittee for actual expenses incurred by the supervision and inspection of the permittee's project. 9.
