SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated March 11, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated June 21, 2022. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. This determination is based upon the following: 4.1 Minimize losses of human life and structures from flooding and erosion hazards. 1. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast of in coastal waters. The single-family residence does not require a location on the coast. The proposed screen porch to be located 11.5' to the bulkhead is not supported by this policy. According to the Suffolk County Hazard Mitigation Tool, the parcel is susceptible to storm damage. This area suffered damage from Tropical Storm Sandy. The coordinator notes the Southold Town Trustees issued a Wetlands Permit#9882 and the Town Board issued a Coastal Erosion Hazard Area Permit #9882C on September 21, 2021 for same proposed improvements within the J Page 2, July 21, 2022 #7655, Further Out East SCTM No. 1000-31-18-18 Coastal Erosion Hazard Area. Based on the aforementioned documents, the Board has determined that the action is CONSISTENT with the LWRP.. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 10,266 square feet (3,159 square feet buildable), .236 acre rectangular-shaped waterfront parcel located in the R40 Residential Zoning District measures 133.52 feet along Rabbit Lane, a private right of way, then runs south 82 feet to Gardiners Bay, along a private association beach, then follows the high-water mark 115.35 feet west and returns 91 feet along a residentially developed lot to the west, back to the roadway. The parcel is improved with a two-story frame dwelling with an attached garden shed, substantial `at grade' decking, a hot tub, bulkheading landward of the shore with wood platform/access steps to the beach below and a gravel driveway as shown on the survey by Gary J. Benz, Licensed Land Surveyor and last revised June 23, 2022. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124; and the Building Inspector's December 20, 2021, Amended January 3, 2022 Notice of Disapproval based on an application for a permit to demolish and reconstruct an existing single family dwelling; at; 1) less than the code required minimum front yard setback of 35 feet; 2) less than the code required minimum rear yard setback of 35 feet; 3) more than the code permitted maximum lot coverage of 20%; located at 860 Rabbit Lane(adj. to Gardiners Bay), East Marion,NY SCTM No. 1000-31-18-18. RELIEF REQUESTED: The applicant requests variances to demolish (as defined by Town Code) an existing residence with 2,253 square feet of improvements representing 71.3% lot coverage and replace it with a renovated residence with 2,203 square feet of improvements representing 69.7% lot coverage where the code limits lot coverage to 20% in the R40 Zoning District and to `reconstruct' the residence maintaining the existing front yard setback of 9.2 feet where the code requires a minimum front yard setback of 3 5 feet and to maintain an existing rear yard setback of 17 feet, where the code requires a minimum rear yard setback of 35 feet. As part of this action the applicant proposes the following additions and alterations to the existing residence(technical demolition): • Remove existing propane tank along the western side of the dwelling • Remove existing hot tub from seaward side of dwelling • Remove 132 square feet of existing seaward deck and reconstruct remaining structure in kind • Reconstruct and expand existing seaward balcony by 52 feet(104 square feet) • Remove existing cellar entrance • Abandon and remove existing sanitary system in according with Suffolk County Board of Health • Remove existing shed from the landward side of the dwelling • Remove existing chimney from the eastern side of the dwelling • Remove 358 square feet of decking from the northeasterly deck • Install new IA/OWTS landward of the existing dwelling • Construct porch along the northerly portion of the dwelling; 67 square feet and setback 61 feet from wetlands • Construct screen porch along the easterly side of the existing dwelling; 381.25 square feet and setback 11.5 feet from seaward bulkhead • Install new propane tank • Construct new basement access along westerly side of existing dwelling • Construct addition on the northeastern corner of existing dwelling; 58 square feet setback 66 feet from wetlands • Install 112 linear feet of retaining wall along the northeast corner of the property • Renovate the existing dwelling ADDITIONAL INFORMATION: The Coastal Erosion Hazard Line runs parallel to the shoreline and bisects the existing residence in the FEMA designated zone X property. The subject property consists of two parcels;the subject ~ Page 3,July 21,2022 #7655,Further Out East S CTM No. 1000-31-18-18 bayfront lot known as Suffolk County Tax Map 1000-31-18-18 and Suffolk County Tax Map 1000-31-17-19, a vacant lakefront parcel located opposite the subject property on the landward side of the existing right of way. When purchased the applicant acquired both lots; it is unknow whether the vacant, lakefront lot across Rabbit Lane can be developed with a single-family residence, however, the applicant, as part of the public hearing and record indicated their intention to `merge'the two lots and at a later point apply for a permit to build an accessory garage on the vacant parcel to service the residence. As a result of the right of way it is improbable to `merge' the lots. The applicant indicated that they would be willing to create covenants and restrictions, to be filed with Suffolk County, acceptable to the Town of Southold Attorney to ensure that the vacant lot would not be developed with a dwelling. The subject parcel is the beneficiary of Zoning Board of Appeals decision #5957 dated November 2, 2006 granting relief for an addition to the second floor of the existing single family residence. The Board of the Town of Southold Trustees issued wetland permit#9882 on May 19, 2021. The Board of the Town of Southold Trustees issued wetland permit#9882C on September 21, 2021 after the Town Board of the Town of Southold granted Approval for construction in the Coastal Erosion Hazard Area. During the public hearing no immediate neighbor spoke in opposition to or in favor of this application. However, several neighbors voiced their concerns over the applicant limiting their access and enjoyment to the private right of way known as Rabbit Lane and the footpath access to the association beach that is adjacent to the applicant's property. Of additional concern to the beach access user is the placement of the IA/OWTS sanitary system blower close to that footpath. The applicant indicated they will relocate the vent to another location on site. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 7, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is located at the end of an unpaved, private right of way adjacent to an association beach and opposite a vacant lot owned by the applicant. Additionally, most of the neighboring residences are older homes that have been substantially altered and updated to reflect current needs and taste. The applicant proposes a technical demolition to their property in order to update the house. While the applicant proposes the addition of an enclosed,screen porch on the east side of the residence and other alterations that may imply an increase in lot coverage,they are actually reducing the existing lot coverage from 71.3%to 69.7%. Furthermore, the applicant proposes to maintain the existing non-conforming front and rear yard setbacks. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing residence is presently sited with a front yard setback of 9.2 feet from the roadway and 17 feet from the rear-yard bulkhead at Gardiners Bay. Excessive lot coverage, including substantial at grade decking, has existed for many years without complaint and is covered by an existing Certificate of Occupancy; the buildable lot area today would allow the construction of a structure with a maximum footprint of approximately 631 square feet and would be further impacted by the Coastal Erosion Hazard Line. Alternatively, the Town Board has reviewed the action and has granted permission for the `technical' demolition, alteration and addition as requested by the applicant. 3. Town Law X267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 248% lot coverage over the allowable 20% for the R40 Zoning District; 74% relief from the code relative to a reduced front yard setback of 9.2 feet; and 51%relief from the code relative to a reduced rear yard setback. However,the applicant Page 4,July 21,2022 #7655, Further Out East SCTM No. 1000-31-18-18 proposes to reduce the lot coverage from the existing 71.3%and does not propose any alteration to the existing front and rear yard setbacks during the renovation. Since the house is not located in a FEMA designated flood zone (property is classified as Zone X), they do not propose any elevational change in height or other disruptive activity and will maintain the existing residential structure and foundation. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Stony► Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions to a renovated residence while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Acampora, and duly carried, to GRANT the variances as applied for, and shown on the survey by Gary J. Benz, Licensed Land Surveyor and last revised June 23, 2022 and the architectural drawings consisting of floor plans and elevations labeled A-100, A-tOl, and A-200 prepared by Joseph Fischetti, Jr., License Professional Engineer, last dated October 12, 2021. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The installation of a Suffolk County Department of Health approved Innovative Advanced (IA/OWTS) sanitary system. 2. Relocation of the IA/OWTS `blower' shall be located at a minimum of 10 feet away from the association beach access path. 3. The right of way, Rabbit Lane, shall not to be blocked in anyway or at any time by construction equipment, contractors, parked vehicles, etc. 4. The association beach path shall not be blocked at any time 5. The applicant shall maintain a construction fence at the perimeter of SCTM: 1000-31-18-18 during the constriction period ensuring debris and equipment, etc. remain on site, which shall be removed prior to issuance of the final Certificate of Occupancy, 6. The proposed screen porch on the east side of the residence shall remain unconditioned and without enclosure of any kind other than `screening'. The porch is to contain minimal electric and no plumbing. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or apossible denial by the Building Department of a buildingpermit, and may require a new application and public hearing before the Zoning Board of Appeals. Page 5,July 21, 2022 #7655, Further Out East SCTM No. 1000-31-18-18 Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. The single-family residence does not require a location on the coast. The proposed screen porch to be located 11.5' to the bulkhead is not supported by this policy. According to the Suffolk County Hazard Mitigation Tool, the parcel is susceptible to storm damage. This area suffered damage from Tropical Storm Sandy. Portions of the structures are located within the CERA. The proposed 69.7 percent lot coverage on the parcel is contrary to preventing loss to structure in hazardous areas. The structures within these areas are subject to repetitive loss from storm surges and flooding and should be avoided and/or minimized.
