Moore, Esq. 51020 Main Road Southold, NY 11971 RE: ABBY ROSMARIN & DAVID ROSS 640 LLOYD'S LANE, MATTITUCK SCTM# 1000-99-3-4.1 Dear Mr. Patanjo & Ms. Moore: The Board of Town Trustees took the following action during its Regular meeting held on Wednesday, August 17, 2022 regarding the above matter: WHEREAS, Jeffrey Patanjo on behalf of ABBY ROSMARIN & DAVID ROSS applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated June 8, 2022, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed applications be found Inconsistent with the LWRP, and specifically Inconsistent with the following coastal policies: Policy 6.3 — Protect and restore tidal and freshwater wetlands, specifically citing: "The unpermitted as-built patio and landscape wall had no prior permits from the Board of Trustees and as such are unpermitted structures. The enlargement of the unpermitted patio is not recommended. The as-built fire pit was also constructed without a Board of Trustee permit and is inconsistent with policy 6.3." The 2 LWRP cited the problem of storm-water run-off and the fact that all of the work proposed is above the top of bluff line and flush with surrounding grade; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 17, 2022, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the structure, as applied for does not comply with the standards set forth in Southold Town Code Chapter 275-12 A. Adversely affect the wetlands of the Town; and Chapter 275-12B. Cause damage from erosion; and Chapter 275-A. Permit Required; and WHEREAS, the proposed structure, as applied for, is located at or on a bluff area as defined in Chapter 111-1 Coastal Erosion Hazard Areas of the Town Code and governed by Chapter 111-14. Bluff area A. The following activities are prohibited on bluffs: (3) All development unless specifically allowed by Section 111-14B of this chapter; and, WHEREAS, the Board has determined that the request, as applied for, will have a detrimental effect upon the health, safety and 1general welfare of the people of the town, and, adversely weaken or undermine the lateral support of other lands in the vicinity; and WHEREAS, the structures, as applied for, do not comply with the standards set forth in the Southold Town Code, Chapter 111-8, Permit required for regulated activities; NOW THEREFORE BE IT RESOLVED, that for foregoing reasons, and because the proposed action is located within the coastal erosion hazard area and at or on a bluff area, and because the proposed action is not permitted in such area pursuant to Chapters 275 and 111 of the Town Code, that the Trustees deem the proposed project to be impermissible under Chapter 275 and Chapter 111, and, BE IT FURTHER RESOLVED that for the foregoing reasons, the Board of Trustees DENIES the Wetland and Coastal Erosion Permit application of ABBY ROSMARIN & DAVID ROSS for the as-built removal of an existing 12.3'x17.2' on grade patio and existing landscape wall (north side), with as-built 24.5' x 19' & 13' semi-circle (west side of patio) on-grade paver patio in same location as previous patio with 24"+/- tall paver block landscape wall (24.5' long),and modified-and extended (19' long) and extended ( 8'1") on west 3 side; as built on east side and partial west side of patio a landscape wall to control water runoff; with paver stone fire pit built into semi-circle patio; non-disturbance area from "top of bluff" on Filed Map seaward on bluff; 25' non-turf buffer landward of non- disturbance buffer (@15' of the 25' contains existing vegetation to remain); and as depicted on the site plan prepared by Jeffrey Patanjo, last dated August 9, 2022. This determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project.
