VX100e Southo d Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JULY 21, 2022 ZBA FILE: 7654 NAME OF APPLICANT: Thomas Kennedy PROPERTY LOCATION: 200 Castle Hill Road, Cutchogue SCTM No. 1000-72-1-1.6 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated March 9, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. As built structures are inconsistent with Policy 1. Building structures without proper reviews erodes community character and circumvents the codes and regulations in place that protects health, safety, and the environment. An application to the Building Department for built structures, and a review by the Zoning Board of Appeals amends the action to CONSISTENT.The expansion of the Gazebo may still be considered INCONSISTENT. The coordinator has recommended a buffer of native plantings to minimize impacts near the bluff in the event that actions are approved. PROPERTY FACTS/DESCRIPTION: The subject parcel is a 78, 831.97 sq. ft. non-conforming lot located in an R-80 Zoning District. The property has a 242. 5 feet front yard located on a right of way off of Castle Hill Road, then turns northwest for 437.85 feet toward Long Island Sound, there is 225.00 feet of Sound front property line before returning southeast for 387.42 ft back to the right of way. The property is improved with an existing two story dwelling, with an accessory in-ground swimming pool all as shown on survey prepared by Michael J. Scalice, L.S. last revised March 15, 2022. BASIS OF APPLICATION: Request for Variances from Article XXIII,Section 280-116A(1);Article XXIII,Section 280-124; and the Building Inspector's January 18, 2022 Notice of Disapproval based on an application for a permit to construct an accessory gazebo and to legalize an "as built" accessory shed; at; 1) gazebo is located in other than i Page 2,July 21,2022 #7654, Kennedy SCTM No. 1000-72-1-1.6 the code permitted rear yard; 2) shed is located less than the code required minimum side yard setback of 20 feet; 3) Both gazebo and shed are located less than the code required 100 feet from the top of the bluff; located at: 200 Castle Hill Road (Adj. to Long Island Sound) Cutchogue,NY. SCTM No. 1000-72-1-1.6. RELIEF REQUESTED: The applicant requests variances for the following: 1. The proposed gazebo is located in the side yard, where a rear yard location is required. 2. The proposed gazebo is shown to be located at 46 feet from the top of the bluff where a 100 ft. minimum is required. 3. The"As-Built"shed has a 0 ft side yard setback. 4. The"As-built" shed is located 61.4 feet from the top of the bluff where a 100 ft minimum is required. ADDITIONAL INFORMATION: Certificates of occupancy were submitted for the existing house and inground swimming pool. In oral testimony, the applicant's agent gave statements about the expansion of the existing patio and retaining wall being built seaward of the existing gazebo to support the proposed new gazebo. Testimony was also given that the existing shed has been in the same location for many years without adverse impact. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 7, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances for the as built shed will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing shed has been in the same place for a number of years and cannot be seen from the street or adjacent properties because it is totally screened by mature, dense landscaping. The 18.3 ft. x 10.3 ft. shed is used solely for storage purposes. Grant of the variances for the enlarged new gazebo will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the terrain is very sloped and constructing the proposed stacked masonry retaining wall that would be required for a larger gazebo will create additional ground disturbance into the hill and will also increase the degree of non-conformance of the current bluff setback. Alternative relief for a new replacement gazebo in the side yard and with the same bluff setback as the current gazebo will not produce a change in the neighborhood or a detriment to nearby properties. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The "As-Built" shed and existing and proposed gazebo are located in the side yard where the code requires a rear yard location and they are both less than the code required minimum setback of 100 ft from the bluff. Any improvements or legalizations would require area variance relief. 3. Town Law §267-b(3)(b)(3). The variances s granted herein are mathematically substantial as follows: 1. The gazebo is located in the side yard thereby needing 100% relief from the code. 2. The"As-Built"shed is located 0 ft from the property line, representing 100% relief from the code. 3. The new gazebo is proposed to be located 46 ft from the bluff, representing a 54% relief from the code. 4. The"As-Built"shed is located 61.4 ft from the top of the bluff, representing a 38.6 % relief from the code. However,the requested and alternative relief granted herein is mitigated by conditions of approval recommended by the LWRP coordinator to install and maintain a drought-tolerant vegetated non-turf buffer to minimize lawn area, and avoid irrigation near the bluff system, and to to integrate existing vegetation into the buffer where feasible. No evidence has been submitted to suggest that a variance in this residential community for the as built shed will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions imposed by this Board. Evidence has been submitted to suggest that a variance in this residential community for the proposed new gazebo will have an adverse impact on the physical or environmental conditions in the neighborhood (see Town Law 1 above). However, alternative relief for a new replacement gazebo that will maintain the current non-conforming bluff setback and retaining wall location will not require additional land disturbance close to the bluff, and will not have an adverse impact. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of alternative relief, and the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a "as-built" shed, and new gazebo while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Lehnert,seconded by Member Planamento,and duly carried, to GRANT the variances for both the bluff and side yard setbacks of the "As-Built: shed, and the side yard location for a replacement gazebo as shown on the survey prepared by Michael J. Scalice, Land Surveyor, last revised March 15, 2022. DENY the variance for the gazebo bluff setback as applied for, and GRANT ALTERNATIVE RELIEF for a new replacement gazebo at no less than the bluff setback of the existing gazebo. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The dwelling immediately situated to the east on the adjoining parcel is shown to be set back approximately 35 feet from its closest point to the "top" of the bluff, and the dwelling adjoining to the west is shown to be set back approximately 70 feet to the "top" of the bluff. Each dwelling is set back more than 150 feet from the tie line along mean highwater of the L.I. Sound. 6. It is the position of this Board that in considering this application: (a) the relief, as noted below, is not substantial and is the minimum necessary; (b) the grant of the requested relief will not alter the essential character of the neighborhood; (c) the difficulties are uniquely related to the property and are not personal in nature; (d) the variance will not in turn be adverse to the safety, health, welfare, comfort, convenience or order of the town, or be adverse to neighboring properties; (e) in view of all the above, the interests of justice will be served by granting relief, as conditionally noted below.
